AMENDMENT TO SENATE BILL 730

2     AMENDMENT NO. ______. Amend Senate Bill 730 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Medical Practice Act of 1987 is amended by
5 adding Section 22.7 as follows:
 
6     (5 ILCS 5/22.7 new)
7     Sec. 22.7. Immediate suspension of license or permit for
8 alleged violent or sexual crime against a patient.
9 Notwithstanding any other provision of this Act, a person's
10 license or permit under this Act shall be deemed immediately
11 suspended by operation of law upon the filing of charges in any
12 court against the person, whether by indictment or information,
13 for a violent or sexual crime allegedly committed against his
14 or her patient in the course of the doctor-patient
15 relationship. The State's Attorney shall promptly inform the
16 Department of the filing of charges against a person who is

1 licensed or holds a permit under this Act for a violent or
2 sexual crime allegedly committed against his or her patient in
3 the course of the doctor-patient relationship. The license or
4 permit shall remain suspended until the Director, without
5 appreciable delay, takes or declines action against the license
6 or permit after the Disciplinary Board has concluded its
7 hearing and sent its recommendations for disciplinary action to
8 the Director, or until the criminal proceedings have concluded,
9 whichever is sooner.
 
10     Section 99. Effective date. This Act takes effect upon
11 becoming law.".
