Provides that the Comptroller shall prepare a report on the number of State and university employees who have contributed to qualified organizations and united funds no later than March 1 of each year. Provides that each agency shall file with the Advisory Committee a report of the total amount of contributions made to qualified organizations and united funds no later than February 15 of each year. LRB9008501MWpcA SB1279 Re-enrolled LRB9008501MWpcA 1 AN ACT concerning certain State payroll deductions. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Voluntary Payroll Deductions Act of 1983 5 is amended by changing Section 5 and adding Section 8 as 6 follows: 7 (5 ILCS 340/5) (from Ch. 15, par. 505) 8 Sec. 5. The State Comptroller shall promulgate and issue 9 reasonable rules and regulations as deemed necessary for the 10 administration of this Act. 11 However, all solicitations of State employees for 12 contributions at their workplace shall be in accordance with 13 rules promulgated by the Governor or his designee or other 14 agency as may be designated by the Governor. 15 The rules promulgated by the Governor or his designee or 16 other agency as designated by the Governor shall include a 17 Code of Campaign Conduct that all qualified organizations and 18 United Funds shall subscribe to in writing, sanctions for 19 violations of the Code of Campaign Conduct, provision for the 20 handling of cash contributions, provision for an Advisory 21 Committee, provisions for the allocation of expenses among 22 the participating organizations, an organizational plan and 23 structure whereby responsibilities are set forth for the 24 appropriate State employees and the participating 25 organizations, and any other matters that are necessary to 26 accomplish the purposes of this Act. 27 The Governor or the Governor's designee shall promulgate 28 rules to establish the composition and the duties of the 29 Advisory Committee. The Governor or the Governor's designee 30 shall make appointments to the Advisory Committee. The 31 powers of the Advisory Committee shall include, at a minimum, SB1279 Re-enrolled -2- LRB9008501MWpcA 1 the ability to impose the sanctions authorized by rule. Each 2 State agency shall file an annual report that sets forth (i) 3 the total amount of money contributed to each qualified 4 organization and united fund through both payroll deductions 5 and cash contributions, (ii) the number of employees who have 6 contributed to each qualified organization and united fund, 7 and (iii) any other information required by the rules. The 8 report shall not include the names of any contributing or 9 non-contributing employee. The report shall be filed with 10 the Advisory Committee no later than March 15 of each year 11 for the solicitation period immediately preceding the report. 12 The report shall be available for inspection. 13 Other Constitutional officers, the University of 14 Illinois, Southern Illinois University, Chicago State 15 University, Eastern Illinois University, Governors State 16 University, Illinois State University, Northeastern Illinois 17 University, Northern Illinois University, and Western 18 Illinois University shall be governed by the rules 19 promulgated pursuant to this Section, unless such entities 20 adopt their own rules governing solicitation of contributions 21 at the workplace. 22 All rules promulgated pursuant to this Section shall not 23 discriminate against one or more qualified organizations or 24 United Funds. 25 (Source: P.A. 89-4, eff. 1-1-96.) 26 (5 ILCS 340/8 new) 27 Sec. 8. Reports. The Comptroller shall annually prepare 28 a report on the number of State and university employees who 29 have contributed to qualified organizations and united funds 30 under this Act. The report shall set forth (i) the number of 31 payroll deductions received by each qualified organization 32 and united fund, (ii) the total amount of the contributions 33 received by each qualified organization and united fund, and SB1279 Re-enrolled -3- LRB9008501MWpcA 1 (iii) the State agencies and universities from which the 2 contributions were received. The report shall be prepared no 3 later than April 1 of each year and shall be available to the 4 public upon request.
