 1                    AMENDMENT TO SENATE BILL 799
 2        AMENDMENT NO.     .  Amend Senate Bill 799 on page 16, by
 3    inserting below line 17, the following:
 4        "Section 40.  Upon the payment of the sum  of  $22,000.00
 5    to  the State of Illinois, the rights or easements of access,
 6    crossing, light, air and view from, to and over the following
 7    described land and FA  Route  805  are  restored  subject  to
 8    permit  requirements  of the State of Illinois, Department of
 9    Transportation:
10    Parcel No. 800XA50:
11        Direct access to FA Route 805 (Illinois Route 161)  shall
12        be  restored  to  720.87 feet of a tract of land abutting
13        the northeasterly right of way line of said route in  the
14        East Half of the Southeast Quarter of Section 6, Township
15        1  North,  Range  8 West of the Third Principal Meridian,
16        St.  Clair  County,  Illinois,  being  more  particularly
17        described as follows:
18        Commencing at the Southeast Corner of Section 6, Township
19        1 North, Range 8 West of the  Third  Principal  Meridian;
20        thence  North 00 degrees 00 minutes 04 seconds East along
21        the east line of said Section 6,  a  distance  of  706.53
22        feet to a point on the northeasterly right of way line of
23        FA  Route  805 (Illinois Route 161); thence northwesterly

19        For the purpose of this description, said South  Line  of

22    Subject to the following conditions:
23    1.  The  property  above  described  will  be maintained as a
24        wetland.  The existing configuration of  water  elevation
25        and  vegetation  growing  both in the water and within 10
26        feet of the waters edge  will  not  be  altered,  filled,
27        drained, or otherwise disturbed or altered.
28        Access  to  the  property  will  be restricted to the one
29        original access point  at  Station  44+63+,  as  measured
30        along  the  southwest  service  drive,  or at Rt. Station
31        745+59.49 as measured from the survey line for F.A. Route
32        38.  The property will have  to  be  maintained  for  the
33        benefit  of  wildlife,  so no hunting or trapping will be
34        allowed on the property.

 1    2.  Provided,  however,  that  should  the   property   above
 2        described  ever cease to be used for public park purposes
 3        or in compliance with the stipulations  contained  above,
 4        then  all  control and title shall revert to the Illinois
 5        Department of Transportation.
 6        Section 60.  Upon the payment of the sum of $12,965.00 to
 7    the State of Illinois, the rights  or  easements  of  access,
 8    crossing, light, air and view from, to and over the following
 9    described  land  and  FAP  Route  322 are restored subject to
10    permit requirements of the State of Illinois,  Department  of
11    Transportation:
12    Parcel No. 7M168AR
13        A  part of the Northeast Quarter of the Northeast Quarter
14        of Section 30, Township 1 North,  Range  1  East  of  the
15        Third  Principal  Meridian, Marion County, Illinois, more
16        particularly described as follows:
17        Beginning at  the  southeast  corner  of  said  Northeast
18        Quarter of the Northeast Quarter and running thence North
19        on  the  east  line  553  feet;  thence  West to the east
20        right-of-way line of Highway U.S. 51 (FA Route  322;  SBI
21        2);  thence South with said east right-of-way line to the
22        south line of said Northeast  Quarter  of  the  Northeast
23        Quarter; thence East with said south line to the Point of
24        Beginning.
25        Section  65.   Upon the payment of the sum of $120,000.00
26    to the State of Illinois, the Secretary of the Department  of
27    Transportation  is authorized to convey by quitclaim deed all
28    right, title and interest in and to the  following  described
29    land in Kane County, Illinois, to the city of St. Charles.

31        That  part  of  the  South  West  quarter  of Section 26,
32        Township 40 North, Range 8 East of  the  Third  Principal

 5        thence  North 64 degrees 32 minutes East 264 feet for the
 6        point of beginning; thence North 64  degrees  32  minutes
 7        East  79.44 feet; thence South 89 degrees 41 minutes East
 8        365 feet; thence South 2 degrees 22  minutes  West  440.8
 9        feet to the South line of said South West quarter; thence
