 1                    AMENDMENT TO HOUSE BILL 1212
 2        AMENDMENT NO.     .  Amend House Bill 1212 on page 2,  by
 3    inserting below line 15 the following:
 4        "Section  8.  Upon the payment of the sum of $6,850.00 to
 5    the State of Illinois,  the  easement  for  highway  purposes
 6    acquired  by  the People of the State of Illinois is released
 7    over and through the  following  described  land  in  Madison
 8    County, Illinois:
 9        Parcel No. 800X898:
10        Part of Lot 1 in "Rutz-Iberg Subdivision", as recorded in
11        the Recorder's Office of Madison County, Illinois in Plat
12        Book  36 on Page 11 being a part of the Northeast Quarter
13        of the Southwest Quarter of Section 32, Township 4 North,
14        Range 5 West of the  Third  Principal  Meridian,  Madison
15        County, Illinois, more particularly described as follows:
16             Commencing  at  an  old stone found at the Northwest
17        Corner of the  Southwest  Quarter  of  said  Section  32;
18        thence east along the north line of the Southwest Quarter
19        of  said  Section  32, a distance of 1,912.61 feet to the
20        northerly extension of the east line of  said  Lot  1  in
21        "Rutz-Iberg  Subdivision";  thence  South  00  degrees 47
22        minutes 35 seconds East along  said  northerly  extension
23        and  the  east  line  of said Lot 1, a distance of 601.10

 1        feet to the Southeast Corner of said Lot  1,  said  point
 2        being  on  the existing northerly right of way line of FA
 3        Route 12 (marked U.S. Route 40), being also the Point  of
 4        Beginning.
 5             From  said  Point  of  Beginning;  thence continuing
 6        South 00 degrees 47 minutes 35  seconds East, 53.40 feet;
 7        thence around a curve to the  left  having  a  radius  of
 8        4,607.75  feet, chord bearing South 70 degrees 49 minutes
 9        58 seconds West, an arc distance of 167.01  feet;  thence
10        North  00  degrees 47 minutes 35 seconds West, 54.04 feet
11        to the Southwest Corner of  said  Lot  1  of  "Rutz-Iberg
12        Subdivision",  said point being on the existing northerly
13        right of way line of FA Route 12 (marked U.S. Route  40);
14        thence  along  said existing right of way, around a curve
15        to the right having a  radius  of  4,658.75  feet,  chord
16        bearing  North  71 degrees 02 minutes 28 seconds East, an
17        arc distance of 166.81 feet to the Point of Beginning.
18             Parcel 800X898 herein described contains  8,512  sq.
19        ft. (0.195 acre).
20             Basis  of  bearing is North 90 degrees 00 minutes 00
21        seconds East between  a  stone  found  at  the  Northwest
22        Corner  of the Southwest Quarter of Section 32 and a plug
23        found at the center of said Section 32, Township 4 North,
24        Range 5 West of the Third Principal Meridian.
25             And further, in consideration of the payment of  the
26        amount  set  forth  above,  the  rights  or  easements of
27        access, crossing, light, air and view  to  and  from  the
28        following  described  land  and  FA Route 12 are restored
29        subject to permit requirements of the State of  Illinois,
30        Department of Transportation:
31             Direct  access to FA Route 12 (marked U.S. Route 40)
32        shall be restored to 166.81  lin.  ft.  of  the  existing
33        northerly  right  of  way  line  of  FA  Route  12 in the
34        Northeast Quarter of the Southwest Quarter of Section 32,

 1        Township 4 North, Range 5 West  of  the  Third  Principal
 2        Meridian,  Madison  County,  Illinois,  said right of way
 3        line being described as follows:
 4             Lot 1 of Rutz-Iberg Subdivision, a subdivision of  a
 5        tract  of  land in the Northeast Quarter of the Southwest
 6        Quarter of Section 32, Township 4 North, Range 5 West  of
 7        the  Third  Principal  Meridian, as the same appears from
 8        plat thereof recorded in the Recorder's Office of Madison
 9        County, Illinois in Plat Book 36 on Page 11.  Situated in
10        the County of Madison and State of Illinois.
11        Section 9.  Upon the payment of the sum of $400.00 to the
12    State of Illinois,  the  easement  for  highway  purposes  is
13    released  over  and  through the following described land and
14    the rights or easements of access, crossing, light,  air  and
15    view  from,  to  and over the following described land and FA
16    Route 12 are restored subject to permit requirements  of  the
17    State of Illinois, Department of Transportation:
18        Parcel No. 5X23712
19        Part of the Southwest Quarter of the Northwest Quarter of
20        Section  16,  Township  10  North,  Range  14 West of the
21        Second Principal Meridian, Clark County,  Illinois,  also
22        being  part of a dedication of right of way for a freeway
23        by Charles F. Beaver, recorded in Right of  Way  Book  4,
24        pages  447 and 448 in the Clark County Recorder's Office,
25        described as follows:
26             Commencing at the southwest corner of the  Northwest
27        Quarter  of  said  Section 16; thence North 88 degrees 28
28        minutes 14 seconds East (bearings based on F.A. Route  12
29        surveyed  centerline  bearing  of  North  67  degrees  21
30        minutes  East  from  right of way dedication plat) 394.86
31        feet along the south line of said  Northwest  Quarter  to
32        the  Point  of  Beginning;  thence  North  67  degrees 21
33        minutes 00 seconds East 220.05 feet along a line parallel

 1        with  and  35.00  feet  southerly  of  the  said   survey
 2        centerline; thence South 22 degrees 39 minutes 00 seconds
 3        East  85.00  feet  to  the  intersection  of the existing
 4        southerly right of way line of said F.A. Route 12 and the
 5        south line of the  Southwest  Quarter  of  the  Northwest
 6        Quarter  of  said  Section 16; thence South 88 degrees 28
 7        minutes 14 seconds West 235.89 feet along the south  line
 8        of  said  Quarter  Section  to  the  Point  of Beginning,
 9        containing 0.215 of an acre, more or less.".
