AMENDMENT TO SENATE BILL 2428

2    AMENDMENT NO. ______. Amend Senate Bill 2428 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Personnel Code is amended by changing
5Section 8a.2 and by adding Section 8a.3 as follows:
 
6    (20 ILCS 415/8a.2)  (from Ch. 127, par. 63b108a.2)
7    Sec. 8a.2. For the purposes of the pay plan established
8under Section 8a of this Code, the Director may establish a
9special pay supplement for those positions of employment that
10are in State agencies not covered by Section 8a.3 of this Code
11and that require, pursuant to the Department's official
12classification specification, that a person employed in that
13position engage in oral or written communication at the
14requisite professional level in speak or write a language
15other than English. Positions paid under Section 8a of this
16Code may be eligible for a bilingual pay supplement to attract

1bilingual individuals, to encourage present employees to
2become proficient in languages other than English, or to
3retain qualified bilingual employees.
4    The positions eligible for a bilingual pay supplement
5under this Section, the amount of the supplement, and the
6length of time it remains in effect shall be negotiated
7between the Department and the appropriate collective
8bargaining representative as determined under the Illinois
9Public Labor Relations Act. The bilingual pay supplement may
10be negotiated for each foreign language required for the
11position by the Department's official classification
12specification.
13    A bilingual pay supplement under this Section shall be
14processed within 30 calendar days after the employee presents
15to the Director, or the Director's designee for this purpose,
16a certification from either: (i) the designated testing
17program process selected by the Director; or (ii) an Illinois
18community college confirming that the language skill
19proficiency requirement described in this Section in reading,
20writing, and speaking has been satisfied by the employee.

2Department of Children and Family Services and the Department
3of Corrections that require, pursuant to the Department of
4Central Management Services's official classification
5specification, that a person employed in that position engage
6in oral or written communication at the requisite professional
7level in a language other than English. Positions paid under
8Section 8a of this Code may be eligible for a bilingual pay
9supplement to attract bilingual individuals, to encourage
10present employees to become proficient in languages other than
11English, or to retain qualified bilingual employees.
12    The positions eligible for a bilingual pay supplement
13under this Section, the amount of the supplement, and the
14length of time it remains in effect shall be negotiated by the
15Department of Central Management Services and the appropriate
16collective bargaining representative as determined under the
17Illinois Public Labor Relations Act. The bilingual pay
18supplement may be negotiated for each foreign language
19required for the position by the Department of Central
20Management Services's official classification specification.
21    A bilingual pay supplement shall be processed within 30
22calendar days after the employee presents to the Director, or
23the Director's designee for this purpose, a certification from
24either: (i) the designated testing program process selected by
25the Director; or (ii) an Illinois community college confirming
