| 2 | | AMENDMENT NO. ______. Amend Senate Bill 3851 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 1. This Act may be referred to as the Supporting | 5 | | Special Needs Students Act. | 6 | | Section 5. The School Code is amended by adding Section | 7 | | 2-3.11e and by changing Section 2-3.25 as follows: | 8 | | (105 ILCS 5/2-3.11e new) | 9 | | Sec. 2-3.11e. Adult students receiving special education | 10 | | services; computation of completion rates. The General | 11 | | Assembly finds that for the purposes of calculating completion | 12 | | rates, certain adult students receiving special education | 13 | | services have completed the requirements for graduation and | 14 | | are eligible for a diploma with their cohort, but the | 15 | | withholding of graduate status at the school level permits a |

| 1 | | continuation of special education services in a population | 2 | | that would otherwise have received a standard diploma and be | 3 | | considered graduates. Relating to the inclusion of certain | 4 | | adult students receiving special education services in the | 5 | | computation of completion rates for purposes of public school | 6 | | accountability, when computing completion rates under Section | 7 | | 10-17a, the State Superintendent of Education shall include | 8 | | students who: | 9 | | (1) are at least 18 years of age as of September 1 of | 10 | | the school year as reported for the fall semester and have | 11 | | satisfied the credit requirements for high school | 12 | | graduation; | 13 | | (2) have not completed their individualized education | 14 | | program in accordance with Section 14-1.02 of this Code | 15 | | and the federal Individuals with Disabilities Education | 16 | | Act (20 U.S.C. Section 1400 et seq.); and | 17 | | (3) are enrolled and receiving individualized | 18 | | education program services.

| 20 | | Sec. 2-3.25. Standards for schools.
| 21 | | (a) To determine for all types of
schools conducted under | 22 | | this Act efficient and adequate standards for the
physical | 23 | | plant, heating, lighting, ventilation, sanitation, safety,
| 24 | | equipment and supplies, instruction and teaching, curriculum, | 25 | | library,
operation, maintenance, administration and |

| 1 | | supervision, and to issue,
refuse to issue or revoke | 2 | | certificates of recognition for schools or school
districts | 3 | | pursuant to standards established hereunder; to determine and
| 4 | | establish efficient and adequate standards for approval of | 5 | | credit for
courses given and conducted by schools outside of | 6 | | the regular school term.
| 7 | | (a-5) On or before July 1, 2021, the State Board of | 8 | | Education must adopt revised social science learning standards | 9 | | that are inclusive and reflective of all individuals in this | 10 | | country. | 11 | | (b) Whenever it appears that a secondary or unit school | 12 | | district may
be unable to offer courses enabling students in | 13 | | grades 9 through 12 to meet
the minimum preparation and | 14 | | admission requirements for public colleges and
universities | 15 | | adopted by the Board of Higher Education, the State Board of
| 16 | | Education shall assist the district in reviewing and analyzing | 17 | | its existing
curriculum with particular reference to the | 18 | | educational needs of all pupils
of the district and the | 19 | | sufficiency of existing and future revenues and
payments | 20 | | available to the district for development of a curriculum | 21 | | which
will provide maximum educational opportunity to pupils | 22 | | of the district.
The review and analysis may consider | 23 | | achievement of this goal not only
through implementation of | 24 | | traditional classroom methods but also through
development of | 25 | | and participation in joint educational programs with other
| 26 | | school districts or institutions of higher education, or |

| 1 | | alternative
programs employing modern technological methods | 2 | | including but not limited
to the use of television, | 3 | | telephones, computers, radio and other electronic
devices.
| 4 | | Beginning with the 2025-2026 school year, in high school | 5 | | districts providing transition services in counties with | 6 | | populations greater than 800,000 but less than 4,000,000 where | 7 | | there are 2 high schools individually serving grades 9 through | 8 | | 12 and where enrollment is less than 2,500 at any school, | 9 | | enrollment shall be balanced across high schools within the | 10 | | district equally, not to exceed a 15% enrollment difference | 11 | | when averaged over the previous 3 consecutive years. | 12 | | (Source: P.A. 101-654, eff. 3-8-21.)".
