AMENDMENT TO SENATE BILL 2288

2     AMENDMENT NO. ______. Amend Senate Bill 2288 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Nursing and Advanced Practice Nursing Act
5 is amended by adding Section 10-36 as follows:
 
6     (225 ILCS 65/10-36 new)
7     Sec. 10-36. Visiting registered nurse permit.
8     (a) The Department may, in its discretion, grant a visiting
9 registered nurse permit to practice nursing as a registered
10 nurse, without examination, provided:
11         (1) that the applicant maintains an equivalent license
12     to practice as a registered nurse that is active and in
13     good standing in a state or territory of the United States
14     during the period of the temporary visiting registered
15     nurse permit;
16         (2) that the applicant is a graduate from a National
17     Council of State Boards of Nursing (NCSBN) approved
18     registered nurse program;
19         (3) that the applicant has received a bona fide
20     employment offer or employment contract to practice as a
21     registered nurse in a sponsoring medical facility as
22     defined by rule; and
23         (4) that the sponsoring medical facility provides to
24     the Department written documentation identifying the

1     following:
2             (A) the name of the applicant;
3             (B) the name of the sponsoring medical facility;
4             (C) the address of the sponsoring medical
5         facility;
6             (D) the location address where the employee will be
7         providing services;
8             (E) the applicant's beginning date of employment;
9             (F)the medically underserved area to be staffed;
10             (G) the special need for professional nursing
11         services in the medically underserved area; and
12             (H) a statement outlining the individuals ability
13         to fulfill this need.
14     (b) The application for a visiting registered nurse permit
15 shall be made to the Department in writing on forms prescribed
16 by the Department and shall be accompanied by the fee
17 established by rule, which shall not be refundable. The
18 application shall require information that, in the judgment of
19 the Department, will enable the Department to pass on the
20 qualifications of the applicant and the necessity for granting
21 a visiting registered nurse permit.
22     (c) A visiting registered nurse permit shall be valid for
23 no longer than one year from the date of issuance or until the
24 employment contract or registered nurse employment is
25 terminated, whichever occurs first. The visiting nurse permit
26 shall not be renewed. The medical facility shall be required to
27 notify the Department of any termination or discontinuance of
28 employment.
29     (d) After receiving a visiting registered nurse permit
30 under this Section, the holder of a visiting registered nurse
31 license shall have one year from the date of issuance of the
32 visiting registered nurse permit to take an examination under
33 this Act that is scheduled to be given before his or her permit
34 expires. The visiting registered nurse permit of an individual

1 who passes the examination shall be valid until he or she
2 applies for and receives a license under this Act. The
3 authority to practice shall immediately terminate, without
4 hearing, upon the denial of licensure by the Department,
5 withdrawal of the application, or upon failure of the
6 examination. Individuals who failed or have previously failed
7 the licensing examinations for registered nurses in any
8 jurisdiction shall not be eligible.
9     (e) An applicant for a temporary visiting registered nurse
10 permit may be required to appear before the Board of Nursing
11 for an interview prior to, and as a requirement for, the
12 issuance of the original license.
13     (f) Persons holding a temporary visiting registered nurse
14 permit under this Section shall only practice nursing in the
15 State of Illinois in accordance with their employment contract
16 or their job description as indicated on their employment
17 notification form submitted by the medical facility, clinic, or
18 hospital or any affiliated institution in which the permit
19 holder is employed.
20     (g) An applicant must submit to criminal background checks
21 in accordance with Section 5-23 of this Act as part of the
22 qualifications for issuance of the permit.
23     (h) Permits issued under this Section are subject to
24 discipline pursuant to the provisions of Section 10-45 this
25 Act.".
