AMENDMENT TO SENATE BILL 2288

AMENDMENT NO. ______. Amend Senate Bill 2288 by replacing everything after the enacting clause with the following:

"Section 5. The Nursing and Advanced Practice Nursing Act is amended by adding Section 10-36 as follows:

(225 ILCS 65/10-36 new)

Sec. 10-36. Visiting registered nurse permit.

(a) The Department may, in its discretion, grant a visiting registered nurse permit to practice nursing as a registered nurse, without examination, provided:

(1) that the applicant maintains an equivalent license to practice as a registered nurse that is active and in good standing in a state or territory of the United States during the period of the temporary visiting registered nurse permit;

(2) that the applicant is a graduate from a National Council of State Boards of Nursing (NCSBN) approved registered nurse program;

(3) that the applicant has received a bona fide employment offer or employment contract to practice as a registered nurse in a sponsoring medical facility as defined by rule; and

(4) that the sponsoring medical facility provides to the Department written documentation identifying the following:

(A) the name of the applicant;

(B) the name of the sponsoring medical facility;

(C) the address of the sponsoring medical facility;

(D) the location address where the employee will be providing services;

(E) the applicant's beginning date of employment;

(F)the medically underserved area to be staffed;

(G) the special need for professional nursing services in the medically underserved area; and

(H) a statement outlining the individuals ability to fulfill this need.

(b) The application for a visiting registered nurse permit shall be made to the Department in writing on forms prescribed by the Department and shall be accompanied by the fee established by rule, which shall not be refundable. The application shall require information that, in the judgment of the Department, will enable the Department to pass on the qualifications of the applicant and the necessity for granting a visiting registered nurse permit.

(c) A visiting registered nurse permit shall be valid for no longer than one year from the date of issuance or until the employment contract or registered nurse employment is terminated, whichever occurs first. The visiting nurse permit shall not be renewed. The medical facility shall be required to notify the Department of any termination or discontinuance of employment.

(d) After receiving a visiting registered nurse permit under this Section, the holder of a visiting registered nurse license shall have one year from the date of issuance of the visiting registered nurse permit to take an examination under this Act that is scheduled to be given before his or her permit expires. The visiting registered nurse permit of an individual who passes the examination shall be valid until he or she applies for and receives a license under this Act. The authority to practice shall immediately terminate, without hearing, upon the denial of licensure by the Department, withdrawal of the application, or upon failure of the examination. Individuals who failed or have previously failed the licensing examinations for registered nurses in any jurisdiction shall not be eligible.

(e) An applicant for a temporary visiting registered nurse permit may be required to appear before the Board of Nursing for an interview prior to, and as a requirement for, the issuance of the original license.

(f) Persons holding a temporary visiting registered nurse permit under this Section shall only practice nursing in the State of Illinois in accordance with their employment contract or their job description as indicated on their employment notification form submitted by the medical facility, clinic, or hospital or any affiliated institution in which the permit holder is employed.

(g) An applicant must submit to criminal background checks in accordance with Section 5-23 of this Act as part of the qualifications for issuance of the permit.

(h) Permits issued under this Section are subject to discipline pursuant to the provisions of Section 10-45 this Act.".
