90_HB1090 105 ILCS 5/10-21.7-5 new 105 ILCS 5/34-84a.2 new 720 ILCS 5/31-9 new Amends the School Code and the Criminal Code of 1961. Requires school principals, chief administrative officers of private schools, and college or university presidents or chancellors to report to local law enforcement agencies felony and misdemeanor violations that occur in the schools, colleges, and universities or at school related activities supervised by school employees. Violations are petty offenses with $500 fines imposed for each incident of criminal violations not reported. LRB9004959RCsb LRB9004959RCsb 1 AN ACT to require administrators of certain educational 2 institutions to report certain criminal offenses. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The School Code is amended by adding Sections 6 10-21.7-5 and 34-84a.2 as follows: 7 (105 ILCS 5/10-21.7-5 new) 8 Sec. 10-21.7-5. Principal to report incidents of 9 felonies and misdemeanors occurring in school, on school 10 grounds or at supervised school activities. The principal 11 shall report the occurrence of a felony or misdemeanor 12 offense occurring on school grounds, in the school, on a 13 school bus, or at an activity supervised by school employees 14 to the local law enforcement agency within 24 hours after the 15 principal becomes aware of the occurrence. 16 (105 ILCS 5/34-84a.2 new) 17 Sec. 34-84a.2. Principal to report incidents of felonies 18 and misdemeanors occurring in school, on school grounds, or 19 at supervised school activities. The principal of each 20 attendance center shall report the occurrence of a felony or 21 misdemeanor offense occurring on school grounds, in the 22 school, on a school bus, or at an activity supervised by 23 school employees to the local law enforcement agency within 24 24 hours after the principal becomes aware of the occurrence. 25 Section 10. The Criminal Code of 1961 is amended by 26 adding Section 31-9 as follows: 27 (720 ILCS 5/31-9 new) 28 Sec. 31-9. School administrators to report incidents of -2- LRB9004959RCsb 1 felonies and misdemeanors occurring in school, on school 2 grounds, or at supervised school activities. 3 (a) The principal of each attendance center of a public 4 elementary or secondary school, the chief administrative 5 officer of a private school, and the president or chancellor 6 of each college or university shall report the occurrence of 7 a felony or misdemeanor offense occurring on school grounds, 8 in the school, on a school bus, or at an activity supervised 9 by school employees to the local law enforcement agency 10 within 24 hours after the principal, officer, president, or 11 chancellor becomes aware of the occurrence. 12 (b) Sentence. A person who knowingly violates this 13 Section is guilty of a petty offense for which the court 14 shall impose a fine of $500 for each occurrence in which the 15 principal, officer, president, or chancellor fails to report 16 an offense as required by this Section.
