AMENDMENT TO HOUSE BILL 3295

2    AMENDMENT NO. ______. Amend House Bill 3295 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Civil Administrative Code of Illinois is
5amended by changing Section 5-715 as follows:
 
6    (20 ILCS 5/5-715)
7    Sec. 5-715. Expedited licensure for service members and
8spouses.
9    (a) In this Section, "service member" means any person
10who, at the time of application under this Section, is an
11active duty member of the United States Armed Forces or any
12reserve component of the United States Armed Forces, the Coast
13Guard, or the National Guard of any state, commonwealth, or
14territory of the United States or the District of Columbia or
15whose active duty service concluded within the preceding 2
16years before application.

1    (a-5) The Department of Financial and Professional
2Regulation shall within 180 days after January 1, 2020 (the
3effective date of Public Act 101-240) designate one staff
4member as the military liaison within the Department of
5Financial and Professional Regulation to ensure proper
6enactment of the requirements of this Section. The military
7liaison's responsibilities shall also include, but are not
8limited to: (1) the management of all expedited applications
9to ensure processing within 30 days after receipt of a
10completed application, including notification of federal
11assistance programs available to reimburse costs associated
12with applicable licensing fees and professional credentials
13for service members and their families pursuant to Section 556
14of Public Law 115-91, or any related federal program; (2)
15coordination with all military installation military and
16family support center directors within this State, including
17virtual, phone, or in-person periodic meetings with each
18military installation military and family support center; and
19(3) training by the military liaison to all directors of each
20division that issues an occupational or professional license
21to ensure proper application of this Section. At the end of
22each calendar year, the military liaison shall provide an
23annual report documenting the expedited licensure program for
24service members and spouses, and shall deliver that report to
25the Secretary of Financial and Professional Regulation and the
26Lieutenant Governor.

1    (b) Each director of a department that issues an
2occupational or professional license is authorized to and
3shall issue an expedited license to a service member who meets
4the requirements under this Section. Review and determination
5of an application for a license issued by the department shall
6be expedited by the department within 30 days after the date on
7which the department receives all necessary documentation
8required for licensure, including any required information
9from State and federal agencies. An expedited license shall be
10issued by the department to any service members meeting the
11application requirements of this Section, regardless of
12whether the service member currently resides in this State.
13The service member shall apply to the department on forms
14provided by the department. An application must include proof
15that:
16        (1) the applicant is a service member;
17        (2) the applicant holds a valid license in good
18    standing for the occupation or profession issued by
19    another state, commonwealth, possession, or territory of
20    the United States, the District of Columbia, or any
21    foreign jurisdiction;
22        (2.5) the applicant meets the requirements and
23    standards for licensure through endorsement or reciprocity
24    for the occupation or profession for which the applicant
25    is applying;
26        (3) the applicant is assigned to a duty station in

1    this State, has established legal residence in this State,
2    or will reside in this State within 6 months after the date
3    of application for licensure;
4        (4) a complete set of the applicant's fingerprints has
5    been submitted to the Illinois State Police for statewide
6    and national criminal history checks, if applicable to the
7    requirements of the department issuing the license; the
8    applicant shall pay the fee to the Illinois State Police
9    or to the fingerprint vendor for electronic fingerprint
10    processing; no temporary occupational or professional
11    license shall be issued to an applicant if the statewide
12    or national criminal history check discloses information
13    that would cause the denial of an application for
14    licensure under any applicable occupational or
15    professional licensing Act;
16        (5) the applicant is not ineligible for licensure
17    pursuant to Section 2105-165 of the Civil Administrative
18    Code of Illinois;
19        (6) the applicant has submitted an application for
20    full licensure; and
21        (7) the applicant has paid the required fee; fees
22    shall not be refundable.
23    (c) Each director of a department that issues an
24occupational or professional license is authorized to and
25shall issue an expedited license to the spouse of a service
26member who meets the requirements under this Section. Review

1and determination of an application for a license shall be
2expedited by the department within 30 days after the date on
3which the department receives all necessary documentation
4required for licensure, including information from State and
5federal agencies. An expedited license shall be issued by the
6department to any spouse of a service member meeting the
7application requirements of this Section, regardless of
8whether the spouse or the service member currently resides in
9this State. The spouse of a service member shall apply to the
10department on forms provided by the department. An application
11must include proof that:
12        (1) the applicant is the spouse of a service member;
13        (2) the applicant holds a valid license in good
14    standing for the occupation or profession issued by
15    another state, commonwealth, possession, or territory of
16    the United States, the District of Columbia, or any
17    foreign jurisdiction;
18        (2.5) the applicant meets the requirements and
19    standards for licensure through endorsement or reciprocity
20    for the occupation or profession for which the applicant
21    is applying;
22        (3) the applicant's spouse is assigned to a duty
23    station in this State, has established legal residence in
24    this State, or will reside in this State within 6 months
25    after the date of application for licensure;

19    (c-5) If a service member or his or her spouse relocates
20from this State, he or she shall be provided an opportunity to
21place his or her license in inactive status through
22coordination with the military liaison. If the service member
23or his or her spouse returns to this State, he or she may
24reactivate the license in accordance with the statutory
25provisions regulating the profession and any applicable
26administrative rules. The license reactivation shall be

1expedited and completed within 30 days after receipt of a
2completed application to reactivate the license. A license
3reactivation is only applicable when the valid license for
4which the first issuance of a license was predicated is still
5valid and in good standing. An application to reactivate a
6license must include proof that the applicant still holds a
7valid license in good standing for the occupation or
8profession issued in another State, commonwealth, possession,
9or territory of the United States, the District of Columbia,
10or any foreign jurisdiction.
11    (d) All relevant experience of a service member or his or
12her spouse in the discharge of official duties, including
13full-time and part-time experience, shall be credited in the
14calculation of any years of practice in an occupation or
15profession as may be required under any applicable
16occupational or professional licensing Act. All relevant
17training provided by the military and completed by a service
18member shall be credited to that service member as meeting any
19training or education requirement under any applicable
20occupational or professional licensing Act, provided that the
21training or education is determined by the department to meet
22the requirements under any applicable Act and is not otherwise
23contrary to any other licensure requirement.
24    (e) A department may adopt any rules necessary for the
25implementation and administration of this Section and shall by
26rule provide for fees for the administration of this Section.

3    Section 99. Effective date. This Act takes effect upon
