92_SB0397eng SB397 Engrossed LRB9207627ARsb 1 AN ACT concerning firearms. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Firearm Owners Identification Card Act is 5 amended by adding Section 8.5 as follows: 6 (430 ILCS 65/8.5 new) 7 Sec. 8.5. Department to conduct ongoing criminal history 8 checks. 9 (a) The Department shall, for every person to whom a 10 Firearm Owner's Identification Card is issued, inquire 11 through the Law Enforcement Agencies Data System (LEADS) to 12 ascertain whether or not the person has been convicted of any 13 of the offenses enumerated in Section 8 of this Act that 14 would disqualify him or her from holding a Firearm Owner's 15 Identification Card. This inquiry shall be done on an 16 ongoing basis as determined by the Director but not less than 17 once every 6 months. If the inquiry reveals that the person 18 has been convicted of any of the disqualifying offenses 19 enumerated in Section 8 of this Act, the Department shall 20 immediately send written notice to the person as required by 21 Section 9 of this Act and revoke the person's card. 22 (b) The Department shall pursue the feasibility of 23 conducting ongoing and periodic background checks of 24 appropriate national data systems via the National Instant 25 Criminal Background Check System. 26 Section 99. Effective date. This Act takes effect on 27 January 1, 2002.
