90_SB0799enr New Act Provides that, upon payment of specified consideration to the State, the State is authorized to convey title to certain land, release easements over certain land, and restore access rights to certain land. Effective immediately. LRB9001379DNmbA SB799 Enrolled LRB9001379DNmbA 1 AN ACT in relation to certain land. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. Upon the payment of the sum of $5,625.00 to 5 the State of Illinois, the easement for highway purposes 6 acquired by the People of the State of Illinois is released 7 over and through the following described land in Peoria 8 County, Illinois: 9 Parcel No. 403D10V 10 Lot 118, except the Easterly 5 feet of said lot, in the 11 Highlands Subdivision, an addition to the Village of 12 Peoria Heights, being in the Northwest quarter of Section 13 27, Township 9 North, Range 8 East of the Fourth 14 Principal Meridian, Peoria County, Illinois, containing 15 3,750 square feet, more or less, or 0.086 acre more or 16 less. 17 It is understood and agreed that there is no existing 18 right of access nor will access be permitted in the future by 19 the State of Illinois, Department of Transportation, from or 20 over the premises above described to and from FA Route 49 (US 21 150), previously declared a freeway, nor will access from or 22 to the parcel be permitted from the adjacent Vincent Avenue 23 nor the adjacent alley. 24 Section 10. The transaction described in Section 995 6 will be to the mutual advantage of both parties; each party 7 shall be responsible for any and all title costs associated 8 with their respective properties. 9 Section 1005. The Director of the Department of Natural 10 Resources shall obtain an opinion of title from the Illinois 11 Attorney General certifying that the State of Illinois will 12 receive merchantable title to the real property referred to 13 in Section 995 as Parcel 2. 14 Section 1010. On behalf of the State of Illinois, the 15 Director of the Department of Natural Resources is authorized 16 to execute and deliver its interest in the real property, 17 described as follows, to the Town of Naples, its successors 18 and assigns, for and in consideration of $1 paid to the 19 Department; such interest consisting of a public recreational 20 easement for the purpose of launching and landing boats into 21 the Illinois River: 22 Part of the Southwest Quarter of fractional Section 12, 23 Township 15 North, Range 13 West of the 3rd P.M., Scott 24 County, Illinois, more particularly described as follows: 25 Beginning at a point approximately 1540 feet South of the 26 North line of above described fractional Section 12; said 27 point being the North line of Shelly Street in the 28 Village of Naples, at its intersection with the West toe 29 of slope of the Mauvaisterre Drainage and Levee District 30 levee; thence in a Northeasterly direction parallel to 31 the levee 140 feet; thence Westerly 240 feet, more or SB799 Enrolled -50- LRB9001379DNmbA 1 less, to the East shore line of the Illinois River; 2 thence in a Southwesterly direction along the low water 3 line of the East shore of the Illinois River 630 feet 4 more or less; thence Easterly 240 feet, more or less, to 5 the West toe of slope of the above described levee; 6 thence Northeasterly along the toe of the levee 490 feet, 7 more or less, to the place of beginning, containing 4.3 8 acres, more or less. 9 Section 1015. The Director of Natural Resources shall 10 obtain a certified copy of the portions of this Act 11 containing the title, enacting clause, the effective date, 12 the appropriate Section or Sections containing the land 13 descriptions of property to be transferred or otherwise 14 affected, and this Section within 60 days after its 15 effective date and, upon receipt of payment required by the 16 Section or Sections, if any payment is required, shall 17 record the certified document in the Recorder's Office in 18 the county in which the land is located. 19 Section 9999. Effective date. This Act takes effect upon 20 becoming law.
