90_HB2827ccr001 LRB9009243JMsbccr 1 90TH GENERAL ASSEMBLY 2 CONFERENCE COMMITTEE REPORT 3 ON HOUSE BILL 2827 4 ------------------------------------------------------------- 5 ------------------------------------------------------------- 6 To the President of the Senate and the Speaker of the 7 House of Representatives: 8 We, the conference committee appointed to consider the 9 differences between the houses in relation to Senate 10 Amendments No. 1, 2, 3, and 5 to House Bill 2827, recommend 11 the following: 12 (1) that the House concur in Senate Amendments No. 1, 2, 13 3, and 5; and 14 (2) that House Bill 2827, AS AMENDED, be further amended 15 as follows: 16 in the introductory paragraph of Section 5, by inserting 17 "25-10," after "17-30,"; and 18 in Section 5, by replacing all of Sec. 25-11 with the 19 following: 20 "(10 ILCS 5/25-10) (from Ch. 46, par. 25-10) 21 Sec. 25-10. This Section applies only to counties of 22 3,000,000 or more population. When a vacancy occurs in the 23 office of Clerk of the Circuit Court of any of the counties 24 in this State, it shall be the duty of the Circuit Judges of 25 the respective judicial circuit in which such vacancy may 26 occur, to make an appointment to fill the vacancy for the 27 remainder of the unexpired term. However, if more than 28 28 months remain in the term, the appointment shall be until the 29 next general election, at which time a clerk of the circuit 30 court shall be elected for the balance of the unexpired term. 31 The appointee shall be a member of the same political party 32 as the person he succeeds was at the time of his election and 33 shall be otherwise eligible to serve as Clerk of the Circuit -2- LRB9009243JMsbccr 1 Court. The Circuit Judges may appoint a Clerk Pro Tempore for 2 whatever period is necessary while reviewing the 3 qualifications of candidates for appointment to the office. 4 (Source: P.A. 86-875; 86-1348.) 5 (10 ILCS 5/25-11) (from Ch. 46, par. 25-11) 6 Sec. 25-11. When a vacancy occurs in any elective county 7 office, or in a county of less than 3,000,000 population in 8 the office of clerk of the circuit court, in a county which 9 is not a home rule unit, the county board shall declare that 10 such vacancy exists and notification thereof shall be given 11 to the county central committee or the appropriate county 12 board district committee of each established political party 13 within 3 days of the occurrence of the vacancy. The vacancy 14 shall be filled within 60 days by appointment of the chairman 15 of the county board with the advice and consent of the county 16 board. The appointee shall be a member of the same political 17 party as the person he succeeds was at the time of his 18 election and shall be otherwise eligible to serve. The 19 appointee shall serve the remainder of the unexpired term. 20 However, if more than 28 months remain in the term, the 21 appointment shall be until the next general election at which 22 time the vacatedcountyoffice shall be filled by election 23 for the remainder of the term.
