AMENDMENT TO SENATE BILL 730

2     AMENDMENT NO. ______. Amend Senate Bill 730, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Medical Practice Act of 1987 is amended by
6 adding Section 22.7 as follows:
 
7     (5 ILCS 5/22.7 new)
8     Sec. 22.7. Immediate suspension of license or permit for
9 alleged violent or sexual felony against a patient.
10 Notwithstanding any other provision of this Act, a person's
11 license or permit under this Act shall be deemed immediately
12 suspended by operation of law upon the filing of charges in any
13 court against the person, whether by indictment or information,
14 for a violent or sexual felony allegedly committed against his
15 or her patient in the course of the doctor-patient relationship
16 if the patient is either 18 years of age or under or 65 years of

1 age or over. The State's Attorney shall promptly notify the
2 Department of the filing of these charges against a person who
3 is licensed or holds a permit under this Act.
4     Upon receipt of notification from the State's Attorney, the
5 Department shall immediately notify the licensee or permit
6 holder of his or her suspension. This notice shall be deposited
7 in the United States mail, postage prepaid, to the last known
8 address of the licensee or permit holder. The Department must
9 convene a hearing within 15 days after it receives notice of
10 the suspension from the State's Attorney in the same manner as
11 a hearing convened under Section 25 of this Act. The hearing
12 must be completed without appreciable delay.
13     The license or permit shall remain suspended until the
14 first of the following occurs: (1) the Director, without
15 appreciable delay, takes or declines action against the license
16 or permit after the Disciplinary Board has concluded its
17 hearing; (2) the criminal proceedings against the licensee or
18 permit holder have concluded; or (3) 60 days have passed since
19 the initial suspension of the license or permit.
 
20     Section 99. Effective date. This Act takes effect upon
21 becoming law.".
