Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. Provides that each State building constructed, acquired, or of which more than 50% of the façade is substantially altered shall meet specified standards concerning bird safety. Provides requirements for the Director of Central Management Services in implementing the standards. Specifies that the provisions shall not apply to any acquisition or substantial alteration if the Director, after consideration of multiple options, determines that the use of the required building materials and design features would result in a significant additional cost for the project. Exempts specified buildings from the requirements.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Department of Central Management Services | 5 | | Law of the
Civil Administrative Code of Illinois is amended by | 6 | | adding Section 405-317 as follows: | 7 | | (20 ILCS 405/405-317 new) | 8 | | Sec. 405-317. Bird-safe State buildings. | 9 | | (a) Each State building constructed, acquired, or of which | 10 | | more than 50% of the façade is substantially altered, in the | 11 | | opinion of the Department's Bureau of Property Management, | 12 | | shall meet, as determined by the Director, the following | 13 | | standards: | 14 | | (1) at least 90% of the exposed façade material from | 15 | | ground level to 40 feet: | 16 | | (A) shall not be composed of glass; or | 17 | | (B) shall be composed of glass employing: (i) | 18 | | elements that preclude bird collisions without | 19 | | completely obscuring vision, such as secondary | 20 | | facades, netting, screens, shutters, and exterior | 21 | | shades; (ii) ultraviolet (UV) patterned glass that | 22 | | contains UV-reflective or contrasting patterns that | 23 | | are visible to birds; (iii) patterns on glass designed |

| 1 | | in accordance with a rule that restricts horizontal | 2 | | spaces to less than 2 inches high and vertical spaces | 3 | | to less than 4 inches wide; (iv) opaque, etched, | 4 | | stained, frosted, or translucent glass; or (v) any | 5 | | combination of the methods described in this | 6 | | subparagraph (B); | 7 | | (2) at least 60% of the exposed facade material above | 8 | | 40 feet shall meet the standard described in paragraph | 9 | | (1); | 10 | | (3) there shall not be any transparent passageways or | 11 | | corners; | 12 | | (4) all glass adjacent to atria or courtyards | 13 | | containing water features, plants, and other materials | 14 | | attractive to birds shall meet the standard described in | 15 | | subparagraph (B) of paragraph (1); and | 16 | | (5) outside lighting shall be appropriately shielded | 17 | | and minimized subject to security and other mission | 18 | | related requirements. | 19 | | (b) The Director shall take such actions as may be | 20 | | necessary to ensure that actual bird mortality is monitored at | 21 | | each State building. | 22 | | (c) The Director, where practicable and consistent with | 23 | | security and other mission related requirements, shall reduce | 24 | | exterior building and site lighting for each State building. | 25 | | This subsection (c) shall not apply to buildings in which the | 26 | | Director does not have control of the exterior building and |

In implementing the requirements of this | 2 | | subsection (c), the Director shall make use of automatic | 3 | | control technologies, including timers, photo-sensors, and | 4 | | infrared and motion detectors. | 5 | | (d) In implementing the requirements of this Section, the | 6 | | Director may employ any available methods and strategies that | 7 | | are in accordance with existing effective best practices to | 8 | | reduce bird mortality. | 9 | | (e) The requirements of this Section shall not apply to | 10 | | any acquisition or substantial alteration described in | 11 | | subsection (a) if the Director, after consideration of | 12 | | multiple options, determines that the use of the required | 13 | | building materials and design features would result in a | 14 | | significant additional cost for the project. | 15 | | (f) This Section shall not apply to the following | 16 | | buildings: | 17 | | (1) any building or site listed, or eligible for | 18 | | listing, on the National Register of Historic Places; | 19 | | (2) the Executive Mansion and its grounds; | 20 | | (3) the Illinois Supreme Court Building and its | 21 | | grounds; | 22 | | (4) the Old State Capitol Building in Springfield, | 23 | | Illinois, and its related buildings and grounds; | 24 | | (5) the Lincoln Home in Springfield, Illinois, and its | 25 | | related buildings and grounds; | 26 | | (6) the Abraham Lincoln Presidential Library and |

| 1 | | Museum and its related buildings and grounds; and | 2 | | (7) the Illinois State Capitol Building and its | 3 | | related buildings and grounds.
