AMENDMENT TO HOUSE BILL 4851

AMENDMENT NO. ______. Amend House Bill 4851 by replacing everything after the enacting clause with the following:

"Section 5. The Adult Education Act is amended by changing Section 1-4 and by adding Section 1-5 as follows:

Sec. 1-4. Except as otherwise provided in Section 1-5 of this Act, on On July 1, 2001, all powers and duties of the State Board of Education and the State Superintendent of Education under this Act and related grants and contracts shall be transferred to the Illinois Community College Board, and references to the State Board of Education or the State Superintendent of Education in this Act or any other law concerning adult and continuing education shall be deemed to refer to the Illinois Community College Board. Except as otherwise provided in Section 1-5 of this Act, all All rules, standards, and procedures adopted by the State Board of Education or the State Superintendent of Education under this Act shall continue in effect as the rules, standards, and procedures of the Illinois Community College Board, until they are modified by the Illinois Community College Board. In order to effect an orderly transition, from July 1, 2000 until July 1, 2001, the State Board of Education and the State Superintendent of Education shall coordinate administration of this Act with the Illinois Community College Board.

Sec. 1-5. Licensed practice nursing and certified nurse assistant programs.

(a) In this Section:

"Program" means a non-degree granting program for licensed practice nursing or certified nurse assistants that has established a joint agreement with a public school for the purpose of providing students career and technical education courses. The program shall have been statutorily authorized to receive funding from the State Board of Education for operation purposes prior to July 1, 2001.

"Student" means a student enrolled in a non-degree granting program for licensed practice nursing or certified nurse assistants.

(b) The State Board of Education shall oversee and fund non-degree granting programs for licensed practice nursing or certified nurse assistants that have established a joint agreement with a public school for the purpose of providing students career and technical education courses. The program's related grants and contracts shall be transferred to the State Board of Education. All programs operating before the effective date of this amendatory Act of the 97th General Assembly shall be approved and continue to receive funding from the State Board of Education.

(c) The State Board of Education shall provide funding for the programs, beginning with Fiscal Year 2013, in the same manner and expenditure that such programs received in Fiscal Year 2012. The State Board of Education may increase funding for the programs. The funding shall be provided from the State Board of Education's Career and Technical Education appropriation and shall not exceed a total of $1 million.

(d) The State Board of Education shall adopt rules to implement this Section.

Section 99. Effective date. This Act takes effect upon becoming law.".
