1 AMENDMENT TO HOUSE BILL 1261
2 AMENDMENT NO. . Amend House Bill 1261, AS AMENDED,
3 by replacing everything after the enacting clause with the
4 following:
5 "Section 5. Upon the payment of the sum of $1.00 to the
6 State of Illinois, the Director of Mental Health and
7 Developmental Disabilities (before July 1, 1997) or the
8 Secretary of Human Services (on and after July 1, 1997) is
9 authorized to convey to the County of Kankakee by quit claim
10 deed, all right, title, and interest of the State of Illinois
11 in and to the following described real property, to wit:
12 A part of the North Half of the South Half of the
13 Southwest Quarter of Section 8, Township 30 North, Range
14 13 West of the 2nd P.M. in Kankakee County, Illinois,
15 described as follows: Commencing at the intersection of
16 the East right-of-way line of Illinois Route 49 with the
17 North line of the South Half of the South Half of the
18 Southwest Quarter of said Section 8; thence North
19 00䓎'25" West along said East right-of-way line a
20 distance of 300.00 feet to a point; thence South
21 88䓦'15" East a distance of 1,452.57 feet to a point;
22 thence South 00䓎'25" East a distance of 300.00 feet to
23 a point; thence North 88䓦'15" West along the North line

1 of the South Half of the South Half of the Southwest
2 Quarter of said Section 8 a distance of 1,452.57 feet to
3 the point of beginning, SUBJECT TO rights-of-way for
4 roads, drainage, and easements apparent or of record, AND
5 SUBJECT TO survey.
6 Section 10. The conveyance of real property authorized
7 by Section 50 shall be made subject to the express condition
8 that the property be used for the construction of a county
9 jail facility, and that if the grantee fails to use the
10 property for this purpose the title to the property shall
11 revert to the State of Illinois.
12 Section 15. The Director of Mental Health and
13 Developmental Disabilities (before July 1, 1997) or the
14 Secretary of Human Services (on and after July 1, 1997) shall
15 obtain a certified copy of the portions of this Act
16 containing the title, the enacting clause, the effective
17 date, the appropriate Section or Sections containing the land
18 descriptions of property to be transferred or otherwise
19 affected, and this Section within 60 days after its effective
20 date, and, upon receipt of the payment required by the
21 Section or Sections, if any payment is required, shall record
22 the certified document in the Recorder's Office in the
23 appropriate county.
24 Section 99. Effective date. This Act takes effect upon
25 becoming law.".
