1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Medical Practice Act of 1987 is amended by
5 adding Section 22.7 as follows:
 
6     (5 ILCS 5/22.7 new)
7     Sec. 22.7. Immediate suspension of license or permit for
8 alleged violent or sexual felony against a patient.
9 Notwithstanding any other provision of this Act, a person's
10 license or permit under this Act shall be deemed immediately
11 suspended by operation of law upon the filing of charges in any
12 court against the person, whether by indictment or information,
13 for a violent or sexual felony allegedly committed against his
14 or her patient in the course of the doctor-patient relationship
15 if the patient is either 18 years of age or under or 65 years of
16 age or over. The State's Attorney shall promptly notify the
17 Department of the filing of these charges against a person who
18 is licensed or holds a permit under this Act.
19     Upon receipt of notification from the State's Attorney, the
20 Department shall immediately notify the licensee or permit
21 holder of his or her suspension. This notice shall be deposited
22 in the United States mail, postage prepaid, to the last known
23 address of the licensee or permit holder. The Department must

1 convene a hearing within 15 days after it receives notice of
2 the suspension from the State's Attorney in the same manner as
3 a hearing convened under Section 25 of this Act. The hearing
4 must be completed without appreciable delay.
5     The license or permit shall remain suspended until the
6 first of the following occurs: (1) the Director, without
7 appreciable delay, takes or declines action against the license
8 or permit after the Disciplinary Board has concluded its
9 hearing; (2) the criminal proceedings against the licensee or
10 permit holder have concluded; or (3) 60 days have passed since
11 the initial suspension of the license or permit.
 
12     Section 99. Effective date. This Act takes effect upon
13 becoming law.
