AMENDMENT TO HOUSE BILL 247

2    AMENDMENT NO. ______. Amend House Bill 247 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6adding Section 405-317 as follows:
 
7    (20 ILCS 405/405-317 new)
8    Sec. 405-317. Bird-safe State buildings.
9    (a) Each State building constructed, acquired, or of which
10more than 50% of the façade is substantially altered, in the
11opinion of the Department's Bureau of Property Management,
12shall meet, as determined by the Director, the following
13standards:
14        (1) at least 90% of the exposed façade material from
15    ground level to 40 feet:
16            (A) shall not be composed of glass; or

1            (B) shall be composed of glass employing: (i)
2        elements that preclude bird collisions without
3        completely obscuring vision, such as secondary
4        facades, netting, screens, shutters, and exterior
5        shades; (ii) ultraviolet (UV) patterned glass that
6        contains UV-reflective or contrasting patterns that
7        are visible to birds; (iii) patterns on glass designed
8        in accordance with a rule that restricts horizontal
9        spaces to less than 2 inches high and vertical spaces
10        to less than 4 inches wide; (iv) opaque, etched,
11        stained, frosted, or translucent glass; or (v) any
12        combination of the methods described in this
13        subparagraph (B);
14        (2) at least 60% of the exposed facade material above
15    40 feet shall meet the standard described in paragraph
16    (1);
17        (3) there shall not be any transparent passageways or
18    corners;
19        (4) all glass adjacent to atria or courtyards
20    containing water features, plants, and other materials
21    attractive to birds shall meet the standard described in
22    subparagraph (B) of paragraph (1); and
23        (5) outside lighting shall be appropriately shielded
24    and minimized subject to security and other mission
25    related requirements.
26    (b) The Director shall take such actions as may be

1necessary to ensure that actual bird mortality is monitored at
2each State building.
3    (c) The Director, where practicable and consistent with
4security and other mission related requirements, shall reduce
5exterior building and site lighting for each State building.
6This subsection (c) shall not apply to buildings in which the
7Director does not have control of the exterior building and
8site lighting. In implementing the requirements of this
9subsection (c), the Director shall make use of automatic
10control technologies, including timers, photo-sensors, and
11infrared and motion detectors.
12    (d) In implementing the requirements of this Section, the
13Director may employ any available methods and strategies that
14are in accordance with existing effective best practices to
15reduce bird mortality.
16    (e) The requirements of this Section shall not apply to
17any acquisition or substantial alteration described in
18subsection (a) if the Director, after consideration of
19multiple options, determines that the use of the required
20building materials and design features would result in a
21significant additional cost for the project.
22    (f) Any construction which may be required as a result of
23the requirements of this Section shall be under the authority
24of the Capital Development Board in consultation with the
25Department.
26    (g) The requirements of this Section shall only apply to

1State buildings under the management or control of the
2Department, but does not include buildings leased by the
3Department.
4    (h) The requirements of this Section shall not apply to
5any project in the design or construction phase as of the
6effective date of this amendatory Act of the 102nd General
7Assembly.
8    (i) This Section shall not apply to the following
9buildings:
10        (1) any building or site listed, or eligible for
11    listing, on the National Register of Historic Places;
12        (2) the Executive Mansion and its grounds;
13        (3) the Illinois Supreme Court Building and its
14    grounds;
15        (4) the Old State Capitol Building in Springfield,
16    Illinois, and its related buildings and grounds;
17        (5) the Lincoln Home in Springfield, Illinois, and its
18    related buildings and grounds;
19        (6) the Abraham Lincoln Presidential Library and
20    Museum and its related buildings and grounds; and
21        (7) the Illinois State Capitol Building and its
22    related buildings and grounds.".
