AMENDMENT TO HOUSE BILL 29

2     AMENDMENT NO. ______. Amend House Bill 29 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. Upon the conveyance of the property described
5 in Section 20 to the State of Illinois, the Director of Natural
6 Resources shall convey to the Toney Watkins Company by quit
7 claim deed all right, title and interest in and to the
8 following described land in Perry County, Illinois.
 
9 All of the South 1/2 of Section 1, except; the NW 1/4 of the SW
10 1/4 of Section 1, the area Northeast of Leopard Road and the
11 area East of Panda Bear Road, The South 1/4 of Section 2, All
12 of Section 11, All of that part of Section 12; West of Panda
13 Bear Road, All of that Part of Section 13; West of Panda Bear
14 Road, except, the SW 1/4, of the SW 1/4, of Section 13. All of
15 Section 14 except; the East 14 acres of the SE 1/4, of the SE
16 1/4, of Section 14, T.6S., R.4W., of the 3rd P.M., Perry

1 County, Illinois and containing approximately 2,000 acres.
 
2 More commonly described as that area of Pyramid State Park
3 North of Perry County Hwy 4 (Pyatt-Cutler Road) and west of
4 Panda Bear Road.
 
5     Section 20. In consideration of the conveyance by the State
6 of the property described in Section 5, the Toney Watkins
7 Company shall convey to the State by quit claim deed all right,
8 title and interest in and to the following described land in
9 Perry County, Illinois.
 
10 Part of Section 21, 22, 23, and 26, all of Section 27, and part
11 of Section 28, 33, and 34, T.6S., R.2W. of the 3rd P.M., Perry
12 County, Illinois and containing approximately 2,000 acres.
 
13     Section 25. Legislative Findings. The General Assembly
14 finds that development opportunities expected to be
15 facilitated by the exchange in Section 5 and Section 20 of this
16 Act will result in a minimum private investment of $100,000,000
17 and approximately 2,500 jobs.
 
18     Section 30. The transfers of property under Section 5 and
19 Section 20 of this Act shall be contingent upon:
20         (1) the Director of Natural Resources making a finding
21     that the properties described in Section 5 and Section 20

1     of this Act are of equal value, size and attributes; and
2         (2) the State of Illinois and the Toney Watkins Company
3     entering into a contract under which the Toney Watkins
4     Company agrees to pay a sum of money to the State of
5     Illinois and perform certain activities regarding the
6     remediation and restoration of the property to be
7     transferred to the State of Illinois.
 
8     Section 40. Upon this Act becoming law, conveyance
9 negotiations shall not be initiated by the Director of Natural
10 Resources or the Director's designee until (i) the Department
11 of Natural Resources is in receipt of a bond in the amount 10%
12 of the appraised value of the property to be conveyed and (ii)
13 the submission of completed applications for any and all
14 assistance being sought from the Department of Commerce and
15 Economic Opportunity, the Illinois Finance Authority, and any
16 other federal, State, or local government agencies.
 
17     Section 50. The Director of Natural Resources shall obtain
18 a certified copy of the portion of this Act containing the
19 title, the enacting clause, the effective date, and the
20 appropriate Section containing the land description of the
21 property to be transferred or otherwise affected under this Act
22 within 60 days after its effective date and shall record the
23 certified document in the Recorder's Office in the county in
24 which the land is located.

1     Section 99. Effective date. This Act takes effect upon
2 becoming law.".
