AMENDMENT TO SENATE BILL 3002

2    AMENDMENT NO. ______. Amend Senate Bill 3002 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Toll Bridge Act is amended by changing
5Section 7 as follows:
 
6    (605 ILCS 115/7)  (from Ch. 137, par. 7)
7    Sec. 7. Toll rates; electronic toll collection.
8    (a) The county board shall fix the rates of toll, and may
9from time to time, alter and change the same, including by
10establishing a toll rate schedule, setting a maximum toll rate
11that may be adjusted from time to time, or by establishing
12another toll rate structure, and in case of the neglect of the
13owner of the bridge to keep the same in proper repair and safe
14for the crossing of persons and property, may prohibit the
15taking of toll.
16    (b) Notwithstanding any law to the contrary, the county

1board may enter into an agreement establishing a toll rate
2schedule for a period not to exceed 99 years. This amendatory
3Act of the 101st General Assembly is declarative of existing
4law and shall be given retroactive effect.
5    (c) Except as regarding toll bridges or as otherwise
6provided by law, nothing in Public Act 101-398 this amendatory
7Act of the 101st General Assembly shall be construed to
8authorize a county, municipality, local government, or private
9operator to impose a toll upon any public road, street, or
10highway; nor shall any provision of Public Act 101-398 this
11amendatory Act of the 101st General Assembly be construed to
12authorize, pursuant to an intergovernmental agreement or
13otherwise, the imposition of any toll upon any public road,
14street, or highway.
15    (d) The General Assembly finds that electronic toll
16collection systems in Illinois should be standardized to
17promote safety, efficiency, and traveler convenience. If
18electronic toll collection is used on such bridge, the county
19shall cause the configuration of the electronic toll collection
20system to be compatible with the electronic toll collection
21system used by the Illinois State Toll Highway Authority. The
22municipality or private operator may enter into an agreement
23with the Illinois State Toll Highway Authority to provide for
24such compatibility or to have the Authority provide electronic
25toll collection or toll violation enforcement services. Any
26toll bridges in Winnebago County that are in operation and

1collecting tolls on the effective date of this amendatory Act
2of the 97th General Assembly are exempt from the provisions of
3the Act.

5    Section 99. Effective date. This Act takes effect upon
6becoming law.".
