| 2 | | AMENDMENT NO. ______. Amend House Bill 3295 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 5. The Civil Administrative Code of Illinois is | 5 | | amended by changing Section 5-715 as follows: | 6 | | (20 ILCS 5/5-715) | 7 | | Sec. 5-715. Expedited licensure for service members and | 8 | | spouses. | 9 | | (a) In this Section, "service member" means any person | 10 | | who, at the time of application under this Section, is an | 11 | | active duty member of the United States Armed Forces or any | 12 | | reserve component of the United States Armed Forces, the Coast | 13 | | Guard, or the National Guard of any state, commonwealth, or | 14 | | territory of the United States or the District of Columbia or | 15 | | whose active duty service concluded within the preceding 2 | 16 | | years before application. |

| 1 | | (a-5) The Department of Financial and Professional | 2 | | Regulation shall within 180 days after January 1, 2020 (the | 3 | | effective date of Public Act 101-240) designate one staff | 4 | | member as the military liaison within the Department of | 5 | | Financial and Professional Regulation to ensure proper | 6 | | enactment of the requirements of this Section. The military | 7 | | liaison's responsibilities shall also include, but are not | 8 | | limited to: (1) the management of all expedited applications | 9 | | to ensure processing within 30 days after receipt of a | 10 | | completed application , including notification of federal | 11 | | assistance programs available to reimburse costs associated | 12 | | with applicable licensing fees and professional credentials | 13 | | for service members and their families pursuant to Section 556 | 14 | | of Public Law 115-91, or any related federal program ; (2) | 15 | | coordination with all military installation military and | 16 | | family support center directors within this State, including | 17 | | virtual, phone, or in-person periodic meetings with each | 18 | | military installation military and family support center; and | 19 | | (3) training by the military liaison to all directors of each | 20 | | division that issues an occupational or professional license | 21 | | to ensure proper application of this Section. At the end of | 22 | | each calendar year, the military liaison shall provide an | 23 | | annual report documenting the expedited licensure program for | 24 | | service members and spouses, and shall deliver that report to | 25 | | the Secretary of Financial and Professional Regulation and the | 26 | | Lieutenant Governor. |

| 1 | | (b) Each director of a department that issues an | 2 | | occupational or professional license is authorized to and | 3 | | shall issue an expedited license to a service member who meets | 4 | | the requirements under this Section. Review and determination | 5 | | of an application for a license issued by the department shall | 6 | | be expedited by the department within 30 days after the date on | 7 | | which the department receives all necessary documentation | 8 | | required for licensure, including any required information | 9 | | from State and federal agencies. An expedited license shall be | 10 | | issued by the department to any service members meeting the | 11 | | application requirements of this Section, regardless of | 12 | | whether the service member currently resides in this State. | 13 | | The service member shall apply to the department on forms | 14 | | provided by the department. An application must include proof | 15 | | that: | 16 | | (1) the applicant is a service member; | 17 | | (2) the applicant holds a valid license in good | 18 | | standing for the occupation or profession issued by | 19 | | another state, commonwealth, possession, or territory of | 20 | | the United States, the District of Columbia, or any | 21 | | foreign jurisdiction; | 22 | | (2.5) the applicant meets the requirements and | 23 | | standards for licensure through endorsement or reciprocity | 24 | | for the occupation or profession for which the applicant | 25 | | is applying; | 26 | | (3) the applicant is assigned to a duty station in |

| 1 | | this State, has established legal residence in this State, | 2 | | or will reside in this State within 6 months after the date | 3 | | of application for licensure; | 4 | | (4) a complete set of the applicant's fingerprints has | 5 | | been submitted to the Illinois State Police for statewide | 6 | | and national criminal history checks, if applicable to the | 7 | | requirements of the department issuing the license; the | 8 | | applicant shall pay the fee to the Illinois State Police | 9 | | or to the fingerprint vendor for electronic fingerprint | 10 | | processing; no temporary occupational or professional | 11 | | license shall be issued to an applicant if the statewide | 12 | | or national criminal history check discloses information | 13 | | that would cause the denial of an application for | 14 | | licensure under any applicable occupational or | 15 | | professional licensing Act; | 16 | | (5) the applicant is not ineligible for licensure | 17 | | pursuant to Section 2105-165 of the Civil Administrative | 18 | | Code of Illinois; | 19 | | (6) the applicant has submitted an application for | 20 | | full licensure; and | 21 | | (7) the applicant has paid the required fee; fees | 22 | | shall not be refundable. | 23 | | (c) Each director of a department that issues an | 24 | | occupational or professional license is authorized to and | 25 | | shall issue an expedited license to the spouse of a service | 26 | | member who meets the requirements under this Section. If the service member | 23 | | or his or her spouse returns to this State, he or she may | 24 | | reactivate the license in accordance with the statutory | 25 | | provisions regulating the profession and any applicable | 26 | | administrative rules. | 1 | | expedited and completed within 30 days after receipt of a | 2 | | completed application to reactivate the license. A license | 3 | | reactivation is only applicable when the valid license for | 4 | | which the first issuance of a license was predicated is still | 5 | | valid and in good standing. An application to reactivate a | 6 | | license must include proof that
the applicant still holds a | 7 | | valid license in good standing for the occupation or | 8 | | profession issued in another State, commonwealth, possession, | 9 | | or territory of the United States, the District of Columbia, | 10 | | or any foreign jurisdiction. | 11 | | (d) All relevant experience of a service member or his or | 12 | | her spouse in the discharge of official duties, including | 13 | | full-time and part-time experience, shall be credited in the | 14 | | calculation of any years of practice in an occupation or | 15 | | profession as may be required under any applicable | 16 | | occupational or professional licensing Act. All relevant | 17 | | training provided by the military and completed by a service | 18 | | member shall be credited to that service member as meeting any | 19 | | training or education requirement under any applicable | 20 | | occupational or professional licensing Act, provided that the | 21 | | training or education is determined by the department to meet | 22 | | the requirements under any applicable Act and is not otherwise | 23 | | contrary to any other licensure requirement. | 24 | | (e) A department may adopt any rules necessary for the | 25 | | implementation and administration of this Section and shall by | 26 | | rule provide for fees for the administration of this Section.
