AMENDMENT TO HOUSE BILL 4851

2    AMENDMENT NO. ______. Amend House Bill 4851 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Adult Education Act is amended by changing
5Section 1-4 and by adding Section 1-5 as follows:
 
6    (105 ILCS 405/1-4)
7    Sec. 1-4. Except as otherwise provided in Section 1-5 of
8this Act, on On July 1, 2001, all powers and duties of the
9State Board of Education and the State Superintendent of
10Education under this Act and related grants and contracts shall
11be transferred to the Illinois Community College Board, and
12references to the State Board of Education or the State
13Superintendent of Education in this Act or any other law
14concerning adult and continuing education shall be deemed to
15refer to the Illinois Community College Board. Except as
16otherwise provided in Section 1-5 of this Act, all All rules,

1standards, and procedures adopted by the State Board of
2Education or the State Superintendent of Education under this
3Act shall continue in effect as the rules, standards, and
4procedures of the Illinois Community College Board, until they
5are modified by the Illinois Community College Board. In order
6to effect an orderly transition, from July 1, 2000 until July
71, 2001, the State Board of Education and the State
8Superintendent of Education shall coordinate administration of
9this Act with the Illinois Community College Board.

11    (105 ILCS 405/1-5 new)
12    Sec. 1-5. Licensed practice nursing and certified nurse
13assistant programs.
14    (a) In this Section:
15    "Program" means a non-degree granting program for licensed
16practice nursing or certified nurse assistants that has
17established a joint agreement with a public school for the
18purpose of providing students career and technical education
19courses. The program shall have been statutorily authorized to
20receive funding from the State Board of Education for operation
21purposes prior to July 1, 2001.
22    "Student" means a student enrolled in a non-degree granting
23program for licensed practice nursing or certified nurse
24assistants.
25    (b) The State Board of Education shall oversee and fund

1non-degree granting programs for licensed practice nursing or
2certified nurse assistants that have established a joint
3agreement with a public school for the purpose of providing
4students career and technical education courses. The program's
5related grants and contracts shall be transferred to the State
6Board of Education. All programs operating before the effective
7date of this amendatory Act of the 97th General Assembly shall
8be approved and continue to receive funding from the State
9Board of Education.
10    (c) The State Board of Education shall provide funding for
11the programs, beginning with Fiscal Year 2013, in the same
12manner and expenditure that such programs received in Fiscal
13Year 2012. The State Board of Education may increase funding
14for the programs. The funding shall be provided from the State
15Board of Education's Career and Technical Education
16appropriation and shall not exceed a total of $1 million.
17    (d) The State Board of Education shall adopt rules to
18implement this Section.
 
19    Section 99. Effective date. This Act takes effect upon
20becoming law.".
