92_SB0397sam001 LRB9207627ARsbam 1 AMENDMENT TO SENATE BILL 397 2 AMENDMENT NO. . Amend Senate Bill 397 as follows: 3 by replacing everything after enacting clause with the 4 following: 5 "Section 5. The Firearm Owners Identification Card Act 6 is amended by adding Section 8.5 as follows: 7 (430 ILCS 65/8.5 new) 8 "Sec. 8.5. Department to conduct ongoing criminal 9 history checks. 10 (a) The Department shall, for every person to whom a 11 Firearm Owner's Identification Card is issued, inquire 12 through the Law Enforcement Agencies Data System (LEADS) to 13 ascertain whether or not the person has been convicted of any 14 of the offenses enumerated in Section 8 of this Act that 15 would disqualify him or her from holding a Firearm Owner's 16 Identification Card. This inquiry shall be done on an 17 ongoing basis as determined by the Director but not less than 18 once every 6 months. If the inquiry reveals that the person 19 has been convicted of any of the disqualifying offenses 20 enumerated in Section 8 of this Act, the Department shall 21 immediately send written notice to the person as required by 22 Section 9 of this Act and revoke the person's card. -2- LRB9207627ARsbam 1 (b) The Department shall pursue the feasibility of 2 conducting ongoing and periodic background checks of 3 appropriate national data systems via the National Instant 4 Criminal Background Check System. 5 Section 99. Effective date. This Act takes effect on 6 January 1, 2002.".
