92_HB1436enr HB1436 Enrolled LRB9202656NTsb 1 AN ACT in relation to education. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 3. The School Code is amended by changing 5 Sections 21-7.1 and 21-27 as follows: 6 (105 ILCS 5/21-7.1) (from Ch. 122, par. 21-7.1) 7 Sec. 21-7.1. Administrative certificate. 8 (a) After July 1, 1999, an administrative certificate 9 valid for 5 years of supervising and administering in the 10 public common schools (unless changed under subsection (a-5) 11 of this Section) may be issued to persons who have graduated 12 from a regionally accredited institution of higher learning 13 with a master's degree and who have been recommended by a 14 recognized institution of higher learning as having completed 15 a program of preparation for one or more of these 16 endorsements. Such programs of academic and professional 17 preparation required for endorsement shall be administered by 18 the institution in accordance with standards set forth by the 19 State Superintendent of Education in consultation with the 20 State Teacher Certification Board. 21 (a-5) Beginning July 1, 2003, if an administrative 22 certificate holder holds a Standard Teaching Certificate, the 23 validity period of the administrative certificate shall be 24 changed, if necessary, so that the validity period of the 25 administrative certificate coincides with the validity period 26 of the Standard Teaching Certificate. Beginning July 1, 2003, 27 if an administrative certificate holder holds a Master 28 Teaching Certificate, the validity period of the 29 administrative certificate shall be changed so that the 30 validity period of the administrative certificate coincides 31 with the validity period of the Master Teaching Certificate. HB1436 Enrolled -2- LRB9202656NTsb 1 (b) No administrative certificate shall be issued for 2 the first time after June 30, 1987 and no endorsement 3 provided for by this Section shall be made or affixed to an 4 administrative certificate for the first time after June 30, 5 1987 unless the person to whom such administrative 6 certificate is to be issued or to whose administrative 7 certificate such endorsement is to be affixed has been 8 required to demonstrate as a part of a program of academic or 9 professional preparation for such certification or 10 endorsement: (i) an understanding of the knowledge called for 11 in establishing productive parent-school relationships and of 12 the procedures fostering the involvement which such 13 relationships demand; and (ii) an understanding of the 14 knowledge required for establishing a high quality school 15 climate and promoting good classroom organization and 16 management, including rules of conduct and instructional 17 procedures appropriate to accomplishing the tasks of 18 schooling; and (iii) a demonstration of the knowledge and 19 skills called for in providing instructional leadership. The 20 standards for demonstrating an understanding of such 21 knowledge shall be set forth by the State Board of Education 22 in consultation with the State Teacher Certification Board, 23 and shall be administered by the recognized institutions of 24 higher learning as part of the programs of academic and 25 professional preparation required for certification and 26 endorsement under this Section. As used in this subsection: 27 "establishing productive parent-school relationships" means 28 the ability to maintain effective communication between 29 parents and school personnel, to encourage parental 30 involvement in schooling, and to motivate school personnel to 31 engage parents in encouraging student achievement, including 32 the development of programs and policies which serve to 33 accomplish this purpose; and "establishing a high quality 34 school climate" means the ability to promote academic HB1436 Enrolled -3- LRB9202656NTsb 1 achievement, to maintain discipline, to recognize substance 2 abuse problems among students and utilize appropriate law 3 enforcement and other community resources to address these 4 problems, to support teachers and students in their education 5 endeavors, to establish learning objectives and to provide 6 instructional leadership, including the development of 7 policies and programs which serve to accomplish this purpose; 8 and "providing instructional leadership" means the ability to 9 effectively evaluate school personnel, to possess general 10 communication and interpersonal skills, and to establish and 11 maintain appropriate classroom learning environments. The 12 provisions of this subsection shall not apply to or affect 13 the initial issuance or making on or before June 30, 1987 of 14 any administrative certificate or endorsement provided for 15 under this Section, nor shall such provisions apply to or 16 affect the renewal after June 30, 1987 of any such 17 certificate or endorsement initially issued or made on or 18 before June 30, 1987. 19 (c) Administrative certificates shall be renewed every 5 20fiveyears with the first renewal being 5fiveyears 21 following the initial receipt of an administrative 22 certificate, unless the validity period for the 23 administrative certificate has been changed under subsection 24 (a-5) of this Section, in which case the certificate shall be 25 renewed at the same time that the Standard or Master Teaching 26 Certificate is renewed. 27 (c-5) Before July 1, 2003, renewal requirements for 28 administrators whose positions require certification shall be 29 based upon evidence of continuing professional education 30 which promotes the following goals: (1) improving 31 administrators' knowledge of instructional practices and 32 administrative procedures; (2) maintaining the basic level of 33 competence required for initial certification; and (3) 34 improving the mastery of skills and knowledge regarding the HB1436 Enrolled -4- LRB9202656NTsb 1 improvement of teaching performance in clinical settings and 2 assessment of the levels of student performance in their 3 schools. Evidence of continuing professional education must 4 include verification of biennial attendance in a program 5 developed by the Illinois Administrators' Academy and 6 verification of annual participation in a school district 7 approved activity which contributes to continuing 8 professional education. 9 (c-10) Beginning July 1, 2003, except as otherwise 10 provided in subsection (c-15) of this Section, persons 11 holding administrative certificates must follow the 12 certificate renewal procedure set forth in this subsection 13 (c-10), provided that those persons holding administrative 14 certificates on June 30, 2003 who are renewing those 15 certificates on or after July 1, 2003 shall be issued new 16 administrative certificates valid for 5 years (unless changed 17 under subsection (a-5) of this Section), which may be renewed 18 thereafter as set forth in this subsection (c-10). 19 (1) A person holding an administrative certificate 20 and employed in a position requiring administrative 21 certification, including a regional superintendent of 22 schools, must develop an administrative certificate 23 renewal plan for satisfying the continuing professional 24 development required to renew his or her administrative 25 certificate. An administrative certificate renewal plan 26 must include a minimum of 3 individual improvement goals 27 developed by the certificate holder and must include 28 without limitation the following continuing professional 29 development purposes: 30 (A) To improve the administrator's knowledge 31 of instructional practices and administrative 32 procedures in accordance with the Illinois 33 Professional School Leader Standards. 34 (B) To maintain the basic level of competence HB1436 Enrolled -5- LRB9202656NTsb 1 required for initial certification. 2 (C) To improve the administrator's mastery of 3 skills and knowledge regarding the improvement of 4 teaching performance in clinical settings and 5 assessment of the levels of student performance in 6 the schools. 7 An administrative certificate renewal plan must include a 8 description of how the improvement goals are to be 9 achieved and an explanation of the selected continuing 10 professional development activities to be completed, each 11 of which must meet one or more of the continuing 12 professional development purposes specified in this 13 paragraph (1). 14 (2) In addition to the requirements in paragraph 15 (1) of this subsection (c-10), the administrative 16 certificate renewal plan must include the following in 17 order for the certificate to be renewed: 18 (A) Participation in continuing professional 19 development activities, which must total a minimum 20 of 100 hours of continuing professional development 21 and which must meet all of the following 22 requirements: 23 (i) The participation must consist of a 24 minimum of 5 activities per validity period of 25 the certificate. 26 (ii) The activities must address the 27 goals in the certificate holder's professional 28 development plan. 29 (iii) The activities must be aligned with 30 the Illinois Professional School Leader 31 Standards. 32 (iv) A portion of the activities must 33 address the certificate holder's school 34 improvement plan at either the district or HB1436 Enrolled -6- LRB9202656NTsb 1 school level. 2 (v) The participation must include a 3 communication, dissemination, or application 4 component. 5 (vi) There must be documentation of 6 completion of each activity. 7 (B) Participation every year in an Illinois 8 Administrators' Academy course, which participation 9 must total a minimum of 36 continuing professional 10 development hours during the period of the 11 certificate's validity and which must include all of 12 the following: 13 (i) Completion of applicable required 14 coursework, as defined by the State Board of 15 Education. 16 (ii) Completion of a communication, 17 dissemination, or application component. 18 (iii) Documentation of completion of each 19 activity. 20 (3) Each administrator who is subject to the 21 requirements of this subsection (c-10) but who is not 22 serving as a district or regional superintendent, a 23 director of a cooperative program or special education 24 program, or a director of a State-operated school must 25 submit his or her administrative certificate renewal plan 26 for review to the superintendent of the employing school 27 district or to the director of the cooperative or special 28 education program or State-operated school (or to the 29 superintendent's or director's designee). Each district 30 or regional superintendent, director of a cooperative 31 program or special education program, or director of a 32 State-operated school must submit his or her 33 administrative certificate renewal plan for review to a 34 review panel comprised of peers established by the HB1436 Enrolled -7- LRB9202656NTsb 1 regional superintendent of schools for the geographic 2 area where the certificate holder is employed as an 3 administrator. 4 (4) If the certificate holder's plan does not 5 conform to the requirements of this subsection (c-10), 6 the reviewer or review panel must notify the certificate 7 holder, who must revise the administrative certificate 8 renewal plan. A certificate holder who is not a regional 9 superintendent of schools may appeal that determination 10 to the regional superintendent of schools for the 11 geographic area where the certificate holder is employed 12 as an administrator. A certificate holder who is a 13 regional superintendent of schools may appeal that 14 determination to the State Superintendent of Education. 15 The regional superintendent of schools or the State 16 Superintendent of Education (or the regional 17 superintendent's or State Superintendent's designee) 18 shall facilitate any modification of the plan, if 19 necessary, to make it acceptable. 20 (5) A certificate holder may modify his or her 21 administrative certificate renewal plan at any time 22 during the validity period of the administrative 23 certificate through the process outlined in paragraphs 24 (3) and (4) of this subsection (c-10). 25 (6) Evidence of completion of the activities in the 26 administrative certificate renewal plan must be submitted 27 to the responsible reviewer or review panel. Before the 28 expiration of the administrative certificate, the 29 certificate holder must request from the responsible 30 reviewer or review panel a signed verification form 31 developed by the State Board of Education confirming that 32 the certificate holder has met the requirements for 33 renewal contained in this Section. A certificate holder 34 who is not a regional superintendent of schools must HB1436 Enrolled -8- LRB9202656NTsb 1 submit this form to the responsible regional 2 superintendent of schools (or his or her designee) at the 3 time of application for renewal of the certificate. A 4 certificate holder who is a regional superintendent of 5 schools must submit this form for validation to the State 6 Superintendent of Education (or his or her designee) at 7 the time of application for renewal of the certificate. 8 (7) The regional superintendent of schools shall 9 review and validate the verification form for a 10 certificate holder. Based on compliance with all of the 11 requirements for renewal, the regional superintendent of 12 schools shall forward a recommendation for renewal or 13 non-renewal to the State Superintendent of Education and 14 shall notify the certificate holder of the 15 recommendation. The State Superintendent of Education 16 shall review the recommendation to renew or non-renew and 17 shall notify, in writing, the certificate holder of a 18 decision denying renewal of his or her certificate. Any 19 decision regarding non-renewal of an administrative 20 certificate may be appealed to the State Teacher 21 Certification Board. 22 The State Board of Education, in consultation with the 23 State Teacher Certification Board, shall adopt rules to 24 implement this subsection (c-10). 25 The regional superintendent of schools shall monitor the 26 process for renewal of administrative certificates 27 established in this subsection (c-10). 28 (c-15) This subsection (c-15) applies to the first 29 period of an administrative certificate's validity during 30 which the holder becomes subject to the requirements of 31 subsection (c-10) of this Section if the certificate has less 32 than 5 years' validity or has less than 5 years' validity 33 remaining when the certificate holder becomes subject to the 34 requirements of subsection (c-10) of this Section. With HB1436 Enrolled -9- LRB9202656NTsb 1 respect to this period, the 100 hours of continuing 2 professional development and 5 activities per validity period 3 specified in clause (A) of paragraph (2) of subsection (c-10) 4 of this Section shall instead be deemed to mean 20 hours of 5 continuing professional development and one activity per year 6 of the certificate's validity or remaining validity and the 7 36 continuing professional development hours specified in 8 clause (B) of paragraph (2) of subsection (c-10) of this 9 Section shall instead be deemed to mean completion of at 10 least one course per year of the certificate's validity or 11 remaining validity. If the certificate has 3 or fewer years 12 of validity or 3 or fewer years of validity remaining, the 13 certificate holder is not subject to the requirements for 14 submission and approval of plans for continuing professional 15 development described in paragraphs (1) through (4) of 16 subsection (c-10) of this Section with respect to that period 17 of the certificate's validity. 18 (c-20) The State Board of Education, in consultation 19 with the State Teacher Certification Board, shall develop 20 procedures for implementing this Section and shall administer 21 the renewal of administrative certificates. Failure to submit 22 satisfactory evidence of continuing professional education 23 which contributes to promoting the goals of this Section 24 shall result in a loss of administrative certification. 25 (d) Any limited or life supervisory certificate issued 26 prior to July 1, 1968 shall continue to be valid for all 27 administrative and supervisory positions in the public 28 schools for which it is valid as of that date as long as its 29 holder meets the requirements for registration or renewal as 30 set forth in the statutes or until revoked according to law. 31 (e) The administrative or supervisory positions for 32 which the certificate shall be valid shall be determined by 33 one or more of 3 endorsements: general supervisory, general 34 administrative and superintendent. HB1436 Enrolled -10- LRB9202656NTsb 1 Subject to the provisions of Section 21-1a, endorsements 2 shall be made under conditions set forth in this Section. 3 The State Board of Education shall, in consultation with the 4 State Teacher Certification Board, adopt rules pursuant to 5 the Illinois Administrative Procedure Act, establishing 6 requirements for obtaining administrative certificates where 7 the minimum administrative or supervisory requirements 8 surpass those set forth in this Section. 9 The State Teacher Certification Board shall file with the 10 State Board of Education a written recommendation when 11 considering additional administrative or supervisory 12 requirements. All additional requirements shall be based 13 upon the requisite knowledge necessary to perform those tasks 14 required by the certificate. The State Board of Education 15 shall in consultation with the State Teacher Certification 16 Board, establish standards within its rules which shall 17 include the academic and professional requirements necessary 18 for certification. These standards shall at a minimum 19 contain, but not be limited to, those used by the State Board 20 of Education in determining whether additional knowledge will 21 be required. Additionally, the State Board of Education 22 shall in consultation with the State Teacher Certification 23 Board, establish provisions within its rules whereby any 24 member of the educational community or the public may file a 25 formal written recommendation or inquiry regarding 26 requirements. 27 (1) Until July 1, 2003, the general supervisory 28 endorsement shall be affixed to the administrative 29 certificate of any holder who has at least 16 semester 30 hours of graduate credit in professional education 31 including 8 semester hours of graduate credit in 32 curriculum and research and who has at least 2 years of 33 full-time teaching experience or school service personnel 34 experience in public schools, schools under the HB1436 Enrolled -11- LRB9202656NTsb 1 supervision of the Department of Corrections, schools 2 under the administration of the Department of 3 Rehabilitation Services, or nonpublic schools meeting the 4 standards established by the State Superintendent of 5 Education or comparable out-of-state recognition 6 standards approved by the State Superintendent of 7 Education. 8 Such endorsement shall be required for supervisors, 9 curriculum directors and for such similar and related 10 positions as determined by the State Superintendent of 11 Education in consultation with the State Teacher 12 Certification Board. 13 (2) The general administrative endorsement shall be 14 affixed to the administrative certificate of any holder 15 who has at least 20 semester hours of graduate credit in 16 educational administration and supervision and who has at 17 least 2 years of full-time teaching experience or school 18 service personnel experience in public schools, schools 19 under the supervision of the Department of Corrections, 20 schools under the administration of the Department of 21 Rehabilitation Services, or nonpublic schools meeting the 22 standards established by the State Superintendent of 23 Education or comparable out-of-state recognition 24 standards approved by the State Superintendent of 25 Education. 26 Such endorsement shall be required for principal, 27 assistant principal, assistant or associate 28 superintendent, junior college dean and for related or 29 similar positions as determined by the State 30 Superintendent of Education in consultation with the 31 State Teacher Certification Board. 32 Notwithstanding any other provisions of this Act, 33 after January 1, 1990 and until January 1, 1991, any 34 teacher employed by a district subject to Article 34 HB1436 Enrolled -12- LRB9202656NTsb 1 shall be entitled to receive an administrative 2 certificate with a general administrative endorsement 3 affixed thereto if he or she: (i) had at least 3 years of 4 experience as a certified teacher for such district prior 5 to August 1, 1985; (ii) obtained a Master's degree prior 6 to August 1, 1985; (iii) completed at least 20 hours of 7 graduate credit in education courses (including at least 8 12 hours in educational administration and supervision) 9 prior to September 1, 1987; and (iv) has received a 10 rating of superior for at least each of the last 5 years. 11 Any person who obtains an administrative certificate with 12 a general administrative endorsement affixed thereto 13 under this paragraph shall not be qualified to serve in 14 any administrative position except assistant principal. 15 (3) The chief school business official endorsement 16 shall be affixed to the administrative certificate of any 17 holder who qualifies by having a Master's degree, two 18 years of administrative experience in school business 19 management, and a minimum of 20 semester hours of 20 graduate credit in a program established by the State 21 Superintendent of Education in consultation with the 22 State Teacher Certification Board for the preparation of 23 school business administrators. Such endorsement shall 24 also be affixed to the administrative certificate of any 25 holder who qualifies by having a Master's Degree in 26 Business Administration, Finance or Accounting from a 27 regionally accredited institution of higher education. 28 After June 30, 1977, such endorsement shall be 29 required for any individual first employed as a chief 30 school business official. 31 (4) The superintendent endorsement shall be affixed 32 to the administrative certificate of any holder who has 33 completed 30 semester hours of graduate credit beyond the 34 master's degree in a program for the preparation of HB1436 Enrolled -13- LRB9202656NTsb 1 superintendents of schools including 16 semester hours of 2 graduate credit in professional education and who has at 3 least 2 years experience as an administrator or 4 supervisor in the public schools or the State Board of 5 Education or education service regions or in nonpublic 6 schools meeting the standards established by the State 7 Superintendent of Education or comparable out-of-state 8 recognition standards approved by the State 9 Superintendent of Education and holds general supervisory 10 or general administrative endorsement, or who has had 2 11 years of experience as a supervisor or administrator 12 while holding an all-grade supervisory certificate or a 13 certificate comparable in validity and educational and 14 experience requirements. 15 After June 30, 1968, such endorsement shall be 16 required for a superintendent of schools, except as 17 provided in the second paragraph of this Section and in 18 Section 34-6. 19 Any person appointed to the position of 20 superintendent between the effective date of this Act and 21 June 30, 1993 in a school district organized pursuant to 22 Article 32 with an enrollment of at least 20,000 pupils 23 shall be exempt from the provisions of this paragraph 24Subsection(4) until June 30, 1996. 25 (f) All official interpretations or acts of issuing or 26 denying administrative certificates or endorsements by the 27 State Teacher's Certification Board, State Board of Education 28 or the State Superintendent of Education, from the passage of 29 P.A. 81-1208 on November 8, 1979 through September 24, 1981 30 are hereby declared valid and legal acts in all respects and 31 further that the purported repeal of the provisions of this 32 Section by P.A. 81-1208 and P.A. 81-1509 is declared null and 33 void. 34 (Source: P.A. 91-102, eff. 7-12-99.) HB1436 Enrolled -14- LRB9202656NTsb 1 (105 ILCS 5/21-27) 2 Sec. 21-27. The Illinois Teaching Excellence Program. 3 The Illinois Teaching Excellence Program is hereby 4 established to provide categorical funding for monetary 5 incentives and bonuses for teachers who are employed by 6 school districts and who hold a Master Certificate. The 7 State Board of Education shall allocate and distribute to 8 each school district an amount as annually appropriated by 9 the General Assembly from federal funds for the Illinois 10 Teaching Excellence Program. Unless otherwise provided by 11 appropriation, each school district's annual allocation shall 12 be the sum of the amounts earned for the following incentives 13 and bonuses: 14 (1) An annualA one-timepayment of $3,000 to be 15 paid to each teacher who successfully completes the 16 program leading to and who receives a Master Certificate 17 and is employed as a teacher by a school district. The 18 school district shall distribute this payment to each 19 eligible teacher as a single payment or in not more than 20 3 payments. 21 (2) An annual incentive equal to $1,000 shall be 22 paid to each teacher who holds a Master Certificate, who 23 is employed as a teacher by a school district, and who 24 agrees, in writing, to provide 60 hours of mentoring 25 during that year to classroom teachers. This mentoring 26 may include, either singly or in combination, (i) 27 providing high quality professional development for new 28 and experienced teachers, and (ii) assisting National 29 Board for Professional Teaching Standards (NBPTS) 30 candidates through the NBPTS certification process. The 31 school district shall distribute 50% of each annual 32 incentive payment upon completion of 30 hours of the 33 required mentoring and the remaining 50% of the incentive 34 upon completion of the required 60 hours of mentoring. HB1436 Enrolled -15- LRB9202656NTsb 1 Credit may not be granted by a school district for 2 mentoring or related services provided during a regular 3 school day or during the total number of days of required 4 service for the school year. 5 (3) An annual incentive equal to $3,000 shall be 6 paid to each teacher who holds a Master Certificate, who 7 is employed as a teacher by a school district, and who 8 agrees, in writing, to provide 60 hours of mentoring 9 during that year to classroom teachers in schools on the 10 Academic Early Warning List or in schools in which 50% or 11 more of the students receive free or reduced price 12 lunches, or both. The school district shall distribute 13 50% of each annual incentive payment upon completion of 14 30 hours of the required mentoring and the remaining 50% 15 of the incentive upon completion of the required 60 hours 16 of mentoring. Credit may not be granted by a school 17 district for mentoring or related services provided 18 during a regular school day or during the total number of 19 days of required service for the school year. 20 Each regional superintendent of schools shall provide 21 information about the Master Certificate Program of the 22 National Board for Professional Teaching Standards (NBPTS) 23 and this amendatory Act of the 91st General Assembly to each 24 individual seeking to register or renew a certificate under 25 Section 21-14 of this Code. 26 (Source: P.A. 91-606, eff. 8-16-99.) 27 Section 5. The School Code is amended by changing 28 Sections 21-2, 21-14, and 21-16 as follows: 29 (105 ILCS 5/21-2) (from Ch. 122, par. 21-2) 30 Sec. 21-2. Grades of certificates. 31 (a)Until February 15, 2000,All certificates issued 32 under this Article shall be State certificates valid, except HB1436 Enrolled -16- LRB9202656NTsb 1 as limited in Section 21-1, in every school district coming 2 under the provisions of this Act and shall be limited in time 3 and designated as follows: Provisional vocational 4 certificate, temporary provisional vocational certificate, 5 early childhood certificate, elementary school certificate, 6 special certificate, secondaryhigh schoolcertificate, 7 school service personnel certificate, administrative 8 certificate, provisional certificate, and substitute 9 certificate. The requirement of student teaching under close 10 and competent supervision for obtaining a teaching 11 certificate may be waived by the State Teacher Certification 12 Board upon presentation to the Board by the teacher of 13 evidence of 5 years successful teaching experience on a valid 14 certificate and graduation from a recognized institution of 15 higher learning with a bachelor's degreewith not less than16120 semester hours and a minimum of 16 semester hours in17professional education. 18 (b) Initial Teaching Certificate.Beginning February 15,192000,Persons who (1) have completed an approved teacher 20 preparation program, (2) are recommended by an approved 21 teacher preparation program, (3) have successfully completed 22 the Initial Teaching Certification examinations required by 23 the State Board of Education, and (4) have met all other 24 criteria established by the State Board of Education in 25 consultation with the State Teacher Certification Board, 26 shall be issued an Initial Teaching Certificate valid for 4 27 years of teaching, as defined in Section 21-14 of this Code. 28 Initial Teaching Certificates shall be issued for categories 29 corresponding to Early Childhood, Elementary, Secondary, and 30 Special K-12, with special certification designations for 31 Special Education, Bilingual Education, fundamental learning 32 areas (including Language Arts, Reading, Mathematics, 33 Science, Social Science, Physical Development and Health, 34 Fine Arts, and Foreign Language), and other areas designated HB1436 Enrolled -17- LRB9202656NTsb 1 by the State Board of Education, in consultation with the 2 State Teacher Certification Board. 3 (c) Standard Certificate.Beginning February 15, 2000,4 (1) Persons who (i)(1)have completed 4 years of 5 teaching, as defined in Section 21-14 of this Code, with an 6 Initial Certificate or an Initial Alternative Teaching 7 Certificate and have met all other criteria established by 8 the State Board of Education in consultation with the State 9 Teacher Certification Board, (ii)(2)have completed 4 years 10 of teaching on a valid equivalent certificate in another 11 State or territory of the United States, or have completed 4 12 years of teaching in a nonpublic Illinois elementary or 13 secondary school with an Initial Certificate or an Initial 14 Alternative Teaching Certificate, and have met all other 15 criteria established by the State Board of Education, in 16 consultation with the State Teacher Certification Board, or 17 (iii)(3)were issued teaching certificates prior to February 18 15, 2000 and are renewing those certificates after February 19 15, 2000, shall be issued a Standard Certificate valid for 5 20 years, which may be renewed thereafter every 5 years by the 21 State Teacher Certification Board based on proof of 22 continuing education or professional development. Beginning 23 July 1, 2003, persons who have completed 4 years of teaching, 24 as described in clauses (i)(1)and (ii)(2)of this 25 paragraph (1)subsection (c), have successfully completed 26 the requirements of paragraphs (2) through (4) of this 27 subsection (c)Standard Teaching Certificate Examinations, 28 and have met all other criteria established by the State 29 Board of Education, in consultation with the State Teacher 30 Certification Board, shall be issued Standard Certificates. 31 Standard Certificates shall be issued for categories 32 corresponding to Early Childhood, Elementary, Secondary, and 33 Special K-12, with special certification designations for 34 Special Education, Bilingual Education, fundamental learning HB1436 Enrolled -18- LRB9202656NTsb 1 areas (including Language Arts, Reading, Mathematics, 2 Science, Social Science, Physical Development and Health, 3 Fine Arts, and Foreign Language), and other areas designated 4 by the State Board of Education, in consultation with the 5 State Teacher Certification Board. 6 (2) This paragraph (2) applies only to those persons 7 required to successfully complete the requirements of this 8 paragraph under paragraph (1) of this subsection (c). In 9 order to receive a Standard Teaching Certificate, a person 10 must satisfy one of the following requirements, which the 11 person must identify, in writing, as the requirement that the 12 person has chosen to satisfy to the responsible local 13 professional development committee established pursuant to 14 subsection (f) of Section 21-14 of this Code: 15 (A) Completion of a program of induction and 16 mentoring for new teachers that is based upon a specific 17 plan approved by the State Board of Education, in 18 consultation with the State Teacher Certification Board. 19 The plan must describe the role of mentor teachers, the 20 criteria and process for their selection, and how all the 21 following components are to be provided: 22 (i) Assignment of a formally trained mentor 23 teacher to each new teacher for a specified period 24 of time, which shall be established by the employing 25 school or school district but shall be at least 2 26 school years in duration, provided that a mentor 27 teacher may not directly or indirectly participate 28 in the evaluation of a new teacher pursuant to 29 Article 24A of this Code or the evaluation procedure 30 of the school. 31 (ii) Formal mentoring for each new teacher. 32 (iii) Support for each new teacher in relation 33 to the Illinois Professional Teaching Standards, the 34 content-area standards applicable to the new HB1436 Enrolled -19- LRB9202656NTsb 1 teacher's area of certification, and any applicable 2 local school improvement and professional 3 development plans. 4 (iv) Professional development specifically 5 designed to foster the growth of each new teacher's 6 knowledge and skills. 7 (v) Formative assessment that is based on the 8 Illinois Professional Teaching Standards and 9 designed to provide feedback to the new teacher and 10 opportunities for reflection on his or her 11 performance, which must not be used directly or 12 indirectly in any evaluation of a new teacher 13 pursuant to Article 24A of this Code or the 14 evaluation procedure of the school and which must 15 include the activities specified in clauses (B)(i), 16 (B)(ii), and (B)(iii) of this paragraph (2). 17 (vi) Assignment of responsibility for 18 coordination of the induction and mentoring program 19 within each school district participating in the 20 program. 21 (B) Successful completion of 4 semester hours of 22 graduate-level coursework on the assessment of one's own 23 performance in relation to the Illinois Professional 24 Teaching Standards. The coursework must be approved by 25 the State Board of Education, in consultation with the 26 State Teacher Certification Board; must be offered either 27 by an institution of higher education, by such an 28 institution in partnership with a teachers' association 29 or union or with a regional office of education, or by 30 another entity authorized to issue college credit; and 31 must include demonstration of performance through all of 32 the following activities for each of the Illinois 33 Professional Teaching Standards: 34 (i) Observation, by the course instructor or HB1436 Enrolled -20- LRB9202656NTsb 1 another experienced teacher, of the new teacher's 2 classroom practice (the observation may be recorded 3 for later viewing) for the purpose of identifying 4 and describing how the new teacher made content 5 meaningful for students; how the teacher motivated 6 individuals and the group and created an environment 7 conducive to positive social interactions, active 8 learning, and self-motivation; what instructional 9 strategies the teacher used to encourage students' 10 development of critical thinking, problem solving, 11 and performance; how the teacher communicated using 12 written, verbal, nonverbal, and visual communication 13 techniques; and how the teacher maintained standards 14 of professional conduct and provided leadership to 15 improve students' learning. 16 (ii) Review and analysis, by the course 17 instructor or another experienced teacher, of 18 written documentation (i.e., lesson plans, 19 assignments, assessment instruments, and samples of 20 students' work) prepared by the new teacher for at 21 least 2 lessons. The documentation must provide 22 evidence of classroom performance related to 23 Illinois Professional Teaching Standards 1 through 24 9, with an emphasis on how the teacher used his or 25 her understanding of students, assessment data, and 26 subject matter to decide on learning goals; how the 27 teacher designed or selected activities and 28 instructional materials and aligned instruction to 29 the relevant Illinois Learning Standards; how the 30 teacher adapted or modified curriculum to meet 31 individual students' needs; and how the teacher 32 sequenced instruction and designed or selected 33 student assessment strategies. 34 (iii) Demonstration of professional expertise HB1436 Enrolled -21- LRB9202656NTsb 1 on the part of the new teacher in reflecting on his 2 or her practice, which was observed under clause 3 (B)(i) of this paragraph (2) and documented under 4 clause (B)(ii) of this paragraph (2), in terms of 5 teaching strengths, weaknesses, and implications for 6 improvement according to the Illinois Professional 7 Teaching Standards. 8 (C) Successful completion of a minimum of 4 9 semester hours of graduate-level coursework addressing 10 preparation to meet the requirements for certification by 11 the National Board for Professional Teaching Standards 12 (NBPTS). The coursework must be approved by the State 13 Board of Education, in consultation with the State 14 Teacher Certification Board, and must be offered either 15 by an institution of higher education, by such an 16 institution in partnership with a teachers' association 17 or union or with a regional office of education, or by 18 another entity authorized to issue college credit. The 19 course must address the 5 NBPTS Core Propositions and 20 relevant standards through such means as the following: 21 (i) Observation, by the course instructor or 22 another experienced teacher, of the new teacher's 23 classroom practice (the observation may be recorded 24 for later viewing) for the purpose of identifying 25 and describing how the new teacher made content 26 meaningful for students; how the teacher motivated 27 individuals and the group and created an environment 28 conducive to positive social interactions, active 29 learning, and self-motivation; what instructional 30 strategies the teacher used to encourage students' 31 development of critical thinking, problem solving, 32 and performance; how the teacher communicated using 33 written, verbal, nonverbal, and visual communication 34 techniques; and how the teacher maintained standards HB1436 Enrolled -22- LRB9202656NTsb 1 of professional conduct and provided leadership to 2 improve students' learning. 3 (ii) Review and analysis, by the course 4 instructor or another experienced teacher, of 5 written documentation (i.e., lesson plans, 6 assignments, assessment instruments, and samples of 7 students' work) prepared by the new teacher for at 8 least 2 lessons. The documentation must provide 9 evidence of classroom performance, including how the 10 teacher used his or her understanding of students, 11 assessment data, and subject matter to decide on 12 learning goals; how the teacher designed or selected 13 activities and instructional materials and aligned 14 instruction to the relevant Illinois Learning 15 Standards; how the teacher adapted or modified 16 curriculum to meet individual students' needs; and 17 how the teacher sequenced instruction and designed 18 or selected student assessment strategies. 19 (iii) Demonstration of professional expertise 20 on the part of the new teacher in reflecting on his 21 or her practice, which was observed under clause 22 (C)(i) of this paragraph (2) and documented under 23 clause (C)(ii) of this paragraph (2), in terms of 24 teaching strengths, weaknesses, and implications for 25 improvement. 26 (D) Receipt of an advanced degree from an 27 accredited institution of higher education in an 28 education-related field, provided that at least 8 29 semester hours of the coursework completed count toward a 30 degree, certificate, or endorsement in a teaching field. 31 (E) Accumulation of 60 continuing professional 32 development units (CPDUs), earned by completing selected 33 activities that comply with paragraphs (3) and (4) of 34 this subsection (c). However, for an individual who holds HB1436 Enrolled -23- LRB9202656NTsb 1 an Initial Teaching Certificate on the effective date of 2 this amendatory Act of the 92nd General Assembly, the 3 number of CPDUs shall be reduced to reflect the teaching 4 time remaining on the Initial Teaching Certificate. 5 (F) Completion of a nationally normed, 6 performance-based assessment, if made available by the 7 State Board of Education in consultation with the State 8 Teacher Certification Board, provided that the cost to 9 the person shall not exceed the cost of the coursework 10 described in clause (B) of this paragraph (2). 11 (3) This paragraph (3) applies only to those persons 12 required to successfully complete the requirements of this 13 paragraph under paragraph (1) of this subsection (c). At 14 least one-half the CPDUs a person must accrue in order to 15 qualify for a Standard Teaching Certificate must be earned 16 through completion of coursework, workshops, seminars, 17 conferences, and other similar training events that are 18 pre-approved by the State Board of Education, in consultation 19 with the State Teacher Certification Board, for the purpose 20 of reflection on teaching practices in order to address all 21 of the Illinois Professional Teaching Standards necessary to 22 obtain a Standard Teaching Certificate. These activities must 23 meet all of the following requirements: 24 (A) Each activity must be designed to advance a 25 person's knowledge and skills in relation to one or more 26 of the Illinois Professional Teaching Standards or in 27 relation to the content-area standards applicable to the 28 teacher's field of certification. 29 (B) Taken together, the activities completed must 30 address each of the Illinois Professional Teaching 31 Standards as provided in clauses (B)(i), (B)(ii), and 32 (B)(iii) of paragraph (2) of this subsection (c). 33 (C) Each activity must be provided by an entity 34 approved by the State Board of Education, in consultation HB1436 Enrolled -24- LRB9202656NTsb 1 with the State Teacher Certification Board, for this 2 purpose. 3 (D) Each activity, integral to its successful 4 completion, must require participants to demonstrate the 5 degree to which they have acquired new knowledge or 6 skills, such as through performance, through preparation 7 of a written product, through assembling samples of 8 students' or teachers' work, or by some other means that 9 is appropriate to the subject matter of the activity. 10 (E) One CPDU shall be available for each hour of 11 direct participation by a holder of an Initial Teaching 12 Certificate in a qualifying activity. An activity may be 13 attributed to more than one of the Illinois Professional 14 Teaching Standards, but credit for any activity shall be 15 counted only once. 16 (4) This paragraph (4) applies only to those persons 17 required to successfully complete the requirements of this 18 paragraph under paragraph (1) of this subsection (c). The 19 balance of the CPDUs a person must accrue in order to qualify 20 for a Standard Teaching Certificate, in combination with 21 those earned pursuant to paragraph (3) of this subsection 22 (c), may be chosen from among the following, provided that an 23 activity listed in clause (C) of this paragraph (4) shall be 24 creditable only if its provider is approved for this purpose 25 by the State Board of Education, in consultation with the 26 State Teacher Certification Board: 27 (A) Collaboration and partnership activities 28 related to improving a person's knowledge and skills as a 29 teacher, including all of the following: 30 (i) Peer review and coaching. 31 (ii) Mentoring in a formal mentoring program, 32 including service as a consulting teacher 33 participating in a remediation process formulated 34 under Section 24A-5 of this Code. HB1436 Enrolled -25- LRB9202656NTsb 1 (iii) Facilitating parent education programs 2 directly related to student achievement for a 3 school, school district, or regional office of 4 education. 5 (iv) Participating in business, school, or 6 community partnerships directly related to student 7 achievement. 8 (B) Teaching college or university courses in areas 9 relevant to a teacher's field of certification, provided 10 that the teaching may only be counted once during the 11 course of 4 years. 12 (C) Conferences, workshops, institutes, seminars, 13 and symposiums related to improving a person's knowledge 14 and skills as a teacher, including all of the following: 15 (i) Completing non-university credit directly 16 related to student achievement, the Illinois 17 Professional Teaching Standards, or content-area 18 standards. 19 (ii) Participating in or presenting at 20 workshops, seminars, conferences, institutes, and 21 symposiums. 22 (iii) Training as external reviewers for the 23 State Board of Education. 24 (iv) Training as reviewers of university 25 teacher preparation programs. 26 (D) Other educational experiences related to 27 improving a person's knowledge and skills as a teacher, 28 including all of the following: 29 (i) Participating in action research and 30 inquiry projects. 31 (ii) Observing programs or teaching in 32 schools, related businesses, or industry that is 33 systematic, purposeful, and relevant to a teacher's 34 field of certification. HB1436 Enrolled -26- LRB9202656NTsb 1 (iii) Participating in study groups related to 2 student achievement, the Illinois Professional 3 Teaching Standards, or content-area standards. 4 (iv) Participating in work/learn programs or 5 internships. 6 (v) Developing a portfolio of students' and 7 teacher's work. 8 (E) Professional leadership experiences related to 9 improving a person's knowledge and skills as a teacher, 10 including all of the following: 11 (i) Participating in curriculum development or 12 assessment activities at the school, school district, 13 regional office of education, State, or national level. 14 (ii) Participating in team or department 15 leadership in a school or school district. 16 (iii) Participating on external or internal 17 school or school district review teams. 18 (iv) Publishing educational articles, columns, 19 or books relevant to a teacher's field of 20 certification. 21 (v) Participating in non-strike related 22 activities of a professional association or labor 23 organization that are related to professional 24 development. 25 (5) A person must complete his or her chosen requirement 26 under paragraph (2) of this subsection (c) before the 27 expiration of his or her Initial Teaching Certificate and 28 must submit evidence of having done so to the local 29 professional development committee. Within 30 days after 30 receipt of a person's evidence of completion, the local 31 professional development committee shall forward the evidence 32 of completion to the responsible regional superintendent of 33 schools along with the local professional development 34 committee's recommendation, based on that evidence, as to HB1436 Enrolled -27- LRB9202656NTsb 1 whether the person is eligible to receive a Standard Teaching 2 Certificate. The local professional development committee 3 shall provide a copy of this recommendation to the affected 4 person. 5 The regional superintendent of schools shall review the 6 evidence of completion submitted by a person and, based upon 7 compliance with all of the requirements for receipt of a 8 Standard Teaching Certificate, shall forward to the State 9 Board of Education a recommendation for issuance or 10 non-issuance. The regional superintendent of schools shall 11 notify the affected person of the recommendation forwarded. 12 Upon review of a regional superintendent of school's 13 recommendations, the State Board of Education shall issue 14 Standard Teaching Certificates to those who qualify and shall 15 notify a person, in writing, of a decision denying a Standard 16 Teaching Certificate. Any decision denying issuance of a 17 Standard Teaching Certificate to a person may be appealed to 18 the State Teacher Certification Board. 19 (6) The State Board of Education, in consultation with 20 the State Teacher Certification Board, may adopt rules to 21 implement this subsection (c) and may periodically evaluate 22 any of the methods of qualifying for a Standard Teaching 23 Certificate described in this subsection (c). 24 (d) Master Certificate.Beginning February 15, 2000,25 Persons who have successfully achieved National Board 26 certification through the National Board for Professional 27 Teaching Standards shall be issued a Master Certificate, 28 valid for 10 years and renewable thereafter every 10 years 29 through compliance with requirements set forth by the State 30 Board of Education, in consultation with the State Teacher 31 Certification Board. However, each teacher who holds a 32 Master Certificate shall be eligible for a teaching position 33 in this State in the areas for which he or she holds a Master 34 Certificate without satisfying any other requirements of this HB1436 Enrolled -28- LRB9202656NTsb 1 Code, except for those requirements pertaining to criminal 2 background checks. A teacher who holds a Master Certificate 3 shall be deemed to meet State certification renewal 4 requirements in the area or areas for which he or she holds a 5 Master Certificate for the 10-year term of the teacher's 6 Master Certificate. 7 (Source: P.A. 91-102, eff. 7-12-99; 91-606, eff. 8-16-99; 8 91-609, eff. 1-1-00; 92-16, eff. 6-28-01.) 9 (105 ILCS 5/21-14) (from Ch. 122, par. 21-14) 10 (Text of Section before amendment by P.A. 92-510) 11 Sec. 21-14. Registration and renewal of certificates. 12 (a) A limited four-year certificate or a certificate 13 issued after July 1, 1955, shall be renewable at its 14 expiration or within 60 days thereafter by the county 15 superintendent of schools having supervision and control over 16 the school where the teacher is teaching upon certified 17 evidence of meeting the requirements for renewal as required 18 by this Act and prescribed by the State Board of Education in 19 consultation with the State Teacher Certification Board. An 20 elementary supervisory certificate shall not be renewed at 21 the end of the first four-year period covered by the 22 certificate unless the holder thereof has filed certified 23 evidence with the State Teacher Certification Board that he 24 has a master's degree or that he has earned 8 semester hours 25 of credit in the field of educational administration and 26 supervision in a recognized institution of higher learning. 27 The holder shall continue to earn 8 semester hours of credit 28 each four-year period until such time as he has earned a 29 master's degree. 30 All certificates not renewed or registered as herein 31 provided shall lapse after a period of 5 years from the 32 expiration of the last year of registration. Such 33 certificates may be reinstated for a one year period upon HB1436 Enrolled -29- LRB9202656NTsb 1 payment of all accumulated registration fees. Such 2 reinstated certificates shall only be renewed: (1) by earning 3 5 semester hours of credit in a recognized institution of 4 higher learning in the field of professional education or in 5 courses related to the holder's contractual teaching duties; 6 or (2) by presenting evidence of holding a valid regular 7 certificate of some other type. Any certificate may be 8 voluntarily surrendered by the certificate holder. A 9 voluntarily surrendered certificate shall be treated as a 10 revoked certificate. 11 (b) When those teaching certificates issued before 12 February 15, 2000 are renewed for the first time after 13 February 15, 2000, all such teaching certificates shall be 14 exchanged for Standard Teaching Certificates as provided in 15 subsection (c) of Section 21-2. All Initial and Standard 16 Teaching Certificates, including those issued to persons who 17 previously held teaching certificates issued before February 18 15, 2000, shall be renewable under the conditions set forth 19 in this subsection (b). 20 Initial Teaching Certificates are nonrenewable and are 21 valid for 4 years of teaching. Standard Teaching 22 Certificates are renewable every 5 years as provided in 23 subsection (c) of Section 21-2 and subsection (c) of this 24 Section. For purposes of this Section, "teaching" is defined 25 as employment and performance of services in an Illinois 26 public or State-operated elementary school, secondary school, 27 or cooperative or joint agreement with a governing body or 28 board of control, in a certificated teaching position, or a 29 charter school operating in compliance with the Charter 30 Schools Law. 31 (c) In compliance with subsection (c) of Section 21-2 of 32 this Code, which provides that a Standard Teaching 33 Certificate may be renewed by the State Teacher Certification 34 Board based upon proof of continuing professional HB1436 Enrolled -30- LRB9202656NTsb 1 development, the State Board of Education and the State 2 Teacher Certification Board shall jointly: 3 (1) establish a procedure for renewing Standard 4 Teaching Certificates, which shall include but not be 5 limited to annual timelines for the renewal process and 6 the components set forth in subsections (d) through (k) 7 of this Section; 8 (2) establish the standards for certificate 9 renewal; 10 (3) approve the providers of continuing 11 professional development activities; 12 (4) determine the maximum credit for each category 13 of continuing professional development activities, based 14 upon recommendations submitted by a continuing 15 professional development activity task force, which shall 16 consist of 6 staff members from the State Board of 17 Education, appointed by the State Superintendent of 18 Education, and 6 teacher representatives, 3 of whom are 19 selected by the Illinois Education Association and 3 of 20 whom are selected by the Illinois Federation of Teachers; 21 (5) designate the type and amount of documentation 22 required to show that continuing professional development 23 activities have been completed; and 24 (6) provide, on a timely basis to all Illinois 25 teachers, certificate holders, regional superintendents 26 of schools, school districts, and others with an interest 27 in continuing professional development, information about 28 the standards and requirements established pursuant to 29 this subsection (c). 30 (d) Any Standard Teaching Certificate held by an 31 individual employed and performing services in an Illinois 32 public or State-operated elementary school, secondary school, 33 or cooperative or joint agreement with a governing body or 34 board of control in a certificated teaching position or a HB1436 Enrolled -31- LRB9202656NTsb 1 charter school in compliance with the Charter Schools Law 2 must be maintained Valid and Active through certificate 3 renewal activities specified in the certificate renewal 4 procedure established pursuant to subsection (c) of this 5 Section, provided that a holder of a Valid and Active 6 certificate who is only employed on either a part-time basis 7 or day-to-day basis as a substitute teacher shall pay only 8 the required registration fee to renew his or her certificate 9 and maintain it as Valid and Active. All other Standard 10 Teaching Certificates held may be maintained as Valid and 11 Exempt through the registration process provided for in the 12 certificate renewal procedure established pursuant to 13 subsection (c) of this Section. A Valid and Exempt 14 certificate must be immediately activated, through procedures 15 developed jointly by the State Board of Education and the 16 State Teacher Certification Board, upon the certificate 17 holder becoming employed and performing services in an 18 Illinois public or State-operated elementary school, 19 secondary school, or cooperative or joint agreement with a 20 governing body or board of control in a certificated teaching 21 position or a charter school operating in compliance with the 22 Charter Schools Law. A holder of a Valid and Exempt 23 certificate may activate his or her certificate through 24 procedures provided for in the certificate renewal procedure 25 established pursuant to subsection (c) of this Section. 26 (e)(1) A Standard Teaching Certificate that has been 27 maintained as Valid and Active for the 5 years of the 28 certificate's validity shall be renewed as Valid and Active 29 upon the certificate holder: (i) completing an advanced 30 degree from an approved institution in an education-related 31 field; (ii) completing at least 8 semester hours of 32 coursework as described in subdivision (B)(A)of paragraph 33 (3) of this subsection (e); (iii)(ii)earning at least 24 34 continuing education units as described in subdivision (C) HB1436 Enrolled -32- LRB9202656NTsb 1(B)of paragraph (3) of this subsection (e); (iv)(iii)2 completing the National Board for Professional Teaching 3 Standards process as described in subdivision (D)(C)of 4 paragraph (3) of this subsection (e); or (v)(iv)earning 120 5 continuing professional development units ("CPDU") as 6 described in subdivision (E)(D)of paragraph (3) of this 7 subsection (e). The maximum continuing professional 8 development units for each continuing professional 9 development activity identified in subdivisions (F)(E)10 through (J)(I)of paragraph (3) of this subsection (e) shall 11 be jointly determined by the State Board of Education and the 12 State Teacher Certification Board. If, however, the 13 certificate holder has maintained the certificate as Valid 14 and Exempt for a portion of the 5-year period of validity, 15 the number of continuing professional development units 16 needed to renew the certificate as Valid and Active shall be 17 proportionately reduced by the amount of time the certificate 18 was Valid and Exempt. Furthermore, if a certificate holder is 19 employed and performs teaching services on a part-time basis 20 for all or a portion of the certificate's 5-year period of 21 validity, the number of continuing professional development 22 units needed to renew the certificate as Valid and Active 23 shall be reduced by 50% for the amount of time the 24 certificate holder has been employed and performed teaching 25 services on a part-time basis. Part-time shall be defined as 26 less than 50% of the school day or school term. 27 (2) Each Valid and Active Standard Teaching Certificate 28 holder shall develop a certificate renewal plan for 29 satisfying the continuing professional development 30 requirement provided for in subsection (c) of Section 21-2 of 31 this Code. Certificate holders with multiple certificates 32 shall develop a certificate renewal plan that addresses only 33 that certificate or those certificates that are required of 34 his or her certificated teaching position, if the certificate HB1436 Enrolled -33- LRB9202656NTsb 1 holder is employed and performing services in an Illinois 2 public or State-operated elementary school, secondary school, 3 or cooperative or joint agreement with a governing body or 4 board of control, or that certificate or those certificates 5 most closely related to his or her teaching position, if the 6 certificate holder is employed in a charter school. Except 7 as otherwise provided in this subsection (e), a certificate 8 renewal plan shall include a minimum of 3 individual 9 improvement goals developed by the certificate holder and 10 shall reflect purposes (A), (B), and (C) and may reflect 11 purpose (D) of the following continuing professional 12 development purposes: 13 (A) Advance both the certificate holder's knowledge 14 and skills as a teacher consistent with the Illinois 15 Professional Teaching Standards and the Illinois Content 16 Area Standards in the certificate holder's areas of 17 certification, endorsement, or teaching assignment in 18 order to keep the certificate holder current in those 19 areas. 20 (B) Develop the certificate holder's knowledge and 21 skills in areas determined to be critical for all 22 Illinois teachers, as defined by the State Board of 23 Education, known as "State priorities". 24 (C) Address the knowledge, skills, and goals of the 25 certificate holder's local school improvement plan, if 26 the teacher is employed in an Illinois public or 27 State-operated elementary school, secondary school, or 28 cooperative or joint agreement with a governing body or 29 board of control. 30 (D) Expand the certificate holder's knowledge and 31 skills in an additional teaching field or toward the 32 acquisition of another teaching certificate, endorsement, 33 or relevant education degree. 34 A certificate renewal plan must include a description of how HB1436 Enrolled -34- LRB9202656NTsb 1 these goals are to be achieved and an explanation of selected 2 continuing professional development activities to be 3 completed, each of which must meet one or more of the 4 continuing professional development purposes specified in 5 this paragraph (2). The plan shall identify potential 6 activities and include projected timelines for those 7 activities that will assure completion of the plan before the 8 expiration of the 5-year validity of the Standard Teaching 9 Certificate. Except as otherwise provided in this subsection 10 (e), at least 50% of continuing professional development 11 units must relate to purposes (A) and (B) set forth in this 12 paragraph (2): the advancement of a certificate holder's 13 knowledge and skills as a teacher consistent with the 14 Illinois Professional Teaching Standards and the Illinois 15 Content Area Standards in the certificate holder's areas of 16 certification, endorsement, or teaching assignment in order 17 to keep the certificate holder current in those areas and the 18 development of a certificate holder's knowledge and skills in 19 the State priorities that exist at the time the certificate 20 renewal plan is developed. 21 (3) Continuing professional development activities 22 included in a certificate renewal plan may include, but are 23 not limited to, the following activities: 24 (A) completion of an advanced degree from an 25 approved institution in an education-related field; 26 (B)(A)at least 8 semester hours of coursework in 27 an approved education-related program, of which at least 28 2 semester hours relate to the continuing professional 29 development purpose set forth in purpose (A) of paragraph 30 (2) of this subsection (e), provided that such a plan 31 need not include any other continuing professional 32 development activities nor reflect or contain activities 33 related to the other continuing professional development 34 purposes set forth in paragraph (2) of this subsection HB1436 Enrolled -35- LRB9202656NTsb 1 (e); 2 (C)(B)continuing education units that satisfy the 3 continuing professional development purposes set forth in 4 paragraph (2) of this subsection (e), with each 5 continuing education unit equal to 5 clock hours, 6 provided that a plan that includes at least 24 continuing 7 education units (or 120 clock/contact hours) need not 8 include any other continuing professional development 9 activities; 10 (D)(C)completion of the National Board of 11 Professional Teaching Standards ("NBPTS") process, 12 provided that a plan that includes completion of the 13 NBPTS process need not include any other continuing 14 professional development activities nor reflect or 15 contain activities related to the continuing professional 16 development purposes set forth in paragraph (2) of 17 subsection (e) of this Section; 18 (E)(D)completion of 120 continuing professional 19 development units that satisfy the continuing 20 professional development purposes set forth in paragraph 21 (2) of this subsection (e) and may include without 22 limitation the activities identified in subdivisions (F) 23(E)through (J)(I)of this paragraph (3); 24 (F)(E)collaboration and partnership activities 25 related to improving the teacher's knowledge and skills 26 as a teacher, including the following: 27 (i) participating on collaborative planning 28 and professional improvement teams and committees; 29 (ii) peer review and coaching; 30 (iii) mentoring in a formal mentoring program, 31 including service as a consulting teacher 32 participating in a remediation process formulated 33 under Section 24A-5 of this Code; 34 (iv) participating in site-based management or HB1436 Enrolled -36- LRB9202656NTsb 1 decision making teams, relevant committees, boards, 2 or task forces directly related to school 3 improvement plans; 4 (v) coordinating community resources in 5 schools, if the project is a specific goal of the 6 school improvement plan; 7 (vi) facilitating parent education programs 8 for a school, school district, or regional office of 9 education directly related to student achievement or 10 school improvement plans; 11 (vii) participating in business, school, or 12 community partnerships directly related to student 13 achievement or school improvement plans; or 14 (viii) supervising a student teacher or 15 teacher education candidate in clinical supervision, 16 provided that the supervision may only be counted 17 once during the course of 5 years; 18 (G)(F)college or university coursework related to 19 improving the teacher's knowledge and skills as a teacher 20 as follows: 21 (i) completing undergraduate or graduate 22 credit earned from a regionally accredited 23 institution in coursework relevant to the 24 certificate area being renewed, including coursework 25 that incorporates induction activities and 26 development of a portfolio of both student and 27 teacher work that provides experience in reflective 28 practices, provided the coursework meets Illinois 29 Professional Teaching Standards or Illinois Content 30 Area Standards and supports the essential 31 characteristics of quality professional development; 32 or 33 (ii) teaching college or university courses in 34 areas relevant to the certificate area being HB1436 Enrolled -37- LRB9202656NTsb 1 renewed, provided that the teaching may only be 2 counted once during the course of 5 years; 3 (H)(G)conferences, workshops, institutes, 4 seminars, and symposiums related to improving the 5 teacher's knowledge and skills as a teacher, including 6 the following: 7 (i) completing non-university credit directly 8 related to student achievement, school improvement 9 plans, or State priorities; 10 (ii) participating in or presenting at 11 workshops, seminars, conferences, institutes, and 12 symposiums; 13 (iii) training as external reviewers for 14 Quality Assurance; or 15 (iv) training as reviewers of university 16 teacher preparation programs; 17 (I)(H)other educational experiences related to 18 improving the teacher's knowledge and skills as a 19 teacher, including the following: 20 (i) participating in action research and 21 inquiry projects; 22 (ii) observing programs or teaching in 23 schools, related businesses, or industry that is 24 systematic, purposeful, and relevant to certificate 25 renewal; 26 (iii) traveling related to ones teaching 27 assignment, directly related to student achievement 28 or school improvement plans and approved at least 30 29 days prior to the travel experience, provided that 30 the traveling shall not include time spent commuting 31 to destinations where the learning experience will 32 occur; 33 (iv) participating in study groups related to 34 student achievement or school improvement plans; HB1436 Enrolled -38- LRB9202656NTsb 1 (v) serving on a statewide education-related 2 committee, including but not limited to the State 3 Teacher Certification Board, State Board of 4 Education strategic agenda teams, or the State 5 Advisory Council on Education of Children with 6 Disabilities; 7 (vi) participating in work/learn programs or 8 internships; or 9 (vii) developing a portfolio of student and 10 teacher work; 11 (J)(I)professional leadership experiences related 12 to improving the teacher's knowledge and skills as a 13 teacher, including the following: 14 (i) participating in curriculum development or 15 assessment activities at the school, school 16 district, regional office of education, State, or 17 national level; 18 (ii) participating in team or department 19 leadership in a school or school district; 20 (iii) participating on external or internal 21 school or school district review teams; 22 (iv) publishing educational articles, columns, 23 or books relevant to the certificate area being 24 renewed; or 25 (v) participating in non-strike related 26 professional association or labor organization 27 service or activities related to professional 28 development. 29 (4) A certificate renewal plan must initially be 30 approved by the certificate holder's local professional 31 development committee, as provided for in subsection (f) of 32 this Section. If the local professional development 33 committee does not approve the certificate renewal plan, the 34 certificate holder may appeal that determination to the HB1436 Enrolled -39- LRB9202656NTsb 1 regional professional development review committee, as 2 provided for in paragraph (2) of subsection (g) of this 3 Section. If the regional professional development review 4 committee disagrees with the local professional development 5 committee's determination, the certificate renewal plan shall 6 be deemed approved and the certificate holder may begin 7 satisfying the continuing professional development activities 8 set forth in the plan. If the regional professional 9 development review committee agrees with the local 10 professional development committee's determination, the 11 certificate renewal plan shall be deemed disapproved and 12 shall be returned to the certificate holder to develop a 13 revised certificate renewal plan. In all cases, the regional 14 professional development review committee shall immediately 15 notify both the local professional development committee and 16 the certificate holder of its determination. 17 (5) A certificate holder who wishes to modify the 18 continuing professional development activities or goals in 19 his or her certificate renewal plan must submit the proposed 20 modifications to his or her local professional development 21 committee for approval prior to engaging in the proposed 22 activities. If the local professional development committee 23 does not approve the proposed modification, the certificate 24 holder may appeal that determination to the regional 25 professional development review committee, as set forth in 26 paragraph (4) of this subsection (e). 27 (6) When a certificate holder changes assignments or 28 school districts during the course of completing a 29 certificate renewal plan, the professional development and 30 continuing education credit earned pursuant to the plan shall 31 transfer to the new assignment or school district and count 32 toward the total requirements. This certificate renewal plan 33 must be reviewed by the appropriate local professional 34 development committee and may be modified to reflect the HB1436 Enrolled -40- LRB9202656NTsb 1 certificate holder's new work assignment or the school 2 improvement plan of the new school district or school 3 building. 4 (f) Notwithstanding any other provisions of this Code, 5 each school district, charter school, and cooperative or 6 joint agreement with a governing body or board of control 7 that employs certificated staff, shall establish and 8 implement, in conjunction with its exclusive representative, 9 if any, one or more local professional development 10 committees, as set forth in this subsection (f), which shall 11 perform the following functions: 12 (1) review and approve certificate renewal plans 13 and any modifications made to these plans, including 14 transferred plans; 15 (2) maintain a file of approved certificate renewal 16 plans; 17 (3) monitor certificate holders' progress in 18 completing approved certificate renewal plans, provided 19 that a local professional development committee shall not 20 be required to maintain materials submitted by 21 certificate holders to demonstrate their progress in 22 completing their certificate renewal plans after the 23 committee has reviewed the materials and the credits have 24 been awarded; 25 (4) assist in the development of professional 26 development plans based upon needs identified in 27 certificate renewal plans; 28 (5) determine whether certificate holders have met 29 the requirements of their certificate renewal plans and 30 notify certificate holders of its determination; 31 (6) provide a certificate holder with the 32 opportunity to address the committee when it has 33 determined that the certificate holder has not met the 34 requirements of his or her certificate renewal plan; HB1436 Enrolled -41- LRB9202656NTsb 1 (7) issue and forward recommendations for renewal 2 or nonrenewal of certificate holders' Standard Teaching 3 Certificates to the appropriate regional superintendent 4 of schools, based upon whether certificate holders have 5 met the requirements of their approved certificate 6 renewal plans, with 30-day written notice of its 7 recommendation provided to the certificate holder prior 8 to forwarding the recommendation to the regional 9 superintendent of schools, provided that if the local 10 professional development committee's recommendation is 11 for certificate nonrenewal, the written notice provided 12 to the certificate holder shall include a return receipt; 13 and 14 (8) reconsider its recommendation of certificate 15 nonrenewal, upon request of the certificate holder within 16 30 days of receipt of written notification that the local 17 professional development committee will make such a 18 recommendation, and forward to the regional 19 superintendent of schools its recommendation within 30 20 days of receipt of the certificate holder's request. 21 Each local professional development committee shall 22 consist of at least 3 classroom teachers; one superintendent 23 or chief administrator of the school district, charter 24 school, or cooperative or joint agreement or his or her 25 designee; and one at-large member who shall be either (i) a 26 parent, (ii) a member of the business community, (iii) a 27 community member, or (iv) an administrator, with preference 28 given to an individual chosen from among those persons listed 29 in items (i), (ii), and (iii) in order to secure 30 representation of an interest not already represented on the 31 committee. Except in a school district in a city having a 32 population exceeding 500,000, a local professional 33 development committee shall be responsible for no more than 34 200 certificate renewal plans annually unless otherwise HB1436 Enrolled -42- LRB9202656NTsb 1 mutually agreed upon by the school district, charter school, 2 or governing body or board of control of a cooperative or 3 joint agreement and its exclusive representative, if any. If 4 mutually agreed upon by the school district, charter school, 5 or governing body or board of control of a cooperative or 6 joint agreement and its exclusive representative, if any, 7 additional members may be added to a local professional 8 development committee, provided that a majority of members 9 are classroom teachers. Except in a school district in a 10 city having a population exceeding 500,000, if additional 11 members are added to a local professional development 12 committee, the maximum number of certificate renewal plans 13 for which the committee shall annually be responsible may be 14 increased by 50 plans for each additional member, unless 15 otherwise mutually agreed upon by the school district, 16 charter school, or governing body or board of control of a 17 cooperative or joint agreement and its exclusive 18 representative, if any. The school district, charter school, 19 or governing body or board of control of a cooperative or 20 joint agreement and its exclusive representative, if any, 21 shall determine the term of service of the members of a local 22 professional development committee. All individuals selected 23 to serve on local professional development committees must be 24 known to demonstrate the best practices in teaching or their 25 respective field of practice. 26 The exclusive representative, if any, shall select the 27 classroom teacher members of the local professional 28 development committee. If no exclusive representative 29 exists, then the classroom teacher members of a local 30 professional development committee shall be selected by the 31 classroom teachers that come within the local professional 32 development committee's authority. The school district, 33 charter school, or governing body or board of control of a 34 cooperative or joint agreement shall select the 2 HB1436 Enrolled -43- LRB9202656NTsb 1 non-classroom teacher members (the superintendent or chief 2 administrator of the school district, charter school, or 3 cooperative or joint agreement or his or her designee and the 4 at-large member) of a local professional development 5 committee. Vacancies in positions on a local professional 6 development committee shall be filled in the same manner as 7 the original selections. The members of a local professional 8 development committee shall select a chairperson. Local 9 professional development committee meetings shall be 10 scheduled so as not to interfere with committee members' 11 regularly scheduled teaching duties, except when otherwise 12 permitted by the policies of or agreed to or approved by the 13 school district, charter school, or governing body or board 14 of control of a cooperative or joint agreement, or its 15 designee. 16 The board of education or governing board shall convene 17 the first meeting of the local professional development 18 committee. All actions taken by the local professional 19 development committee shall require that a majority of 20 committee members be present, and no committee action may be 21 taken unless 50% or more of those present are teacher 22 members. 23 The State Board of Education and the State Teacher 24 Certification Board shall jointly provide local professional 25 development committee members with a training manual, and the 26 members shall certify that they have received and read the 27 manual. 28 Notwithstanding any other provisions of this subsection 29 (f), for a teacher employed and performing services in a 30 nonpublic or State-operated elementary or secondary school, 31 all references to a local professional development committee 32 shall mean the regional superintendent of schools of the 33 regional office of education for the geographic area where 34 the teaching is done. HB1436 Enrolled -44- LRB9202656NTsb 1 (g)(1) Each regional superintendent of schools shall 2 review and concur or nonconcur with each recommendation for 3 renewal or nonrenewal of a Standard Teaching Certificate he 4 or she receives from a local professional development 5 committee or, if a certificate holder appeals the 6 recommendation to the regional professional development 7 review committee, the recommendation for renewal or 8 nonrenewal he or she receives from a regional professional 9 development review committee and, within 14 days of receipt 10 of the recommendation, shall provide the State Teacher 11 Certification Board with verification of the following, if 12 applicable: 13 (A) a certificate renewal plan was filed and 14 approved by the appropriate local professional 15 development committee; 16 (B) the professional development and continuing 17 education activities set forth in the approved 18 certificate renewal plan have been satisfactorily 19 completed; 20 (C) the local professional development committee 21 has recommended the renewal of the certificate holder's 22 Standard Teaching Certificate and forwarded the 23 recommendation, along with all supporting documentation 24 as jointly required by the State Board of Education and 25 the State Teacher Certification Board, to the regional 26 superintendent of schools; 27 (D) the certificate holder has appealed his or her 28 local professional development committee's recommendation 29 of nonrenewal to the regional professional development 30 review committee and the result of that appeal; 31 (E) the regional superintendent of schools has 32 concurred or nonconcurred with the local professional 33 development committee's or regional professional 34 development review committee's recommendation to renew or HB1436 Enrolled -45- LRB9202656NTsb 1 nonrenew the certificate holder's Standard Teaching 2 Certificate and made a recommendation to that effect; and 3 (F) the established registration fee for the 4 Standard Teaching Certificate has been paid. 5 At the same time the regional superintendent of schools 6 provides the State Teacher Certification Board with the 7 notice required by this subsection (g), he or she shall also 8 notify the certificate holder in writing that this notice has 9 been provided to the State Teacher Certification Board, 10 provided that if the notice provided by the regional 11 superintendent of schools to the State Teacher Certification 12 Board includes a recommendation of certificate nonrenewal, 13 the written notice provided to the certificate holder shall 14 be by certified mail, return receipt requested. 15 (2) Each certificate holder shall have the right to 16 appeal his or her local professional development committee's 17 recommendation of nonrenewal to the regional professional 18 development review committee, within 14 days of receipt of 19 notice that the recommendation has been sent to the regional 20 superintendent of schools. Each regional superintendent of 21 schools shall establish a regional professional development 22 review committee or committees for the purpose of advising 23 the regional superintendent of schools, upon request, and 24 handling certificate holder appeals. This committee shall 25 consist of at least 4 classroom teachers, one 26 non-administrative certificated educational employee, 2 27 administrators, and one at-large member who shall be either 28 (i) a parent, (ii) a member of the business community, (iii) 29 a community member, or (iv) an administrator, with preference 30 given to an individual chosen from among those persons listed 31 in items (i), (ii), and (iii) in order to secure 32 representation of an interest not already represented on the 33 committee. The teacher and non-administrative certificated 34 educational employee members of the review committee shall be HB1436 Enrolled -46- LRB9202656NTsb 1 selected by their exclusive representative, if any, and the 2 administrators and at-large member shall be selected by the 3 regional superintendent of schools. A regional superintendent 4 of schools may add additional members to the committee, 5 provided that the same proportion of teachers to 6 administrators and at-large members on the committee is 7 maintained. Any additional teacher and non-administrative 8 certificated educational employee members shall be selected 9 by their exclusive representative, if any. Vacancies in 10 positions on a regional professional development review 11 committee shall be filled in the same manner as the original 12 selections. Committee members shall serve staggered 3-year 13 terms. All individuals selected to serve on regional 14 professional development review committees must be known to 15 demonstrate the best practices in teaching or their 16 respective field of practice. 17 The exclusive representative responsible for choosing the 18 individuals that serve on a regional professional development 19 review committee shall notify each school district, charter 20 school, or governing body or board of control of a 21 cooperative or joint agreement employing the individuals 22 chosen to serve and provide their names to the appropriate 23 regional superintendent of schools. Regional professional 24 development review committee meetings shall be scheduled so 25 as not to interfere with the committee members' regularly 26 scheduled teaching duties, except when otherwise permitted by 27 the policies of or agreed to or approved by the school 28 district, charter school, or governing body or board of 29 control of a cooperative or joint agreement, or its designee, 30 provided that the school district, charter school, or 31 governing body or board of control shall not unreasonably 32 withhold permission for a committee member to attend regional 33 professional development review committee meetings. 34 In a city having a population exceeding 500,000 that does HB1436 Enrolled -47- LRB9202656NTsb 1 not have a regional office of education, one or more separate 2 regional professional development review committees shall be 3 established as mutually agreed upon by the board of education 4 of the school district organized under Article 34 of this 5 Code and the exclusive representative. The composition of 6 each committee shall be the same as for a regional 7 professional development review committee, except that 8 members of the committee shall be jointly appointed by the 9 board of education and the exclusive representative. All 10 other provisions of this Section concerning regional 11 professional development review committees shall apply to 12 these committees. 13 The regional professional development review committee 14 may require information in addition to that received from a 15 certificate holder's local professional development committee 16 or request that the certificate holder appear before it, 17 shall either concur or nonconcur with a local professional 18 development committee's recommendation of nonrenewal, and 19 shall forward to the regional superintendent of schools its 20 recommendation of renewal or nonrenewal. All actions taken 21 by the regional professional development review committee 22 shall require a quorum and be by a simple majority of those 23 present and voting. A record of all votes shall be 24 maintained. The committee shall have 45 days from receipt of 25 a certificate holder's appeal to make its recommendation to 26 the regional superintendent of schools. 27 The State Board of Education and the State Teacher 28 Certification Board shall jointly provide regional 29 professional development review committee members with a 30 training manual, and the members shall be required to attend 31 one training seminar sponsored jointly by the State Board of 32 Education and the State Teacher Certification Board. 33 (h)(1) The State Teacher Certification Board shall 34 review the regional superintendent of schools' HB1436 Enrolled -48- LRB9202656NTsb 1 recommendations to renew or nonrenew Standard Teaching 2 Certificates and notify certificate holders in writing 3 whether their certificates have been renewed or nonrenewed 4 within 90 days of receipt of the recommendations, unless a 5 certificate holder has appealed a regional superintendent of 6 schools' recommendation of nonrenewal, as provided in 7 paragraph (2) of this subsection (h). The State Teacher 8 Certification Board shall verify that the certificate holder 9 has met the renewal criteria set forth in paragraph (1) of 10 subsection (g) of this Section. 11 (2) Each certificate holder shall have the right to 12 appeal a regional superintendent of school's recommendation 13 to nonrenew his or her Standard Teaching Certificate to the 14 State Teacher Certification Board, within 14 days of receipt 15 of notice that the decision has been sent to the State 16 Teacher Certification Board, which shall hold an appeal 17 hearing within 60 days of receipt of the appeal. When such 18 an appeal is taken, the certificate holder's Standard 19 Teaching Certificate shall continue to be valid until the 20 appeal is finally determined. The State Teacher 21 Certification Board shall review the regional superintendent 22 of school's recommendation, the regional professional 23 development review committee's recommendation, if any, and 24 the local professional development committee's recommendation 25 and all relevant documentation to verify whether the 26 certificate holder has met the renewal criteria set forth in 27 paragraph (1) of subsection (g) of this Section. The State 28 Teacher Certification Board may request that the certificate 29 holder appear before it. All actions taken by the State 30 Teacher Certification Board shall require a quorum and be by 31 a simple majority of those present and voting. A record of 32 all votes shall be maintained. The State Teacher 33 Certification Board shall notify the certificate holder in 34 writing, within 7 days of completing the review, whether his HB1436 Enrolled -49- LRB9202656NTsb 1 or her Standard Teaching Certificate has been renewed or 2 nonrenewed, provided that if the State Teacher Certification 3 Board determines to nonrenew a certificate, the written 4 notice provided to the certificate holder shall be by 5 certified mail, return receipt requested. All certificate 6 renewal or nonrenewal decisions of the State Teacher 7 Certification Board are final and subject to administrative 8 review, as set forth in Section 21-24 of this Code. 9 (i) Holders of Master Teaching Certificates shall meet 10 the same requirements and follow the same procedures as 11 holders of Standard Teaching Certificates, except that their 12 renewal cycle shall be as set forth in subsection (d) of 13 Section 21-2 of this Code. 14 (j) Holders of Valid and Exempt Standard and Master 15 Teaching Certificates who are not employed and performing 16 services in an Illinois public or State-operated elementary 17 school, secondary school, or cooperative or joint agreement 18 with a governing body or board of control, in a certificated 19 teaching position, may voluntarily activate their 20 certificates by developing and submitting a certificate 21 renewal plan to the regional superintendent of schools of the 22 regional office of education for the geographic area where 23 their teaching is done, who, or whose designee, shall approve 24 the plan and serve as the certificate holder's local 25 professional development committee. These certificate 26 holders shall follow the same renewal criteria and procedures 27 as all other Standard and Master Teaching Certificate 28 holders, except that their continuing professional 29 development plans shall not be required to reflect or address 30 the knowledge, skills, and goals of a local school 31 improvement plan. 32 (k) Each school district, charter school, or cooperative 33 or joint agreement shall be paid an annual amount of not less 34 than $1,000, as determined by a formula based on the number HB1436 Enrolled -50- LRB9202656NTsb 1 of Standard Teaching and Master Teaching Certificate holders, 2 subject to renewal and established by rule, not to exceed 3 $1,000,000 annually for all school districts, charter 4 schools, and cooperatives or joint agreements, for 5 administrative costs associated with conducting the meetings 6 of the local professional development committee, as 7 determined in consultation with the committee. Each regional 8 office of education shall receive $2,000 annually to pay 9 school districts, charter schools, or cooperatives or joint 10 agreements for costs, as defined by rule, incurred in staff 11 attendance at regional professional development review 12 committee meetings and the training seminar required under 13 paragraph (2) of subsection (g) of this Section. 14 (l) The State Board of Education and the State Teacher 15 Certification Board shall jointly contract with an 16 independent party to conduct a comprehensive evaluation of 17 the certificate renewal system pursuant to this Section. The 18 first report of this evaluation shall be presented to the 19 General Assembly on January 1, 2005 and on January 1 of every 20 third year thereafter. 21 (Source: P.A. 90-548, eff. 1-1-98; 90-653, eff. 7-29-98; 22 90-811, eff. 1-26-99; 91-102, eff. 7-12-99.) 23 (Text of Section after amendment by P.A. 92-510) 24 Sec. 21-14. Registration and renewal of certificates. 25 (a) A limited four-year certificate or a certificate 26 issued after July 1, 1955, shall be renewable at its 27 expiration or within 60 days thereafter by the county 28 superintendent of schools having supervision and control over 29 the school where the teacher is teaching upon certified 30 evidence of meeting the requirements for renewal as required 31 by this Act and prescribed by the State Board of Education in 32 consultation with the State Teacher Certification Board. An 33 elementary supervisory certificate shall not be renewed at 34 the end of the first four-year period covered by the HB1436 Enrolled -51- LRB9202656NTsb 1 certificate unless the holder thereof has filed certified 2 evidence with the State Teacher Certification Board that he 3 has a master's degree or that he has earned 8 semester hours 4 of credit in the field of educational administration and 5 supervision in a recognized institution of higher learning. 6 The holder shall continue to earn 8 semester hours of credit 7 each four-year period until such time as he has earned a 8 master's degree. 9 All certificates not renewed or registered as herein 10 provided shall lapse after a period of 5 years from the 11 expiration of the last year of registration. Such 12 certificates may be reinstated for a one year period upon 13 payment of all accumulated registration fees. Such 14 reinstated certificates shall only be renewed: (1) by earning 15 5 semester hours of credit in a recognized institution of 16 higher learning in the field of professional education or in 17 courses related to the holder's contractual teaching duties; 18 or (2) by presenting evidence of holding a valid regular 19 certificate of some other type. Any certificate may be 20 voluntarily surrendered by the certificate holder. A 21 voluntarily surrendered certificate shall be treated as a 22 revoked certificate. 23 (b) When those teaching certificates issued before 24 February 15, 2000 are renewed for the first time after 25 February 15, 2000, all such teaching certificates shall be 26 exchanged for Standard Teaching Certificates as provided in 27 subsection (c) of Section 21-2. All Initial and Standard 28 Teaching Certificates, including those issued to persons who 29 previously held teaching certificates issued before February 30 15, 2000, shall be renewable under the conditions set forth 31 in this subsection (b). 32 Initial Teaching Certificates are nonrenewable and are 33 valid for 4 years of teaching. Standard Teaching 34 Certificates are renewable every 5 years as provided in HB1436 Enrolled -52- LRB9202656NTsb 1 subsection (c) of Section 21-2 and subsection (c) of this 2 Section. For purposes of this Section, "teaching" is defined 3 as employment and performance of services in an Illinois 4 public or State-operated elementary school, secondary school, 5 or cooperative or joint agreement with a governing body or 6 board of control, in a certificated teaching position, or a 7 charter school operating in compliance with the Charter 8 Schools Law. 9 (c) In compliance with subsection (c) of Section 21-2 of 10 this Code, which provides that a Standard Teaching 11 Certificate may be renewed by the State Teacher Certification 12 Board based upon proof of continuing professional 13 development, the State Board of Education and the State 14 Teacher Certification Board shall jointly: 15 (1) establish a procedure for renewing Standard 16 Teaching Certificates, which shall include but not be 17 limited to annual timelines for the renewal process and 18 the components set forth in subsections (d) through (k) 19 of this Section; 20 (2) establish the standards for certificate 21 renewal; 22 (3) approve the providers of continuing 23 professional development activities; 24 (4) determine the maximum credit for each category 25 of continuing professional development activities, based 26 upon recommendations submitted by a continuing 27 professional development activity task force, which shall 28 consist of 6 staff members from the State Board of 29 Education, appointed by the State Superintendent of 30 Education, and 6 teacher representatives, 3 of whom are 31 selected by the Illinois Education Association and 3 of 32 whom are selected by the Illinois Federation of Teachers; 33 (5) designate the type and amount of documentation 34 required to show that continuing professional development HB1436 Enrolled -53- LRB9202656NTsb 1 activities have been completed; and 2 (6) provide, on a timely basis to all Illinois 3 teachers, certificate holders, regional superintendents 4 of schools, school districts, and others with an interest 5 in continuing professional development, information about 6 the standards and requirements established pursuant to 7 this subsection (c). 8 (d) Any Standard Teaching Certificate held by an 9 individual employed and performing services in an Illinois 10 public or State-operated elementary school, secondary school, 11 or cooperative or joint agreement with a governing body or 12 board of control in a certificated teaching position or a 13 charter school in compliance with the Charter Schools Law 14 must be maintained Valid and Active through certificate 15 renewal activities specified in the certificate renewal 16 procedure established pursuant to subsection (c) of this 17 Section, provided that a holder of a Valid and Active 18 certificate who is only employed on either a part-time basis 19 or day-to-day basis as a substitute teacher shall pay only 20 the required registration fee to renew his or her certificate 21 and maintain it as Valid and Active. All other Standard 22 Teaching Certificates held may be maintained as Valid and 23 Exempt through the registration process provided for in the 24 certificate renewal procedure established pursuant to 25 subsection (c) of this Section. A Valid and Exempt 26 certificate must be immediately activated, through procedures 27 developed jointly by the State Board of Education and the 28 State Teacher Certification Board, upon the certificate 29 holder becoming employed and performing services in an 30 Illinois public or State-operated elementary school, 31 secondary school, or cooperative or joint agreement with a 32 governing body or board of control in a certificated teaching 33 position or a charter school operating in compliance with the 34 Charter Schools Law. A holder of a Valid and Exempt HB1436 Enrolled -54- LRB9202656NTsb 1 certificate may activate his or her certificate through 2 procedures provided for in the certificate renewal procedure 3 established pursuant to subsection (c) of this Section. 4 (e)(1) A Standard Teaching Certificate that has been 5 maintained as Valid and Active for the 5 years of the 6 certificate's validity shall be renewed as Valid and Active 7 upon the certificate holder: (i) completing an advanced 8 degree from an approved institution in an education-related 9 field; (ii) completing at least 8 semester hours of 10 coursework as described in subdivision (B)(A)of paragraph 11 (3) of this subsection (e); (iii)(ii)earning at least 24 12 continuing education units as described in subdivision (C) 13(B)of paragraph (3) of this subsection (e); (iv)(iii)14 completing the National Board for Professional Teaching 15 Standards process as described in subdivision (D)(C)of 16 paragraph (3) of this subsection (e); or (v)(iv)earning 120 17 continuing professional development units ("CPDU") as 18 described in subdivision (E)(D)of paragraph (3) of this 19 subsection (e). The maximum continuing professional 20 development units for each continuing professional 21 development activity identified in subdivisions (F)(E)22 through (J)(I)of paragraph (3) of this subsection (e) shall 23 be jointly determined by the State Board of Education and the 24 State Teacher Certification Board. If, however, the 25 certificate holder has maintained the certificate as Valid 26 and Exempt for a portion of the 5-year period of validity, 27 the number of continuing professional development units 28 needed to renew the certificate as Valid and Active shall be 29 proportionately reduced by the amount of time the certificate 30 was Valid and Exempt. Furthermore, if a certificate holder is 31 employed and performs teaching services on a part-time basis 32 for all or a portion of the certificate's 5-year period of 33 validity, the number of continuing professional development 34 units needed to renew the certificate as Valid and Active HB1436 Enrolled -55- LRB9202656NTsb 1 shall be reduced by 50% for the amount of time the 2 certificate holder has been employed and performed teaching 3 services on a part-time basis. Part-time shall be defined as 4 less than 50% of the school day or school term. 5 (2) Each Valid and Active Standard Teaching Certificate 6 holder shall develop a certificate renewal plan for 7 satisfying the continuing professional development 8 requirement provided for in subsection (c) of Section 21-2 of 9 this Code. Certificate holders with multiple certificates 10 shall develop a certificate renewal plan that addresses only 11 that certificate or those certificates that are required of 12 his or her certificated teaching position, if the certificate 13 holder is employed and performing services in an Illinois 14 public or State-operated elementary school, secondary school, 15 or cooperative or joint agreement with a governing body or 16 board of control, or that certificate or those certificates 17 most closely related to his or her teaching position, if the 18 certificate holder is employed in a charter school. Except 19 as otherwise provided in this subsection (e), a certificate 20 renewal plan shall include a minimum of 3 individual 21 improvement goals developed by the certificate holder and 22 shall reflect purposes (A), (B), and (C) and may reflect 23 purpose (D) of the following continuing professional 24 development purposes: 25 (A) Advance both the certificate holder's knowledge 26 and skills as a teacher consistent with the Illinois 27 Professional Teaching Standards and the Illinois Content 28 Area Standards in the certificate holder's areas of 29 certification, endorsement, or teaching assignment in 30 order to keep the certificate holder current in those 31 areas. 32 (B) Develop the certificate holder's knowledge and 33 skills in areas determined to be critical for all 34 Illinois teachers, as defined by the State Board of HB1436 Enrolled -56- LRB9202656NTsb 1 Education, known as "State priorities". 2 (C) Address the knowledge, skills, and goals of the 3 certificate holder's local school improvement plan, if 4 the teacher is employed in an Illinois public or 5 State-operated elementary school, secondary school, or 6 cooperative or joint agreement with a governing body or 7 board of control. 8 (D) Expand the certificate holder's knowledge and 9 skills in an additional teaching field or toward the 10 acquisition of another teaching certificate, endorsement, 11 or relevant education degree. 12 A certificate renewal plan must include a description of how 13 these goals are to be achieved and an explanation of selected 14 continuing professional development activities to be 15 completed, each of which must meet one or more of the 16 continuing professional development purposes specified in 17 this paragraph (2). The plan shall identify potential 18 activities and include projected timelines for those 19 activities that will assure completion of the plan before the 20 expiration of the 5-year validity of the Standard Teaching 21 Certificate. Except as otherwise provided in this subsection 22 (e), at least 50% of continuing professional development 23 units must relate to purposes (A) and (B) set forth in this 24 paragraph (2): the advancement of a certificate holder's 25 knowledge and skills as a teacher consistent with the 26 Illinois Professional Teaching Standards and the Illinois 27 Content Area Standards in the certificate holder's areas of 28 certification, endorsement, or teaching assignment in order 29 to keep the certificate holder current in those areas and the 30 development of a certificate holder's knowledge and skills in 31 the State priorities that exist at the time the certificate 32 renewal plan is developed. 33 A speech-language pathologist or audiologist who is 34 licensed under the Illinois Speech-Language Pathology and HB1436 Enrolled -57- LRB9202656NTsb 1 Audiology Practice Act and who has met the continuing 2 education requirements of that Act and the rules promulgated 3 under that Act shall be deemed to have satisfied the 4 continuing professional development requirements established 5 by the State Board of Education and the Teacher Certification 6 Board to renew a Standard Certificate. 7 (3) Continuing professional development activities 8 included in a certificate renewal plan may include, but are 9 not limited to, the following activities: 10 (A) completion of an advanced degree from an 11 approved institution in an education-related field; 12 (B)(A)at least 8 semester hours of coursework in 13 an approved education-related program, of which at least 14 2 semester hours relate to the continuing professional 15 development purpose set forth in purpose (A) of paragraph 16 (2) of this subsection (e), provided that such a plan 17 need not include any other continuing professional 18 development activities nor reflect or contain activities 19 related to the other continuing professional development 20 purposes set forth in paragraph (2) of this subsection 21 (e); 22 (C)(B)continuing education units that satisfy the 23 continuing professional development purposes set forth in 24 paragraph (2) of this subsection (e), with each 25 continuing education unit equal to 5 clock hours, 26 provided that a plan that includes at least 24 continuing 27 education units (or 120 clock/contact hours) need not 28 include any other continuing professional development 29 activities; 30 (D)(C)completion of the National Board of 31 Professional Teaching Standards ("NBPTS") process, 32 provided that a plan that includes completion of the 33 NBPTS process need not include any other continuing 34 professional development activities nor reflect or HB1436 Enrolled -58- LRB9202656NTsb 1 contain activities related to the continuing professional 2 development purposes set forth in paragraph (2) of 3 subsection (e) of this Section; 4 (E)(D)completion of 120 continuing professional 5 development units that satisfy the continuing 6 professional development purposes set forth in paragraph 7 (2) of this subsection (e) and may include without 8 limitation the activities identified in subdivisions (F) 9(E)through (J)(I)of this paragraph (3); 10 (F)(E)collaboration and partnership activities 11 related to improving the teacher's knowledge and skills 12 as a teacher, including the following: 13 (i) participating on collaborative planning 14 and professional improvement teams and committees; 15 (ii) peer review and coaching; 16 (iii) mentoring in a formal mentoring program, 17 including service as a consulting teacher 18 participating in a remediation process formulated 19 under Section 24A-5 of this Code; 20 (iv) participating in site-based management or 21 decision making teams, relevant committees, boards, 22 or task forces directly related to school 23 improvement plans; 24 (v) coordinating community resources in 25 schools, if the project is a specific goal of the 26 school improvement plan; 27 (vi) facilitating parent education programs 28 for a school, school district, or regional office of 29 education directly related to student achievement or 30 school improvement plans; 31 (vii) participating in business, school, or 32 community partnerships directly related to student 33 achievement or school improvement plans; or 34 (viii) supervising a student teacher or HB1436 Enrolled -59- LRB9202656NTsb 1 teacher education candidate in clinical supervision, 2 provided that the supervision may only be counted 3 once during the course of 5 years; 4 (G)(F)college or university coursework related to 5 improving the teacher's knowledge and skills as a teacher 6 as follows: 7 (i) completing undergraduate or graduate 8 credit earned from a regionally accredited 9 institution in coursework relevant to the 10 certificate area being renewed, including coursework 11 that incorporates induction activities and 12 development of a portfolio of both student and 13 teacher work that provides experience in reflective 14 practices, provided the coursework meets Illinois 15 Professional Teaching Standards or Illinois Content 16 Area Standards and supports the essential 17 characteristics of quality professional development; 18 or 19 (ii) teaching college or university courses in 20 areas relevant to the certificate area being 21 renewed, provided that the teaching may only be 22 counted once during the course of 5 years; 23 (H)(G)conferences, workshops, institutes, 24 seminars, and symposiums related to improving the 25 teacher's knowledge and skills as a teacher, including 26 the following: 27 (i) completing non-university credit directly 28 related to student achievement, school improvement 29 plans, or State priorities; 30 (ii) participating in or presenting at 31 workshops, seminars, conferences, institutes, and 32 symposiums; 33 (iii) training as external reviewers for 34 Quality Assurance; or HB1436 Enrolled -60- LRB9202656NTsb 1 (iv) training as reviewers of university 2 teacher preparation programs; 3 (I)(H)other educational experiences related to 4 improving the teacher's knowledge and skills as a 5 teacher, including the following: 6 (i) participating in action research and 7 inquiry projects; 8 (ii) observing programs or teaching in 9 schools, related businesses, or industry that is 10 systematic, purposeful, and relevant to certificate 11 renewal; 12 (iii) traveling related to ones teaching 13 assignment, directly related to student achievement 14 or school improvement plans and approved at least 30 15 days prior to the travel experience, provided that 16 the traveling shall not include time spent commuting 17 to destinations where the learning experience will 18 occur; 19 (iv) participating in study groups related to 20 student achievement or school improvement plans; 21 (v) serving on a statewide education-related 22 committee, including but not limited to the State 23 Teacher Certification Board, State Board of 24 Education strategic agenda teams, or the State 25 Advisory Council on Education of Children with 26 Disabilities; 27 (vi) participating in work/learn programs or 28 internships; or 29 (vii) developing a portfolio of student and 30 teacher work; 31 (J)(I)professional leadership experiences related 32 to improving the teacher's knowledge and skills as a 33 teacher, including the following: 34 (i) participating in curriculum development or HB1436 Enrolled -61- LRB9202656NTsb 1 assessment activities at the school, school 2 district, regional office of education, State, or 3 national level; 4 (ii) participating in team or department 5 leadership in a school or school district; 6 (iii) participating on external or internal 7 school or school district review teams; 8 (iv) publishing educational articles, columns, 9 or books relevant to the certificate area being 10 renewed; or 11 (v) participating in non-strike related 12 professional association or labor organization 13 service or activities related to professional 14 development. 15 (4) A certificate renewal plan must initially be 16 approved by the certificate holder's local professional 17 development committee, as provided for in subsection (f) of 18 this Section. If the local professional development 19 committee does not approve the certificate renewal plan, the 20 certificate holder may appeal that determination to the 21 regional professional development review committee, as 22 provided for in paragraph (2) of subsection (g) of this 23 Section. If the regional professional development review 24 committee disagrees with the local professional development 25 committee's determination, the certificate renewal plan shall 26 be deemed approved and the certificate holder may begin 27 satisfying the continuing professional development activities 28 set forth in the plan. If the regional professional 29 development review committee agrees with the local 30 professional development committee's determination, the 31 certificate renewal plan shall be deemed disapproved and 32 shall be returned to the certificate holder to develop a 33 revised certificate renewal plan. In all cases, the regional 34 professional development review committee shall immediately HB1436 Enrolled -62- LRB9202656NTsb 1 notify both the local professional development committee and 2 the certificate holder of its determination. 3 (5) A certificate holder who wishes to modify the 4 continuing professional development activities or goals in 5 his or her certificate renewal plan must submit the proposed 6 modifications to his or her local professional development 7 committee for approval prior to engaging in the proposed 8 activities. If the local professional development committee 9 does not approve the proposed modification, the certificate 10 holder may appeal that determination to the regional 11 professional development review committee, as set forth in 12 paragraph (4) of this subsection (e). 13 (6) When a certificate holder changes assignments or 14 school districts during the course of completing a 15 certificate renewal plan, the professional development and 16 continuing education credit earned pursuant to the plan shall 17 transfer to the new assignment or school district and count 18 toward the total requirements. This certificate renewal plan 19 must be reviewed by the appropriate local professional 20 development committee and may be modified to reflect the 21 certificate holder's new work assignment or the school 22 improvement plan of the new school district or school 23 building. 24 (f) Notwithstanding any other provisions of this Code, 25 each school district, charter school, and cooperative or 26 joint agreement with a governing body or board of control 27 that employs certificated staff, shall establish and 28 implement, in conjunction with its exclusive representative, 29 if any, one or more local professional development 30 committees, as set forth in this subsection (f), which shall 31 perform the following functions: 32 (1) review and approve certificate renewal plans 33 and any modifications made to these plans, including 34 transferred plans; HB1436 Enrolled -63- LRB9202656NTsb 1 (2) maintain a file of approved certificate renewal 2 plans; 3 (3) monitor certificate holders' progress in 4 completing approved certificate renewal plans, provided 5 that a local professional development committee shall not 6 be required to maintain materials submitted by 7 certificate holders to demonstrate their progress in 8 completing their certificate renewal plans after the 9 committee has reviewed the materials and the credits have 10 been awarded; 11 (4) assist in the development of professional 12 development plans based upon needs identified in 13 certificate renewal plans; 14 (5) determine whether certificate holders have met 15 the requirements of their certificate renewal plans and 16 notify certificate holders of its determination; 17 (6) provide a certificate holder with the 18 opportunity to address the committee when it has 19 determined that the certificate holder has not met the 20 requirements of his or her certificate renewal plan; 21 (7) issue and forward recommendations for renewal 22 or nonrenewal of certificate holders' Standard Teaching 23 Certificates to the appropriate regional superintendent 24 of schools, based upon whether certificate holders have 25 met the requirements of their approved certificate 26 renewal plans, with 30-day written notice of its 27 recommendation provided to the certificate holder prior 28 to forwarding the recommendation to the regional 29 superintendent of schools, provided that if the local 30 professional development committee's recommendation is 31 for certificate nonrenewal, the written notice provided 32 to the certificate holder shall include a return receipt; 33 and 34 (8) reconsider its recommendation of certificate HB1436 Enrolled -64- LRB9202656NTsb 1 nonrenewal, upon request of the certificate holder within 2 30 days of receipt of written notification that the local 3 professional development committee will make such a 4 recommendation, and forward to the regional 5 superintendent of schools its recommendation within 30 6 days of receipt of the certificate holder's request. 7 Each local professional development committee shall 8 consist of at least 3 classroom teachers; one superintendent 9 or chief administrator of the school district, charter 10 school, or cooperative or joint agreement or his or her 11 designee; and one at-large member who shall be either (i) a 12 parent, (ii) a member of the business community, (iii) a 13 community member, or (iv) an administrator, with preference 14 given to an individual chosen from among those persons listed 15 in items (i), (ii), and (iii) in order to secure 16 representation of an interest not already represented on the 17 committee. Except in a school district in a city having a 18 population exceeding 500,000, a local professional 19 development committee shall be responsible for no more than 20 200 certificate renewal plans annually unless otherwise 21 mutually agreed upon by the school district, charter school, 22 or governing body or board of control of a cooperative or 23 joint agreement and its exclusive representative, if any. If 24 mutually agreed upon by the school district, charter school, 25 or governing body or board of control of a cooperative or 26 joint agreement and its exclusive representative, if any, 27 additional members may be added to a local professional 28 development committee, provided that a majority of members 29 are classroom teachers. Except in a school district in a 30 city having a population exceeding 500,000, if additional 31 members are added to a local professional development 32 committee, the maximum number of certificate renewal plans 33 for which the committee shall annually be responsible may be 34 increased by 50 plans for each additional member, unless HB1436 Enrolled -65- LRB9202656NTsb 1 otherwise mutually agreed upon by the school district, 2 charter school, or governing body or board of control of a 3 cooperative or joint agreement and its exclusive 4 representative, if any. The school district, charter school, 5 or governing body or board of control of a cooperative or 6 joint agreement and its exclusive representative, if any, 7 shall determine the term of service of the members of a local 8 professional development committee. All individuals selected 9 to serve on local professional development committees must be 10 known to demonstrate the best practices in teaching or their 11 respective field of practice. 12 The exclusive representative, if any, shall select the 13 classroom teacher members of the local professional 14 development committee. If no exclusive representative 15 exists, then the classroom teacher members of a local 16 professional development committee shall be selected by the 17 classroom teachers that come within the local professional 18 development committee's authority. The school district, 19 charter school, or governing body or board of control of a 20 cooperative or joint agreement shall select the 2 21 non-classroom teacher members (the superintendent or chief 22 administrator of the school district, charter school, or 23 cooperative or joint agreement or his or her designee and the 24 at-large member) of a local professional development 25 committee. Vacancies in positions on a local professional 26 development committee shall be filled in the same manner as 27 the original selections. The members of a local professional 28 development committee shall select a chairperson. Local 29 professional development committee meetings shall be 30 scheduled so as not to interfere with committee members' 31 regularly scheduled teaching duties, except when otherwise 32 permitted by the policies of or agreed to or approved by the 33 school district, charter school, or governing body or board 34 of control of a cooperative or joint agreement, or its HB1436 Enrolled -66- LRB9202656NTsb 1 designee. 2 The board of education or governing board shall convene 3 the first meeting of the local professional development 4 committee. All actions taken by the local professional 5 development committee shall require that a majority of 6 committee members be present, and no committee action may be 7 taken unless 50% or more of those present are teacher 8 members. 9 The State Board of Education and the State Teacher 10 Certification Board shall jointly provide local professional 11 development committee members with a training manual, and the 12 members shall certify that they have received and read the 13 manual. 14 Notwithstanding any other provisions of this subsection 15 (f), for a teacher employed and performing services in a 16 nonpublic or State-operated elementary or secondary school, 17 all references to a local professional development committee 18 shall mean the regional superintendent of schools of the 19 regional office of education for the geographic area where 20 the teaching is done. 21 (g)(1) Each regional superintendent of schools shall 22 review and concur or nonconcur with each recommendation for 23 renewal or nonrenewal of a Standard Teaching Certificate he 24 or she receives from a local professional development 25 committee or, if a certificate holder appeals the 26 recommendation to the regional professional development 27 review committee, the recommendation for renewal or 28 nonrenewal he or she receives from a regional professional 29 development review committee and, within 14 days of receipt 30 of the recommendation, shall provide the State Teacher 31 Certification Board with verification of the following, if 32 applicable: 33 (A) a certificate renewal plan was filed and 34 approved by the appropriate local professional HB1436 Enrolled -67- LRB9202656NTsb 1 development committee; 2 (B) the professional development and continuing 3 education activities set forth in the approved 4 certificate renewal plan have been satisfactorily 5 completed; 6 (C) the local professional development committee 7 has recommended the renewal of the certificate holder's 8 Standard Teaching Certificate and forwarded the 9 recommendation, along with all supporting documentation 10 as jointly required by the State Board of Education and 11 the State Teacher Certification Board, to the regional 12 superintendent of schools; 13 (D) the certificate holder has appealed his or her 14 local professional development committee's recommendation 15 of nonrenewal to the regional professional development 16 review committee and the result of that appeal; 17 (E) the regional superintendent of schools has 18 concurred or nonconcurred with the local professional 19 development committee's or regional professional 20 development review committee's recommendation to renew or 21 nonrenew the certificate holder's Standard Teaching 22 Certificate and made a recommendation to that effect; and 23 (F) the established registration fee for the 24 Standard Teaching Certificate has been paid. 25 At the same time the regional superintendent of schools 26 provides the State Teacher Certification Board with the 27 notice required by this subsection (g), he or she shall also 28 notify the certificate holder in writing that this notice has 29 been provided to the State Teacher Certification Board, 30 provided that if the notice provided by the regional 31 superintendent of schools to the State Teacher Certification 32 Board includes a recommendation of certificate nonrenewal, 33 the written notice provided to the certificate holder shall 34 be by certified mail, return receipt requested. HB1436 Enrolled -68- LRB9202656NTsb 1 (2) Each certificate holder shall have the right to 2 appeal his or her local professional development committee's 3 recommendation of nonrenewal to the regional professional 4 development review committee, within 14 days of receipt of 5 notice that the recommendation has been sent to the regional 6 superintendent of schools. Each regional superintendent of 7 schools shall establish a regional professional development 8 review committee or committees for the purpose of advising 9 the regional superintendent of schools, upon request, and 10 handling certificate holder appeals. This committee shall 11 consist of at least 4 classroom teachers, one 12 non-administrative certificated educational employee, 2 13 administrators, and one at-large member who shall be either 14 (i) a parent, (ii) a member of the business community, (iii) 15 a community member, or (iv) an administrator, with preference 16 given to an individual chosen from among those persons listed 17 in items (i), (ii), and (iii) in order to secure 18 representation of an interest not already represented on the 19 committee. The teacher and non-administrative certificated 20 educational employee members of the review committee shall be 21 selected by their exclusive representative, if any, and the 22 administrators and at-large member shall be selected by the 23 regional superintendent of schools. A regional 24 superintendent of schools may add additional members to the 25 committee, provided that the same proportion of teachers to 26 administrators and at-large members on the committee is 27 maintained. Any additional teacher and non-administrative 28 certificated educational employee members shall be selected 29 by their exclusive representative, if any. Vacancies in 30 positions on a regional professional development review 31 committee shall be filled in the same manner as the original 32 selections. Committee members shall serve staggered 3-year 33 terms. All individuals selected to serve on regional 34 professional development review committees must be known to HB1436 Enrolled -69- LRB9202656NTsb 1 demonstrate the best practices in teaching or their 2 respective field of practice. 3 The exclusive representative responsible for choosing the 4 individuals that serve on a regional professional development 5 review committee shall notify each school district, charter 6 school, or governing body or board of control of a 7 cooperative or joint agreement employing the individuals 8 chosen to serve and provide their names to the appropriate 9 regional superintendent of schools. Regional professional 10 development review committee meetings shall be scheduled so 11 as not to interfere with the committee members' regularly 12 scheduled teaching duties, except when otherwise permitted by 13 the policies of or agreed to or approved by the school 14 district, charter school, or governing body or board of 15 control of a cooperative or joint agreement, or its designee, 16 provided that the school district, charter school, or 17 governing body or board of control shall not unreasonably 18 withhold permission for a committee member to attend regional 19 professional development review committee meetings. 20 In a city having a population exceeding 500,000 that does 21 not have a regional office of education, one or more separate 22 regional professional development review committees shall be 23 established as mutually agreed upon by the board of education 24 of the school district organized under Article 34 of this 25 Code and the exclusive representative. The composition of 26 each committee shall be the same as for a regional 27 professional development review committee, except that 28 members of the committee shall be jointly appointed by the 29 board of education and the exclusive representative. All 30 other provisions of this Section concerning regional 31 professional development review committees shall apply to 32 these committees. 33 The regional professional development review committee 34 may require information in addition to that received from a HB1436 Enrolled -70- LRB9202656NTsb 1 certificate holder's local professional development committee 2 or request that the certificate holder appear before it, 3 shall either concur or nonconcur with a local professional 4 development committee's recommendation of nonrenewal, and 5 shall forward to the regional superintendent of schools its 6 recommendation of renewal or nonrenewal. All actions taken 7 by the regional professional development review committee 8 shall require a quorum and be by a simple majority of those 9 present and voting. A record of all votes shall be 10 maintained. The committee shall have 45 days from receipt of 11 a certificate holder's appeal to make its recommendation to 12 the regional superintendent of schools. 13 The State Board of Education and the State Teacher 14 Certification Board shall jointly provide regional 15 professional development review committee members with a 16 training manual, and the members shall be required to attend 17 one training seminar sponsored jointly by the State Board of 18 Education and the State Teacher Certification Board. 19 (h)(1) The State Teacher Certification Board shall 20 review the regional superintendent of schools' 21 recommendations to renew or nonrenew Standard Teaching 22 Certificates and notify certificate holders in writing 23 whether their certificates have been renewed or nonrenewed 24 within 90 days of receipt of the recommendations, unless a 25 certificate holder has appealed a regional superintendent of 26 schools' recommendation of nonrenewal, as provided in 27 paragraph (2) of this subsection (h). The State Teacher 28 Certification Board shall verify that the certificate holder 29 has met the renewal criteria set forth in paragraph (1) of 30 subsection (g) of this Section. 31 (2) Each certificate holder shall have the right to 32 appeal a regional superintendent of school's recommendation 33 to nonrenew his or her Standard Teaching Certificate to the 34 State Teacher Certification Board, within 14 days of receipt HB1436 Enrolled -71- LRB9202656NTsb 1 of notice that the decision has been sent to the State 2 Teacher Certification Board, which shall hold an appeal 3 hearing within 60 days of receipt of the appeal. When such 4 an appeal is taken, the certificate holder's Standard 5 Teaching Certificate shall continue to be valid until the 6 appeal is finally determined. The State Teacher 7 Certification Board shall review the regional superintendent 8 of school's recommendation, the regional professional 9 development review committee's recommendation, if any, and 10 the local professional development committee's recommendation 11 and all relevant documentation to verify whether the 12 certificate holder has met the renewal criteria set forth in 13 paragraph (1) of subsection (g) of this Section. The State 14 Teacher Certification Board may request that the certificate 15 holder appear before it. All actions taken by the State 16 Teacher Certification Board shall require a quorum and be by 17 a simple majority of those present and voting. A record of 18 all votes shall be maintained. The State Teacher 19 Certification Board shall notify the certificate holder in 20 writing, within 7 days of completing the review, whether his 21 or her Standard Teaching Certificate has been renewed or 22 nonrenewed, provided that if the State Teacher Certification 23 Board determines to nonrenew a certificate, the written 24 notice provided to the certificate holder shall be by 25 certified mail, return receipt requested. All certificate 26 renewal or nonrenewal decisions of the State Teacher 27 Certification Board are final and subject to administrative 28 review, as set forth in Section 21-24 of this Code. 29 (i) Holders of Master Teaching Certificates shall meet 30 the same requirements and follow the same procedures as 31 holders of Standard Teaching Certificates, except that their 32 renewal cycle shall be as set forth in subsection (d) of 33 Section 21-2 of this Code. 34 A holder of a teaching certificate endorsed as a HB1436 Enrolled -72- LRB9202656NTsb 1 speech-language pathologist who has been granted the 2 Certificate of Clinical Competence by the American 3 Speech-Language Hearing Association may renew his or her 4 Standard Teaching Certificate pursuant to the 10-year renewal 5 cycle set forth in subsection (d) of Section 21-2 of this 6 Code. 7 (j) Holders of Valid and Exempt Standard and Master 8 Teaching Certificates who are not employed and performing 9 services in an Illinois public or State-operated elementary 10 school, secondary school, or cooperative or joint agreement 11 with a governing body or board of control, in a certificated 12 teaching position, may voluntarily activate their 13 certificates by developing and submitting a certificate 14 renewal plan to the regional superintendent of schools of the 15 regional office of education for the geographic area where 16 their teaching is done, who, or whose designee, shall approve 17 the plan and serve as the certificate holder's local 18 professional development committee. These certificate 19 holders shall follow the same renewal criteria and procedures 20 as all other Standard and Master Teaching Certificate 21 holders, except that their continuing professional 22 development plans shall not be required to reflect or address 23 the knowledge, skills, and goals of a local school 24 improvement plan. 25 (k) Each school district, charter school, or cooperative 26 or joint agreement shall be paid an annual amount of not less 27 than $1,000, as determined by a formula based on the number 28 of Standard Teaching and Master Teaching Certificate holders, 29 subject to renewal and established by rule, not to exceed 30 $1,000,000 annually for all school districts, charter 31 schools, and cooperatives or joint agreements, for 32 administrative costs associated with conducting the meetings 33 of the local professional development committee, as 34 determined in consultation with the committee. Each regional HB1436 Enrolled -73- LRB9202656NTsb 1 office of education shall receive $2,000 annually to pay 2 school districts, charter schools, or cooperatives or joint 3 agreements for costs, as defined by rule, incurred in staff 4 attendance at regional professional development review 5 committee meetings and the training seminar required under 6 paragraph (2) of subsection (g) of this Section. 7 (l) The State Board of Education and the State Teacher 8 Certification Board shall jointly contract with an 9 independent party to conduct a comprehensive evaluation of 10 the certificate renewal system pursuant to this Section. The 11 first report of this evaluation shall be presented to the 12 General Assembly on January 1, 2005 and on January 1 of every 13 third year thereafter. 14 (Source: P.A. 91-102, eff. 7-12-99; 92-510, eff. 6-1-02.) 15 (105 ILCS 5/21-16) (from Ch. 122, par. 21-16) 16 Sec. 21-16. Fees - Requirement for registration. 17 (a) Until February 15, 2000, every applicant when issued 18 a certificate shall pay to the regional superintendent of 19 schools a fee of $1, which shall be paid into the institute 20 fund. Every certificate issued under the provisions of this 21 Act shall be registered annually or, at the option of the 22 holder of the certificate, once every 3 years. The regional 23 superintendent of schools having supervision and control over 24 the school where the teaching is done shall register the 25 certificate before the holder begins to teach, otherwise it 26 shall be registered in any county in the State of Illinois; 27 and one fee of $4 per year for registration or renewal of one 28 or more certificates which have been issued to the same 29 holder shall be paid into the institute fund. 30 Until February 15, 2000, requirements for registration of 31 any certificate limited in time shall include evidence of 32 professional growth defined as successful teaching experience 33 since last registration of certificate, attendance at HB1436 Enrolled -74- LRB9202656NTsb 1 professional meetings, membership in professional 2 organizations, additional credits earned in recognized 3 teacher-training institutions, travel specifically for 4 educational experience, reading of professional books and 5 periodicals, filing all reports as required by the regional 6 superintendent of schools and the State Superintendent of 7 Education or such other professional experience or 8 combination of experiences as are presented by the teacher 9 and are approved by the State Superintendent of Education in 10 consultation with the State Teacher Certification Board. A 11 duplicate certificate may be issued to the holder of a valid 12 life certificate or valid certificate limited in time by the 13 State Superintendent of Education; however, it shall only be 14 issued upon request of a regional superintendent of schools 15 and upon payment to the regional superintendent of schools 16 who requests such duplicate a fee of $4. 17 (b) Beginning February 15, 2000, all persons who are 18 issued Standard Teaching Certificates pursuant to clause (ii) 19 of paragraph (1)(2)of subsection (c) of Section 21-2 and 20 all persons who renew Standard Teaching Certificates shall 21 pay a $25 fee for registration of all certificates held. All 22 persons who are issued Standard Teaching Certificates under 23 clause (i) of paragraph (1) of subsection (c) of Section 21-2 24 and all other applicants for Standard Teaching Certificates 25 shall pay an original application fee, pursuant to Section 26 21-12, and a $25 fee for registration of all certificates 27 held. These certificates shall be registered and the 28 registration fee paid once every 5 years. Standard Teaching 29 Certificate applicants and holders shall not be required to 30 pay any other registration fees for issuance or renewal of 31 their certificates, except as provided in Section 21-17 of 32 this Code. Beginning February 15, 2000, Master Teaching 33 Certificates shall be issued and renewed upon payment by the 34 applicant or certificate holder of a $50 fee for registration HB1436 Enrolled -75- LRB9202656NTsb 1 of all certificates held. These certificates shall be 2 registered and the fee paid once every 10 years. Master 3 Teaching Certificate applicants and holders shall not be 4 required to pay any other application or registration fees 5 for issuance or renewal of their certificates, except as 6 provided in Section 21-17 of this Code. All other 7 certificates issued under the provisions of this Code shall 8 be registered for the validity period of the certificate at 9 the rate of $5 per year for the total number of years for 10 which the certificate is valid for registration of all 11 certificates held, or for a maximum of 5 years for life 12 certificates. The regional superintendent of schools having 13 supervision and control over the school where the teaching is 14 done shall register the certificate before the holder begins 15 to teach, otherwise it shall be registered in any county in 16 the State of Illinois. Each holder shall pay the appropriate 17 registration fee to the regional superintendent of schools. 18 The regional superintendent of schools shall deposit the 19 registration fees into the institute fund. Any certificate 20 holder who teaches in more than one educational service 21 region shall register the certificate or certificates in all 22 regions where the teaching is done, but shall be required to 23 pay one registration fee for all certificates held, provided 24 holders of certificates issued pursuant to Section 21-9 of 25 this Code shall be required to pay one registration fee, in 26 each educational service region in which his or her 27 certificate or certificates are registered, for all 28 certificates held. 29 A duplicate certificate may be issued to the holder of a 30 valid life certificate or valid certificate limited in time 31 by the State Superintendent of Education; however, it shall 32 only be issued upon request of a regional superintendent of 33 schools and upon payment to the regional superintendent of 34 schools who requests the duplicate a fee of $4, which shall HB1436 Enrolled -76- LRB9202656NTsb 1 be deposited into the institute fund. 2 (Source: P.A. 91-102, eff. 7-12-99.) 3 Section 95. No acceleration or delay. Where this Act 4 makes changes in a statute that is represented in this Act by 5 text that is not yet or no longer in effect (for example, a 6 Section represented by multiple versions), the use of that 7 text does not accelerate or delay the taking effect of (i) 8 the changes made by this Act or (ii) provisions derived from 9 any other Public Act. 10 Section 99. Effective date. This Act takes effect upon 11 becoming law, except that Section 3 takes effect on July 1, 12 2002.
