Provides that the Governor shall designate one of the 3 student members of the University of Illinois Board of Trustees as a voting member. Effective July 1, 1997. LRB9003488THcc HB0923 Engrossed LRB9003488THcc 1 AN ACT relating to membership on the governing boards of 2 public universities. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The University of Illinois Trustees Act is 6 amended by changing Section 1 as follows: 7 (110 ILCS 310/1) (from Ch. 144, par. 41) 8 Sec. 1. The Board of Trustees of the University of 9 Illinois shall consist of 9 trustees appointed by the 10 Governor, by and with the advice and consent of the Senate, 11 the Governor, and onenonvotingstudent member from each 12 campus of the University of Illinois. 13 Eachnonvotingstudent member shall serve a term of one 14 year, beginning on July 1 of each year or on the date of his 15 or her selection, whichever is later, and expiring on the 16 next succeeding June 30. The student members shall have all 17 of the privileges of membership, including the right to make 18 and second motions and to attend executive sessions, except 19 that only one student member, designated by the Governor at 20 the Governor's discretion, shall haveother thanthe right to 21 vote. The method of selecting these student members shall be 22 determined by campus-wide student referendum. Nonvoting 23 student members shall not be considered members for the 24 purpose of determining a quorum at any meeting of the board 25 or any of its committees. To be eligible for selection as a 26 student member, to be eligible for designation by the 27 Governor as a student member who has the right to vote, and 28 to be eligible to remain as a voting or nonvoting student 29 member of the Board, a student member must be a resident of 30 this State, must have and maintain a grade point average that 31 is equivalent to at least 2.5 on a 4.0 scale, and must be HB0923 Engrossed -2- LRB9003488THcc 1 enrolled for a minimum of 8 semester hours of university 2 credit at all times during his or her term of office except 3 for that part of the term which follows the completion of the 4 last full regular semester of an academic year and precedes 5 the first full regular semester of the succeeding academic 6 year at the university (sometimes commonly referred to as the 7 summer session or summer school). If a voting or nonvoting 8 student member serving on the Board fails to continue to meet 9 or maintain the residency, minimum grade point average, or 10 minimum semester hour enrollment requirement established by 11 this Section, his or her membership on the Board shall be 12 deemed to have terminated by operation of law. 13 The term of each elected trustee who is in office on the 14 effective date of this amendatory Act of 1995 shall terminate 15 on the second Monday in January, 1996, or when a quorum of 16 the trustees initially to be appointed under this amendatory 17 Act of 1995 is appointed and qualified, whichever last 18 occurs. 19 No more than 5 of the 9 trusteesmembersappointed by the 20 Governor shall be affiliated with the same political party. 21 The term of office of each appointed trustee shall be 6 years 22 from the third Monday in January of each odd numbered year, 23 except that of the 9 trustees initially appointed by the 24 Governor, 3 shall be appointed for terms that commence on the 25 date of their appointment and expire on the second Monday in 26 January, 1997; 3 shall be appointed for terms that commence 27 on the date of their appointment and expire on the second 28 Monday in January, 1999; and 3 shall be appointed for terms 29 that commence on the date of their appointment and expire on 30 the second Monday in January, 2001. Upon expiration of the 31 terms of the members initially appointed by the Governor, 32 their respective successors shall be appointed for terms of 6 33 years from the second Monday in January of each odd numbered 34 year and until their respective successors are appointed and HB0923 Engrossed -3- LRB9003488THcc 1 qualified. 2 Vacancies shall be filled for the unexpired term in the 3 same manner as original appointments. If a vacancy in 4 membership occurs at a time when the Senate is not in 5 session, the Governor shall make temporary appointments until 6 the next meeting of the Senate, when he shall appoint persons 7 to fill such memberships for the remainder of their 8 respective terms. If the Senate is not in session when 9 appointments for a full term are made, appointments shall be 10 made as in the case of vacancies. 11 No action of the board shall be invalidated by reason of 12 any vacancies on the board, or by reason of any failure to 13 selectnonvotingstudent members. 14 (Source: P.A. 89-4, eff. 7-1-95 (eff. date changed from 15 1-1-96 by P.A. 89-24); 89-5, eff. 1-1-96.) 16 Section 10. The Southern Illinois University Management 17 Act is amended by changing Sections 2 and 5 as follows: 18 (110 ILCS 520/2) (from Ch. 144, par. 652) 19 Sec. 2. The Board shall consist of 7 members appointed by 20 the Governor, by and with the advice and consent of the 21 Senate, the Superintendent of Public Instruction, or his 22 chief assistant for liaison with higher education when 23 designated to serve in his place, ex-officio, and 2nonvoting24 student members each to be selected by the respective 25 campuses of Southern Illinois University at Carbondale and at 26 Edwardsville. The method of selecting these student members 27 shall be determined by campus-wide student referendum. The 28 student members shall serve terms of one year beginning on 29 July 1 of each year, except that the student members 30 initially selected shall serve a term beginning on the date 31 of such selection and expiring on the next succeeding June 32 30. Members of the Board shall elect annually by 30 secret ballot from their own number a chairman who shall 31 preside over meetings of the Board and a secretary. 32 Meetings of the Board shall be held at least once each 33 quarter on a campus of Southern Illinois University. The Chicago State University Law is amended 18 by changing Sections 5-15 and 5-25 as follows: 19 (110 ILCS 660/5-15) 20 Sec. 5-15. Membership; terms; vacancies. The Board 21 shall consist of 7 voting members appointed by the Governor 22 by and with the advice and consent of the Senate, and one 23 votingnonvotingmember who is a student at Chicago State 24 University. The method of selecting the student member shall 25 be determined by a campus-wide student referendum. The 26 student member shall serve a term of one year beginning on 27 July 1 of each year, except that the student member initially 28 selected shall serve a term beginning on the date of his or 29 her selection and expiring on the next succeeding June 30. The method of selecting the student member shall 5 be determined by a campus-wide student referendum. The 6 student member shall serve a term of one year beginning on 7 July 1 of each year, except that the student member initially 8 selected shall serve a term beginning on the date of his or 9 her selection and expiring on the next succeeding June 30. To 10 be eligible to remain as a student member of the Board, the 11 student member must be a resident of this State, must have 12 and maintain a grade point average that is equivalent to at 13 least 2.5 on a 4.0 scale, and must be enrolled for a minimum 14 of 8 semester hours of university credit at all times during 15 his or her term of office except for that part of the term 16 which follows the completion of the last full regular 17 semester of an academic year and precedes the first full 18 regular semester of the succeeding academic year at the 19 university (sometimes commonly referred to as the summer 20 session or summer school). If a student member serving on 21 the Board fails to continue to meet or maintain the 22 residency, minimum grade point average, or minimum semester 23 hour enrollment requirement established by this Section, his 24 or her membership on the Board shall be deemed to have 25 terminated by operation of law. Of the members first 26 appointed by the Governor, 4 shall be appointed for terms to 27 expire on the third Monday in January, 1999, and 3 shall be 28 appointed for terms to expire on the third Monday in January, 29 2001. If the Senate is not in session on the effective date 30 of this Article, or if a vacancy in an appointive membership 31 occurs at a time when the Senate is not in session, the 32 Governor shall make temporary appointments until the next 33 meeting of the Senate when he shall nominate persons to fill 34 such memberships for the remainder of their respective terms.
