1 AMENDMENT TO HOUSE BILL 2259
2 AMENDMENT NO. . Amend House Bill 2259 as follows:
3 on page 1, line 6 by deleting "15-113,"; and
4 on page 1, by replacing lines 20 through 26 with the
5 following:
6 "(d) Non-designated highways are highways in the system
7 of State highways not designated as Class I, II, or III, or
8 local highways which are part of any county, township,
9 municipal, or district road system. Local authorities also
10 may designate Class II or Class III highways within their
11 systems of highways."; and
12 on page 2, by deleting lines 19 through 25; and
13 by replacing lines 12 through 34 on page 8 and lines 1 and 2
14 of page 9 with the following:
15 "(e-1) A vehicle and load not exceeding 8 feet 6 inches
16 in width is allowed access according to the following:
17 (1) A vehicle and load not exceeding 73,280 pounds
18 in weight is allowed access from any State designated
19 highway onto any county, township, or municipal highway
20 for a distance of 5 highway miles for the purpose of
21 loading and unloading, provided:
22 (A) The vehicle and load does not exceed 65

1 feet overall length.
2 (B) There is no sign prohibiting that access.
3 (C) The route is not being used as a
4 thoroughfare between State designated highways.
5 (2) A vehicle and load not exceeding 73,280 pounds
6 in weight is allowed access from any State designated
7 highway onto any county or township highway for a
8 distance of 5 highway miles or onto any municipal highway
9 for a distance of one highway mile for the purpose of
10 food, fuel, repairs, and rest, provided:
11 (A) The vehicle and load does not exceed 65
12 feet overall length.
13 (B) There is no sign prohibiting that access.
14 (C) The route is not being used as a
15 thoroughfare between State designated highways.
16 (3) A vehicle and load not exceeding 80,000 pounds
17 in weight is allowed access from a Class I highway onto
18 any street or highway for a distance of one highway mile
19 for the purpose of loading, unloading, food, fuel,
20 repairs, and rest, provided there is no sign prohibiting
21 that access.
22 (4) A vehicle and load not exceeding 80,000 pounds
23 in weight is allowed access from a Class I or Class II
24 highway onto any State highway or any locally designated
25 highway for a distance of 5 highway miles for the purpose
26 of loading, unloading, food, fuel, repairs, and rest.
27 (5) A trailer or semi-trailer not exceeding 28 feet
28 6 inches in length, that was originally in combination
29 with a truck tractor, shall have unlimited access to
30 points of loading and unloading.
31 (6) All household goods carriers shall have
32 unlimited access to points of loading and unloading.
33 Vehicles operating under this paragraph (e) shall have
34 access for a distance of one highway mile to or from a Class

1 I highway on any street or highway, unless there is a sign
2 prohibiting the access, or 5 highway miles to or from a Class
3 I or II highway on a street or highway included in the system
4 of State highways and upon any street or highway designated
5 by local authorities or road district commissioners, without
6 additional fees, to points of loading and unloading and to
7 facilities for food, fuel, repairs and rest. In addition, any
8 trailer or semitrailer not exceeding 28 feet 6 inches in
9 length, that was originally in combination with a truck
10 tractor, and all household goods carriers, when operating
11 under paragraph (e), shall have access to points of loading
12 and unloading."; and
13 on page 9, line 27, after "highway", by inserting "in this
14 State"; and
15 on page 10, by deleting line 6; and
16 on page 10, line 7, by replacing "(3)" with "(2)"; and
17 on page 10, by replacing lines 22 through 24 with the
18 following:
19 "Vehicles operating during daylight hours when
20 transporting poles, pipes, machinery, or other objects of a
21 structural nature that cannot readily be dismembered are
22 exempt from length limitations, provided that no object may
23 exceed 80 feet in length and the overall dimension of the
24 vehicle including the load may not exceed 100 feet. This
25 exemption does not apply to operation on a Saturday, Sunday,
26 or legal holiday. Legal holidays referred to in this Section
27 are the days on which the following traditional holidays are
28 celebrated: New Year's Day; Memorial Day; Independence Day;
29 Labor Day; Thanksgiving Day; and Christmas Day.
30 Vehicles and loads operated by a public utility while en
31 route to make emergency repairs to public service facilities
32 or properties are exempt from length limitations, provided

1 that during night operations every vehicle and its load must
2 be equipped with a sufficient number of clearance lamps on
3 both sides and marker lamps on the extreme ends of any
4 projecting load to clearly mark the dimensions of the load.
5 A tow truck in combination with a disabled vehicle or
6 combination of disabled vehicles, as provided in paragraph
7 (6) of subsection (c) of this Section, is exempt from length
8 limitations.
9 All other combinations not listed in this subsection (b)
10 may not exceed 60 feet overall dimension. Subject to the";
11 and
12 on page 12, below line 3, by inserting the following:
13 "(6) A tow truck in combination with a disabled
14 vehicle or combination of disabled vehicles, provided the
15 towing vehicle:
16 (A) Is specifically designed as a tow truck
17 having a gross vehicle weight rating of at least
18 18,000 pounds and equipped with air brakes, provided
19 that air brakes are required only if the towing
20 vehicle is towing a vehicle, semitrailer, or
21 tractor-trailer combination that is equipped with
22 air brakes. For the purpose of this subsection,
23 gross vehicle weight rating, or GVWR, means the
24 value specified by the manufacturer as the loaded
25 weight of the tow truck.
26 (B) Is equipped with flashing, rotating, or
27 oscillating amber lights, visible for at least 500
28 feet in all directions.
29 (C) Is capable of utilizing the lighting and
30 braking systems of the disabled vehicle or
31 combination of vehicles.
32 (D) Does not engage a tow exceeding 50 highway
33 miles from the initial point of wreck or disablement
34 to a place of repair. Any additional movement of the

1 vehicles may occur only upon issuance of
2 authorization for that movement under the provisions
3 of Section 15-301 through 15-319 of this Code.
4 The Department may by rule or regulation prescribe
5 additional requirements regarding length limitations for
6 a tow truck towing another vehicle."; and
7 on page 13, by replacing line 22 with the following:
8 "exceed 75 feet overall dimension.
9 Vehicles operating during daylight hours when
10 transporting poles, pipes, machinery, or other objects of a
11 structural nature that cannot readily be dismembered are
12 exempt from length limitations, provided that no object may
13 exceed 80 feet in length and the overall dimension of the
14 vehicle including the load may not exceed 100 feet. This
15 exemption does not apply to operation on a Saturday, Sunday,
16 or legal holiday. Legal holidays referred to in this Section
17 are the days on which the following traditional holidays are
18 celebrated: New Year's Day; Memorial Day; Independence Day;
19 Labor Day; Thanksgiving Day; and Christmas Day.
20 Vehicles and loads operated by a public utility while en
21 route to make emergency repairs to public service facilities
22 or properties are exempt from length limitations, provided
23 that during night operations every vehicle and its load must
24 be equipped with a sufficient number of clearance lamps on
25 both sides and marker lamps on the extreme ends of any
26 projecting load to clearly mark the dimensions of the load.
27 A tow truck in combination with a disabled vehicle or
28 combination of disabled vehicles, as provided in paragraph
29 (6) of subsection (c) of this Section, is exempt from length
30 limitations. Notwithstanding any"; and
31 on page 14, by replacing lines 19 through 22 with the
32 following:
33 "such as rear view mirrors, turn signals, marker lamps, steps

1 and handholds for entry and egress, flexible fender
2 extensions, bumpers, mudflaps and splash and spray
3 suppressant devices, load-induced tire bulge, refrigeration";
4 and
5 on page 15, by replacing line 20 with "provided:"; and
6 on page 16, by replacing lines 15 through 21 with the
7 following:
8 "(8) A truck in transit transporting 3 trucks
9 coupled together by the triple saddlemount method may not
10 exceed 75 feet overall dimension.
11 Vehicles operating during daylight hours when
12 transporting poles, pipes, machinery, or other objects of a
13 structural nature that cannot readily be dismembered are
14 exempt from length limitations, provided that no object may
15 exceed 80 feet in length and the overall dimension of the
16 vehicle including the load may not exceed 100 feet. This

1 respect to streets and highways under their jurisdiction, may
2 also by ordinance or resolution allow length limitations of
3 this subsection (e). In addition to the designation of
4 highways"; and
5 on page 17, by replacing lines 22 through 25 with the
6 following:
7 "such as rear view mirrors, turn signals, marker lamps, steps
8 and handholds for entry and egress, flexible fender
9 extensions, bumpers, mudflaps and splash and spray
10 suppressant devices, load-induced tire bulge, refrigeration";
11 and
12 on page 18, by replacing lines 5 through 15 with the
13 following:
14 "(1) A vehicle and load not exceeding 73,280 pounds
15 in weight is allowed access from any State designated
16 highway onto any county, township, or municipal highway
17 for a distance of 5 highway miles for the purpose of
18 loading and unloading, provided:
19 (A) The vehicle and load does not exceed 65

11 highway for a distance of 5 highway miles for the purpose
12 of loading, unloading, food, fuel, repairs, and rest.
13 (5) All household goods carriers shall have
14 unlimited access to points of loading and unloading.";
15 and
16 on page 18, after line 28, by inserting the following:
17 "(4) The distance between the kingpin and the
18 center axle of a semitrailer longer than 48 feet, in
19 combination with a truck tractor, may not exceed 42 feet
20 6 inches."; and
21 on page 40, by replacing lines 5 through 15 with the
22 following:
23 "(1) A vehicle and load not exceeding 73,280 pounds
24 in weight is allowed access from any State designated
25 highway onto any county, township, or municipal highway
26 for a distance of 5 highway miles for the purpose of
27 loading and unloading, provided:
28 (A) The vehicle and load does not exceed 65
29 feet overall length.
30 (B) There is no sign prohibiting that access.
31 (C) The route is not being used as a
32 thoroughfare between State designated highways.

24 and lines 1 through 14 of page 46.
