Provides that the Illinois Student Assistance Commission may administer a program of grant assistance as authorized by other statutes that may be referenced in the Higher Education Assistance Act. Provides that the Commission may receive, hold, and disburse funds made available by individuals for the purposes for which those funds were made available. LRB9003362THpk LRB9003362THpk 1 AN ACT to amend the Higher Education Student Assistance 2 Act by changing Section 20. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Higher Education Student Assistance Act 6 is amended by changing Section 20 as follows: 7 (110 ILCS 947/20) 8 Sec. 20. Functions of Commission. 9 (a) The Commission, in accordance with this Act, shall 10 prepare and supervise the issuance of public information 11 concerning its provisions; prescribe the form and regulate 12 the submission of applications for assistance; provide for 13 and conduct, or cause to be conducted, all eligibility 14 determinations of applicants; award the appropriate financial 15 assistance; and, upon request by a member of the General 16 Assembly, nominate or evaluate and recommend for nomination 17 applicants for General Assembly scholarships in accordance 18 with criteria specified by the member under Section 30-9 of 19 the School Code. 20 (b) The Commission is authorized to participate in any 21 programs for monetary assistance to students and to receive, 22 hold, and disburse all such funds made available by any 23 agency or organization for the purpose or purposes for which 24 they are made available. The Commission is authorized to 25 administer a program of grant assistance as authorized by the 26 Baccalaureate Savings Act and other statutes that may be 27 referenced herein. The Commission is authorized to 28 participate in any programs established to improve student 29 financial aid services or the proficiency of persons engaged 30 in student financial aid services and to receive, hold, and 31 disburse all funds made available by any individual, agency -2- LRB9003362THpk 1 or organization for the purpose or purposes for which they 2 are made available subject to the appropriations of the 3 General Assembly. 4 (c) The Commission is authorized to deny a scholarship 5 or a grant to any person who has defaulted on a guaranteed 6 student loan and who is not maintaining a satisfactory 7 repayment record. If a person has a defaulted guaranteed 8 student loan but is otherwise eligible for assistance 9 pursuant to Section 40, the Commission shall award one term 10 of assistance during which a satisfactory repayment record 11 must be established. If such a repayment record is not 12 established, additional assistance shall be denied until a 13 satisfactory repayment record is established. 14 (d) The Commission is authorized to participate with 15 federal, state, county, local, and university law enforcement 16 agencies in cooperative efforts to detect and prosecute 17 incidents of fraud in student assistance programs. 18 (e) The Administrative Review Law shall apply to and 19 govern all proceedings for the judicial review of final 20 administrative decisions of the Commission. 21 (f) The Commission is authorized to make all necessary 22 and proper rules, not inconsistent with this Act, for the 23 efficient exercise of the foregoing functions. 24 (g) Unless otherwise provided by statute, the functions 25 of the Commission shall be exercised without regard to any 26 applicant's race, creed, sex, color, national origin, or 27 ancestry. 28 (Source: P.A. 87-997.)
