90_SB0799sam002 LRB9001379DNsbam 1 AMENDMENT TO SENATE BILL 799 2 AMENDMENT NO. . Amend Senate Bill 799 on page 16, by 3 replacing lines 28 and 29 with the following: 4 "Section 910. Upon payment to the Department of Natural 5 Resources of the sum equal to appraised fair market value, 6 the Director of the Department, on behalf of the State of 7 Illinois, is authorized to execute and deliver to Allan 8 Docksteiner and Betty Docksteiner, husband and wife, their 9 heirs, successors and assigns, a quitclaim deed to the 10 following described real property, provided that the grantees 11 pay the appraisal, land survey, title and closing cost: 12 A part of the Northeast Quarter of the Southwest 13 Quarter of Section 29, Township 9 South, Range 6 East of 14 the Third Principal Meridian, Saline County, Illinois, 15 described as follows: Beginning at the intersection of 16 the Easterly right-of-way line of Liberty Road and the 17 Northwesterly right-of-way line of the abandoned Southern 18 Railway Company Railroad, formerly known as the C.C.C. 19 and St. Louis Railroad; thence from said Point of 20 Beginning, Northeasterly on said Railroad right-of-way 21 line, a distance of 351 feet, more or less; thence 22 Southeasterly on a line at right angles to the last 23 described course, a distance of 35 feet, more or less; -2- LRB9001379DNsbam 1 thence Southwesterly on a line parallel with the 2 aforesaid Railroad right-of-way line, to its intersection 3 with the Easterly right-of-way line of Liberty Road; 4 thence Northerly along said Easterly right-of-way line to 5 the Point of Beginning, containing 0.28 acres, more or 6 less, a more accurate description to be prepared from a 7 survey made or to be made by an Illinois Professional 8 Land Surveyor. 9 Section 915. The appraised fair market value of the real 10 property described in Section 910 shall be determined by an 11 independent fee appraiser, who's appraisal report shall be 12 subject to review and certification by the Department of 13 Natural Resources. The legal description of such real 14 property shall be subject to review and approval by the 15 Department of Natural Resources. 16 Section 920. The conveyance of real property authorized 17 by Section 910 shall be made subject to existing public 18 utilities, existing public roads, and any and all 19 reservations, easements, covenants, and restrictions of 20 record. 21 Section 925. The Director of the Department of Natural 22 Resources, on behalf of the State of Illinois, is authorized 23 to execute and deliver to the County of DuPage, an Illinois 24 unit of local government, for and in consideration of $1.00 25 paid to the Department, a quitclaim deed to the following 26 described real property: 27 That part of Section 6, Township 40 North, Range 9 East 28 of the Third Principal Meridian, described as follows: 29 commencing at the intersection of the centerline of 30 Stearns Road as dedicated by Document 424794 and the 31 East line of lands conveyed by Document R73-9999, said -3- LRB9001379DNsbam 1 East line also being the West line of Linneman's 2 Assessment Plat as recorded by Document R92-032281; 3 thence North 00 degrees 45 minutes 20 seconds West along 4 said East line a distance of 40.07 feet to the North 5 right-of-way line of Stearns Road as dedicated for the 6 Point of Beginning; thence Southwesterly along said 7 North right-of-way line, being a 5769.65 foot radius 8 curve to the left, a distance of 458.80 feet to a point 9 of tangency; thence South 81 degrees 21 minutes 47 10 seconds West along said North right-of-way line, a 11 distance of 298.68 feet; thence North 08 degrees 38 12 minutes 14 seconds West, a distance of 20.00 feet; 13 thence North 81 degrees 21 minutes 47 seconds East along 14 a line which is 20.00 feet northerly of and parallel 15 with said North right-of-way line of Stearns road, a 16 distance of 298.68 feet to a point of curvature; thence 17 along a 5789.65 foot radius curve to the right, a 18 distance of 461.54 feet to said East line of lands 19 conveyed by Document R73-9999; thence South 00 degrees 20 45 minutes 20 seconds East along said East line, a 21 distance of 20.02 feet to the Point of Beginning, 22 containing 0.348 acres, more or less. 23 All situated in the County of DuPage and the State of 24 Illinois. 25 Section 930. The conveyance of real property authorized 26 by Section 925 shall be made subject to: (1) existing 27 public utilities and any and all reservations, easements, 28 covenants, and restrictions of record; and (2) the express 29 condition that if the real property ceases to be used for 30 public purposes it shall revert to the State of Illinois, 31 Department of Natural Resources. 32 Section 935. The conveyance of real property authorized 12 by Section 935 shall be made subject to: (1) existing public 13 roads and utilities; (2) any and all reservations, 14 easements, covenants, and restrictions of record, including, 15 but not limited to, all stipulations set forth in that deed 16 from Commonwealth Edison Company to the State of Illinois, 17 dated February 23, 1956 and recorded in Book 237 at page 93 18 of the records of Ogle County, Illinois; (3) an easement to 19 be reserved for the benefit of the State of Illinois, its 20 successors and assigns, of the right of ingress and egress 21 over and across the real property for the express purpose of 22 carrying out any and all obligations stated in the 23 aforementioned deed dated February 23, 1956; and (4) the 24 express condition that if the real property ceases to be 25 used for public purposes it shall revert to the State of 26 Illinois, Department of Natural Resources. 27 Section 945. The Director of the Department of Natural 28 Resources, on behalf of the State of Illinois, is authorized 29 to execute and deliver to the City of Murphysboro, an 30 Illinois municipal corporation, of the County of Jackson, 31 State of Illinois, for and in consideration of $1.00 paid to 32 the Department, a quitclaim deed to the following described -8- LRB9001379DNsbam 1 real property: 2 The John A. Logan Monument and all appurtenances thereto, 3 and any and all rights that the State of Illinois has in 4 or appertaining to such monument and appurtenances, 5 together with the land upon which such monument and 6 appurtenances are located, and including any adjoining 7 land appertaining to said monument and appurtenances, if 8 any, all in the City of Murphysboro, Jackson County, 9 Illinois. 10 Section 950. The Director of the Department of Natural 11 Resources, on behalf of the State of Illinois, is authorized 12 to exchange certain real property in Jackson County, 13 Illinois, hereinafter referred to as Parcel 2 and Parcel 3, 14 for certain real property in Jackson County, Illinois, 15 hereinafter referred to as Parcel 1, the Parcels being 16 described as follows: 17 PARCEL 1 18 A part of the Southwest Quarter of the Southeast Quarter 19 of Section 2, Township 8 South, Range 4 West of the 20 Third Principal Meridian, Jackson County, Illinois, more 21 particularly described as follows: Commencing at the 22 Southeast corner of the Southwest Quarter of the 23 Southeast Quarter of said Section 2; thence Westerly 24 along the South line of the Southwest Quarter of the 25 Southeast Quarter of said Section 2, a distance of 26 578.52 feet to an iron pin monument with an aluminum 27 cap, said iron pin monument with an aluminum cap being 28 the Point of Beginning for this description; from said 29 Point of Beginning, thence continuing Westerly along the 30 last aforesaid line projected, a distance of 121.48 feet 31 to an iron pin monument with an aluminum cap; thence 32 Northerly along a line with a deflection angle of 90 33 degrees 00 minutes 00 seconds, a distance of 150.00 feet -9- LRB9001379DNsbam 1 to an iron pin monument with an aluminum cap; thence 2 Easterly along a line with a deflection angle of 90 3 degrees 00 minutes 00 seconds, a distance of 121.48 feet 4 to an iron pin monument with an aluminum cap; thence 5 Southerly along a line with a deflection angle of 90 6 degrees 00 minutes 00 seconds, a distance of 150.00 feet 7 to the Point of Beginning, containing 0.418 acres, more 8 or less. 9 PARCEL 2 10 A part of the Southwest Quarter of the Southeast Quarter 11 of Section 2, Township 8 South, Range 4 West of the 12 Third Principal Meridian, Jackson County, Illinois, more 13 particularly described as follows: Commencing at the 14 Southeast corner of the Southwest Quarter of the 15 Southeast Quarter of said Section 2; thence Westerly 16 along the South line of the Southwest Quarter of the 17 Southeast Quarter of said Section 2, a distance of 18 578.52 feet to an iron pin monument with an aluminum 19 cap; thence Northerly along a line with a deflection 20 angle of 90 degrees 00 minutes 00 seconds, a distance of 21 150.00 feet to an iron pin monument with an aluminum 22 cap, said iron pin monument with an aluminum cap being 23 the Point of Beginning for this description; from said 24 Point of Beginning, thence Easterly along a line with a 25 deflection angle of 90 degrees 00 minutes 00 seconds, a 26 distance of 128.52 feet to an iron pin monument with an 27 aluminum cap; thence Northerly along a line with a 28 deflection angle of 90 degrees 00 minutes 00 seconds, a 29 distance of 181.33 feet to an iron pin monument with an 30 aluminum cap; thence Southwesterly along a line with a 31 deflection angle of 144 degrees 40 minutes 23 seconds, a 32 distance of 222.26 feet to the Point of Beginning, 33 containing 0.268 acres, more or less. 34 PARCEL 3 -10- LRB9001379DNsbam 1 A part of the Southwest Quarter of the Southeast Quarter 2 of Section 2, Township 8 South, Range 4 West of the 3 Third Principal Meridian, Jackson County, Illinois, more 4 particularly described as follows: Commencing at the 5 Southeast corner of the Southwest Quarter of the 6 Southeast Quarter of said Section 2; thence Westerly 7 along the South line of the Southwest Quarter of the 8 Southeast Quarter of said Section 2, a distance of 9 450.00 feet to a point; thence Northerly along a line 10 with a deflection angle of 90 degrees 00 minutes 00 11 seconds, a distance of 528.91 feet to an iron pin 12 monument with an aluminum cap, said iron pin monument 13 with an aluminum cap being the Point of Beginning for 14 this description; from said Point of Beginning, thence 15 continuing Northerly along the last aforesaid line 16 projected, a distance of 121.09 feet to a point; thence 17 Westerly along a line with a deflection angle of 90 18 degrees 00 minutes 00 seconds, a distance of 108.52 feet 19 to an iron pin monument with an aluminum cap; thence 20 Southeasterly along a line with a deflection angle of 21 131 degrees 52 minutes 02 seconds, a distance of 162.60 22 feet to the Point of Beginning, containing 0.151 acres, 23 more or less. 24 Section 955. The lands described in Section 950 to be 25 exchanged are equal in area and are of marginal but 26 equivalent value. The exchange of lands will be to the 27 mutual advantage of both parties on the basis of utility; 28 each party shall be responsible for any and all title costs 29 associated with their respective properties. 30 Section 960. The Director of the Department of Natural 31 Resources shall obtain an opinion of title from the Illinois 32 Attorney General certifying that the State of Illinois will -11- LRB9001379DNsbam 1 receive merchantable title to the real property referred to 2 in Section 950 as Parcel 1. 3 Section 965. The Director of the Department of Natural 4 Resources, on behalf of the State of Illinois, is authorized 5 to execute and deliver to Norfolk Southern Corporation, its 6 successors and assigns, for and in consideration of $1.00 7 paid to the Department, a non-exclusive grant of permanent 8 easement, for the purpose of operating, repairing, 9 maintaining, removing, and replacing the existing radio 10 transmitter/receiver, radio tower, access road, utility 11 services, and all necessary appurtenances, on, over, and 12 across the following described real property: 13 All that part of the following described tract which lies 14 southerly of the centerline of Tunnel Hill Road (also 15 known as State Aid Route 2&4) and northerly of a line 16 drawn perpendicular to the centerline of the former 17 right-of-way of the Southern Railway Company, said 18 perpendicular line being located 250 feet southerly of 19 the centerline of said road as measured on and along the 20 centerline of said former railway, said part containing 21 1.20 acres, more or less, to wit: All that part of the 22 Northeast Quarter of the Southeast Quarter of Section 23 35, Township 11 South, Range 3 East of the Third 24 Principal Meridian, owned by the State of Illinois and 25 under the control and jurisdiction of the Department of 26 Natural Resources (formerly known as the Department of 27 Conservation), being all that part of said Quarter 28 Quarter Section falling within the former right-of-way 29 of the Southern Railway Company, all situated in the 30 County of Johnson and the State of Illinois, 31 Section 970. The grant of easement authorized by Section 32 965 shall be made subject to: (1) existing public utilities, -12- LRB9001379DNsbam 1 existing public roads, and any and all easements, covenants, 2 and restrictions of record; (2) the condition that the 3 easement rights thereby granted shall not be exercised in 4 any manner that interferes with, obstructs, damages, or 5 endangers the facilities of the Department of Natural 6 Resources; and (3) the condition that the grant of easement 7 shall terminate upon cessation of use or abandonment of 8 facilities by Norfolk Southern Corporation, its successors 9 and assigns, for a continuous period exceeding 24 months. 10 Section 975. The Director of the Department of Natural 11 Resources, on behalf of the State of Illinois, is authorized 12 to execute and deliver to the City of Monmouth, an Illinois 13 municipal corporation, of the County of Warren, State of 14 Illinois, for and in consideration of $1.00 paid to the 15 Department, a quitclaim deed to the following described real 16 property: 17 Parcel 2AV 18 A part of the East Half of the Northwest Quarter of 19 Section 31, Township 11 North, Range 2 West of the 20 Fourth Principal Meridian, Warren County, Illinois, more 21 particularly described as follows: 22 Beginning at the point of intersection of the West line 23 of the said East Half of the Northwest Quarter of 24 Section 31 and the northwesterly railroad trackage right 25 of way line of the Burlington Northern, Incorporated; 26 thence northerly 1557.03 feet, more or less, along the 27 said West line of the East Half of the Northwest Quarter 28 of Section 31; thence easterly 744.83 feet, more or 29 less, to a point on the existing westerly right of way 30 line of Federal Aid Route 9, said point being 160.0 feet 31 normally distant westerly from the Survey Line of 32 Federal Aid Route 9 and running thence southerly 1127.33 33 feet along the existing westerly right of way line of -13- LRB9001379DNsbam 1 said Route 9 parallel to the Survey Line of said Route 9 2 to a point on the northwesterly railroad trackage right 3 of way line of the Burlington Northern, Incorporated, 4 said northwesterly trackage right of way line being 5 parallel to and 100.0 feet normally distant 6 northwesterly from the southeasterly trackage right of 7 way line of the Burlington Northern, Incorporated; 8 thence southwesterly 896.96 feet, more or less, along 9 the said northwesterly trackage right of way line to a 10 point on the said West line of the East Half of the 11 Northwest Quarter of said Section 31 and the Point of 12 Beginning, the said real estate containing 23.867 acres, 13 more or less. 14 All of the above being shown by plat recorded in the 15 Recorder's Records of Warren County, Illinois, as 16 Document Number 361066. 17 Parcel 3A-1 18 A part of the East Half of the Northwest Quarter of 19 Section 31, Township 11 North, Range 2 West of the 20 Fourth Principal Meridian, in the County of Warren and 21 State of Illinois, more particularly described as 22 follows: 23 Commencing at the point of intersection of the east line 24 of the Northwest Quarter of Said Section 31 and a line 25 parallel with and 292.5 feet normally distant southerly 26 from the north line of the Northwest Quarter of said 27 Section 31, and running thence westerly 716.76 feet, 28 more or less, parallel with the north line of the 29 Northwest Quarter of said Section 31 to the Point of 30 Beginning, said point being 160.0 feet normally distant 31 westerly from the Survey Line of Federal Aid Route 9. 32 From the Point of Beginning, continuing westerly 744.8 33 feet, more or less, parallel with the north line of the 34 Northwest Quarter of said Section 31 to a point on the -14- LRB9001379DNsbam 1 west line of the East Half of the Northwest Quarter of 2 said Section 31; The transaction described in Section 995 25 will be to the mutual advantage of both parties; each party 26 shall be responsible for any and all title costs associated 27 with their respective properties. 28 Section 1005. The Director of the Department of Natural 29 Resources shall obtain an opinion of title from the Illinois 30 Attorney General certifying that the State of Illinois will 31 receive merchantable title to the real property referred to 32 in Section 995 as Parcel 2. -21- LRB9001379DNsbam 1 Section 1010. On behalf of the State of Illinois, the 2 Director of the Department of Natural Resources is authorized 3 to execute and deliver its interest in the real property, 4 described as follows, to the Town of Naples, its successors 5 and assigns, for and in consideration of $1 paid to the 6 Department; such interest consisting of a public recreational 7 easement for the purpose of launching and landing boats into 8 the Illinois River: 9 Part of the Southwest Quarter of fractional Section 12, 10 Township 15 North, Range 13 West of the 3rd P.M., Scott 11 County, Illinois, more particularly described as follows: 12 Beginning at a point approximately 1540 feet South of the 13 North line of above described fractional Section 12; said 14 point being the North line of Shelly Street in the 15 Village of Naples, at its intersection with the West toe 16 of slope of the Mauvaisterre Drainage and Levee District 17 levee; thence in a Northeasterly direction parallel to 18 the levee 140 feet; thence Westerly 240 feet, more or 19 less, to the East shore line of the Illinois River; 20 thence in a Southwesterly direction along the low water 21 line of the East shore of the Illinois River 630 feet 22 more or less; thence Easterly 240 feet, more or less, to 23 the West toe of slope of the above described levee; 24 thence Northeasterly along the toe of the levee 490 feet, 25 more or less, to the place of beginning, containing 4.3 26 acres, more or less. 27 Section 1015.
