AN ACT concerning public health.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois is amended by adding Section 2310-655 as follows:

Sec. 2310-655. Training and education program on playground safety.

(a) For the purpose of this Section, "public playground equipment" means equipment intended for use in the play areas of parks, schools, and recreational developments. "Public playground equipment" does not include equipment in restaurants or dwellings.

(b) The Department of Public Health shall develop a training and education program on public playground safety issues. The program may be presented annually and may be available through the Department's website. The Department may inform public health entities within this State of the program. A representative from each affected entity in the State may participate in the program.

The Department shall adopt rules, based on the U.S. Consumer Product Safety Commission's standards, to develop standards for public playground equipment by June 30, 2011. The rules shall include a recommended timeframe by which entities in this State that own or manage playgrounds may meet the guidelines of the rules. The Department may issue a report concerning the status of playgrounds to the General Assembly on or before December 31, 2011.
