1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Civil Administrative Code of Illinois is
5amended by changing Section 5-715 as follows:
 
6    (20 ILCS 5/5-715)
7    Sec. 5-715. Expedited licensure for service members and
8spouses.
9    (a) In this Section, "service member" means any person
10who, at the time of application under this Section, is an
11active duty member of the United States Armed Forces or any
12reserve component of the United States Armed Forces, the Coast
13Guard, or the National Guard of any state, commonwealth, or
14territory of the United States or the District of Columbia or
15whose active duty service concluded within the preceding 2
16years before application.
17    (a-5) The Department of Financial and Professional
18Regulation shall within 180 days after January 1, 2020 (the
19effective date of Public Act 101-240) designate one staff
20member as the military liaison within the Department of
21Financial and Professional Regulation to ensure proper
22enactment of the requirements of this Section. The military
23liaison's responsibilities shall also include, but are not

1limited to: (1) the management of all expedited applications
2to ensure processing within 30 days after receipt of a
3completed application, including notification of federal
4assistance programs available to reimburse costs associated
5with applicable licensing fees and professional credentials
6for service members and their families pursuant to Section 556
7of Public Law 115-91, or any related federal program; (2)
8coordination with all military installation military and
9family support center directors within this State, including
10virtual, phone, or in-person periodic meetings with each
11military installation military and family support center; and
12(3) training by the military liaison to all directors of each
13division that issues an occupational or professional license
14to ensure proper application of this Section. At the end of
15each calendar year, the military liaison shall provide an
16annual report documenting the expedited licensure program for
17service members and spouses, and shall deliver that report to
18the Secretary of Financial and Professional Regulation and the
19Lieutenant Governor.
20    (b) Each director of a department that issues an
21occupational or professional license is authorized to and
22shall issue an expedited license to a service member who meets
23the requirements under this Section. Review and determination
24of an application for a license issued by the department shall
25be expedited by the department within 30 days after the date on
26which the department receives all necessary documentation

1required for licensure, including any required information
2from State and federal agencies. An expedited license shall be
3issued by the department to any service members meeting the
4application requirements of this Section, regardless of
5whether the service member currently resides in this State.
6The service member shall apply to the department on forms
7provided by the department. An application must include proof
8that:
9        (1) the applicant is a service member;
10        (2) the applicant holds a valid license in good
11    standing for the occupation or profession issued by
12    another state, commonwealth, possession, or territory of
13    the United States, the District of Columbia, or any
14    foreign jurisdiction;
15        (2.5) the applicant meets the requirements and
16    standards for licensure through endorsement or reciprocity
17    for the occupation or profession for which the applicant
18    is applying;
19        (3) the applicant is assigned to a duty station in
20    this State, has established legal residence in this State,
21    or will reside in this State within 6 months after the date
22    of application for licensure;
23        (4) a complete set of the applicant's fingerprints has
24    been submitted to the Illinois State Police for statewide
25    and national criminal history checks, if applicable to the
26    requirements of the department issuing the license; the

1    applicant shall pay the fee to the Illinois State Police
2    or to the fingerprint vendor for electronic fingerprint
3    processing; no temporary occupational or professional
4    license shall be issued to an applicant if the statewide
5    or national criminal history check discloses information
6    that would cause the denial of an application for
7    licensure under any applicable occupational or
8    professional licensing Act;
9        (5) the applicant is not ineligible for licensure
10    pursuant to Section 2105-165 of the Civil Administrative
11    Code of Illinois;
12        (6) the applicant has submitted an application for
13    full licensure; and
14        (7) the applicant has paid the required fee; fees
15    shall not be refundable.
16    (c) Each director of a department that issues an
17occupational or professional license is authorized to and
18shall issue an expedited license to the spouse of a service
19member who meets the requirements under this Section. Review
20and determination of an application for a license shall be
21expedited by the department within 30 days after the date on
22which the department receives all necessary documentation
23required for licensure, including information from State and
24federal agencies. An expedited license shall be issued by the
25department to any spouse of a service member meeting the
26application requirements of this Section, regardless of

1whether the spouse or the service member currently resides in
2this State. The spouse of a service member shall apply to the
3department on forms provided by the department. An application
4must include proof that:
5        (1) the applicant is the spouse of a service member;
6        (2) the applicant holds a valid license in good
7    standing for the occupation or profession issued by
8    another state, commonwealth, possession, or territory of
9    the United States, the District of Columbia, or any
10    foreign jurisdiction;
11        (2.5) the applicant meets the requirements and
12    standards for licensure through endorsement or reciprocity
13    for the occupation or profession for which the applicant
14    is applying;
15        (3) the applicant's spouse is assigned to a duty
16    station in this State, has established legal residence in
17    this State, or will reside in this State within 6 months
18    after the date of application for licensure;
19        (4) a complete set of the applicant's fingerprints has
20    been submitted to the Illinois State Police for statewide

5        (5) the applicant is not ineligible for licensure
6    pursuant to Section 2105-165 of the Civil Administrative
7    Code of Illinois;
8        (6) the applicant has submitted an application for
9    full licensure; and
10        (7) the applicant has paid the required fee; fees
11    shall not be refundable.
12    (c-5) If a service member or his or her spouse relocates
13from this State, he or she shall be provided an opportunity to
14place his or her license in inactive status through
15coordination with the military liaison. If the service member
16or his or her spouse returns to this State, he or she may
17reactivate the license in accordance with the statutory
18provisions regulating the profession and any applicable
19administrative rules. The license reactivation shall be
20expedited and completed within 30 days after receipt of a
21completed application to reactivate the license. A license
22reactivation is only applicable when the valid license for
23which the first issuance of a license was predicated is still
24valid and in good standing. An application to reactivate a
25license must include proof that the applicant still holds a
26valid license in good standing for the occupation or

1profession issued in another State, commonwealth, possession,
2or territory of the United States, the District of Columbia,
3or any foreign jurisdiction.
4    (d) All relevant experience of a service member or his or
5her spouse in the discharge of official duties, including
6full-time and part-time experience, shall be credited in the
7calculation of any years of practice in an occupation or
8profession as may be required under any applicable
9occupational or professional licensing Act. All relevant
10training provided by the military and completed by a service
11member shall be credited to that service member as meeting any
12training or education requirement under any applicable
13occupational or professional licensing Act, provided that the
14training or education is determined by the department to meet
15the requirements under any applicable Act and is not otherwise
16contrary to any other licensure requirement.
17    (e) A department may adopt any rules necessary for the
18implementation and administration of this Section and shall by
19rule provide for fees for the administration of this Section.

22    Section 99. Effective date. This Act takes effect upon
23becoming law.
