In a municipality with more than 500,000 inhabitants, creates a Citizens Review Board to monitor housing authority police, with 3 members appointed by the Governor, 2 members appointed by the presiding officer of the municipality, and one member appointed by each of the legislative leaders of the General Assembly. Authorizes the Board to suspend, terminate, or take other disciplinary action against an officer who verbally or physically abused a tenant or tenant's guest or invitee while on or off duty or who entered the residence of a tenant unlawfully. Effective immediately. LRB9000869SMcw SB25 Engrossed LRB9000869SMcw 1 AN ACT to amend the Housing Authorities Act by adding 2 Section 8.1c. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Housing Authorities Act is amended by 6 adding Section 8.1c as follows: 7 (310 ILCS 10/8.1c new) 8 Sec. 8.1c. Citizens Review Board. A Citizens Review 9 Board is established for the housing authority in any 10 municipality having over 500,000 inhabitants to monitor the 11 housing authority police force. 12 The Board shall consist of 9 members with 5 appointed by 13 the Governor, 2 appointed by the presiding officer of the 14 municipality, and 2 appointed by the commissioners of the 15 housing authority. The initial terms of the members shall be 16 one, 2, 3, 4, and 5 years for the members appointed by the 17 Governor, one and 2 years for the members appointed by the 18 presiding officer, and one and 2 years for the members 19 appointed by the commissioners of the housing authority. The 20 appointing authority shall determine which initial term each 21 appointee shall serve. Each successor of the initial members 22 shall serve for a term of 4 years. The initial appointments 23 to the Board shall be made within 30 days of the effective 24 date of this amendatory Act of 1997. The Board shall select 25 one of its members to serve as chairperson. The Board may, 26 after notice and a hearing, remove by majority vote a member 27 of the Board who has been found guilty of neglect of duty or 28 malfeasance. If a member of the Board resigns or is removed, 29 the official who would appoint the member's successor shall 30 appoint a person to serve the remainder of the member's term. 31 After a member's term expires, the member shall continue to SB25 Engrossed -2- LRB9000869SMcw 1 serve until a successor is appointed and qualified. 2 Subject to collective bargaining agreements, the Board 3 has the authority, after holding a hearing, to suspend, 4 terminate, or take other disciplinary action against a 5 housing authority police officer if: 6 (1) the officer is found by the Board to have 7 verbally or physically abused a tenant or his or her 8 guest or invitee while the officer was on or off duty; 9 (2) the officer is found by the Board to have 10 entered the residence of a housing authority tenant and 11 was neither (i) executing a legally issued arrest warrant 12 or search warrant for that residence nor (ii) otherwise 13 lawfully present in the residence; or 14 (3) the officer is found by the Board to have 15 verbally or physically abused a person on or off housing 16 authority property while performing his or her duty as a 17 housing authority police officer. 18 Section 99. Effective date. This Act takes effect upon 19 becoming law.
