AMENDMENT TO HOUSE BILL 29

AMENDMENT NO. ______. Amend House Bill 29 by replacing everything after the enacting clause with the following:

"Section 5. Upon the conveyance of the property described in Section 20 to the State of Illinois, the Director of Natural Resources shall convey to the Toney Watkins Company by quit claim deed all right, title and interest in and to the following described land in Perry County, Illinois.

All of the South 1/2 of Section 1, except; the NW 1/4 of the SW 1/4 of Section 1, the area Northeast of Leopard Road and the area East of Panda Bear Road, The South 1/4 of Section 2, All of Section 11, All of that part of Section 12; West of Panda Bear Road, All of that Part of Section 13; West of Panda Bear Road, except, the SW 1/4, of the SW 1/4, of Section 13. All of Section 14 except; the East 14 acres of the SE 1/4, of the SE 1/4, of Section 14, T.6S., R.4W., of the 3rd P.M., Perry County, Illinois and containing approximately 2,000 acres.

More commonly described as that area of Pyramid State Park North of Perry County Hwy 4 (Pyatt-Cutler Road) and west of Panda Bear Road.

Section 20. In consideration of the conveyance by the State of the property described in Section 5, the Toney Watkins Company shall convey to the State by quit claim deed all right, title and interest in and to the following described land in Perry County, Illinois.

Part of Section 21, 22, 23, and 26, all of Section 27, and part of Section 28, 33, and 34, T.6S., R.2W. of the 3rd P.M., Perry County, Illinois and containing approximately 2,000 acres.

Section 25. Legislative Findings. A determination has been made by the Director of Natural Resources that development opportunities expected to be facilitated by the exchange will result in a minimum private investment of $100,000,000 and approximately 2,500 jobs.

Section 30. The transfers of property under Section 5 and Section 20 of this Act shall be contingent upon:

(1) the Director of Natural Resources making a finding that the properties described in Section 5 and Section 20 of this Act are of equal value, size and attributes; and

(2) the State of Illinois and the Toney Watkins Company entering into a contract under which the Toney Watkins Company agrees to pay a sum of money to the State of Illinois and perform certain activities regarding the remediation and restoration of the property to be transferred to the State of Illinois.

Section 50. The Director of Natural Resources shall obtain a certified copy of the portion of this Act containing the title, the enacting clause, the effective date, and the appropriate Section containing the land description of the property to be transferred or otherwise affected under this Act within 60 days after its effective date and shall record the certified document in the Recorder's Office in the county in which the land is located.

Section 99. Effective date. This Act takes effect upon becoming law.".
