SYNOPSIS AS INTRODUCED:
 
20 ILCS 5/5-715

    Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. In a provision concerning expedited licensure for service members and spouses, provides that a department shall waive any application, examination, or licensure fee for a service member or the service member's spouse. Removes references to fees.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Civil Administrative Code of Illinois is
5amended by changing Section 5-715 as follows:
 
6    (20 ILCS 5/5-715)
7    Sec. 5-715. Expedited licensure for service members and
8spouses.
9    (a) In this Section, "service member" means any person
10who, at the time of application under this Section, is an
11active duty member of the United States Armed Forces or any
12reserve component of the United States Armed Forces, the Coast
13Guard, or the National Guard of any state, commonwealth, or
14territory of the United States or the District of Columbia or
15whose active duty service concluded within the preceding 2
16years before application.
17    (a-5) The Department of Financial and Professional
18Regulation shall within 180 days after January 1, 2020 (the
19effective date of Public Act 101-240) designate one staff
20member as the military liaison within the Department of
21Financial and Professional Regulation to ensure proper
22enactment of the requirements of this Section. The military
23liaison's responsibilities shall also include, but are not

1limited to: (1) the management of all expedited applications
2to ensure processing within 30 days after receipt of a
3completed application; (2) coordination with all military
4installation military and family support center directors
5within this State, including virtual, phone, or in-person
6periodic meetings with each military installation military and
7family support center; and (3) training by the military
8liaison to all directors of each division that issues an
9occupational or professional license to ensure proper
10application of this Section. At the end of each calendar year,
11the military liaison shall provide an annual report
12documenting the expedited licensure program for service
13members and spouses, and shall deliver that report to the
14Secretary of Financial and Professional Regulation and the
15Lieutenant Governor.
16    (b) Each director of a department that issues an
17occupational or professional license is authorized to and
18shall issue an expedited license to a service member who meets
19the requirements under this Section. Review and determination
20of an application for a license issued by the department shall
21be expedited by the department within 30 days after the date on
22which the department receives all necessary documentation
23required for licensure, including any required information
24from State and federal agencies. An expedited license shall be
25issued by the department to any service members meeting the
26application requirements of this Section, regardless of

1whether the service member currently resides in this State.
2The service member shall apply to the department on forms
3provided by the department. An application must include proof
4that:
5        (1) the applicant is a service member;
6        (2) the applicant holds a valid license in good
7    standing for the occupation or profession issued by
8    another state, commonwealth, possession, or territory of
9    the United States, the District of Columbia, or any
10    foreign jurisdiction;
11        (2.5) the applicant meets the requirements and
12    standards for licensure through endorsement or reciprocity
13    for the occupation or profession for which the applicant
14    is applying;
15        (3) the applicant is assigned to a duty station in
16    this State, has established legal residence in this State,
17    or will reside in this State within 6 months after the date
18    of application for licensure;
19        (4) a complete set of the applicant's fingerprints has
20    been submitted to the Illinois State Police for statewide
21    and national criminal history checks, if applicable to the
22    requirements of the department issuing the license; the
23    applicant shall pay the fee to the Illinois State Police
24    or to the fingerprint vendor for electronic fingerprint
25    processing; no temporary occupational or professional
26    license shall be issued to an applicant if the statewide

1    or national criminal history check discloses information
2    that would cause the denial of an application for
3    licensure under any applicable occupational or
4    professional licensing Act;
5        (5) the applicant is not ineligible for licensure
6    pursuant to Section 2105-165 of the Civil Administrative
7    Code of Illinois; and
8        (6) the applicant has submitted an application for
9    full licensure. ; and
10        (7) the applicant has paid the required fee; fees
11    shall not be refundable.
12    (c) Each director of a department that issues an
13occupational or professional license is authorized to and
14shall issue an expedited license to the spouse of a service
15member who meets the requirements under this Section. Review
16and determination of an application for a license shall be
17expedited by the department within 30 days after the date on
18which the department receives all necessary documentation
19required for licensure, including information from State and
20federal agencies. An expedited license shall be issued by the
21department to any spouse of a service member meeting the
22application requirements of this Section, regardless of
23whether the spouse or the service member currently resides in
24this State. The spouse of a service member shall apply to the
25department on forms provided by the department. An application

1        (1) the applicant is the spouse of a service member;
2        (2) the applicant holds a valid license in good
3    standing for the occupation or profession issued by
4    another state, commonwealth, possession, or territory of
5    the United States, the District of Columbia, or any
6    foreign jurisdiction;
7        (2.5) the applicant meets the requirements and
8    standards for licensure through endorsement or reciprocity
9    for the occupation or profession for which the applicant
10    is applying;
11        (3) the applicant's spouse is assigned to a duty
12    station in this State, has established legal residence in
13    this State, or will reside in this State within 6 months
14    after the date of application for licensure;
15        (4) a complete set of the applicant's fingerprints has
16    been submitted to the Illinois State Police for statewide

1        (5) the applicant is not ineligible for licensure
2    pursuant to Section 2105-165 of the Civil Administrative
3    Code of Illinois; and
4        (6) the applicant has submitted an application for
5    full licensure. ; and
6        (7) the applicant has paid the required fee; fees
7    shall not be refundable.
8    (c-5) If a service member or his or her spouse relocates
9from this State, he or she shall be provided an opportunity to
10place his or her license in inactive status through
11coordination with the military liaison. If the service member
12or his or her spouse returns to this State, he or she may
13reactivate the license in accordance with the statutory
14provisions regulating the profession and any applicable
15administrative rules. The license reactivation shall be
16expedited and completed within 30 days after receipt of a
17completed application to reactivate the license. A license
18reactivation is only applicable when the valid license for
19which the first issuance of a license was predicated is still
20valid and in good standing. An application to reactivate a
21license must include proof that the applicant still holds a
22valid license in good standing for the occupation or
23profession issued in another State, commonwealth, possession,
24or territory of the United States, the District of Columbia,
25or any foreign jurisdiction.
26    (d) All relevant experience of a service member or his or

1her spouse in the discharge of official duties, including
2full-time and part-time experience, shall be credited in the
3calculation of any years of practice in an occupation or
4profession as may be required under any applicable
5occupational or professional licensing Act. All relevant
6training provided by the military and completed by a service
7member shall be credited to that service member as meeting any
8training or education requirement under any applicable
9occupational or professional licensing Act, provided that the
10training or education is determined by the department to meet
11the requirements under any applicable Act and is not otherwise
12contrary to any other licensure requirement.
13    (d-5) A department shall waive any application,
14examination, or licensure fee for a service member or the
15service member's spouse under this Section.
16    (e) A department may adopt any rules necessary for the
17implementation and administration of this Section and shall by
18rule provide for fees for the administration of this Section.
