SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/10-20.69 new
105 ILCS 5/34-18.61 new

    Amends the School Code. Provides that an applicant for employment with a school district must obtain school board approval at a public hearing prior to being hired if he or she is the relative of a person already employed by the school district and that person would have supervisory authority over the applicant; defines "relative". Provides that if a school board member is a relative of an applicant, he or she may not participate in any employment decisions concerning the applicant, including, but not limited to, decisions regarding hiring, employment status, reappointment, placement, evaluations, salary and salary increases, promotion, tenure, and awards. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Sections
510-20.69 and 34-18.61 as follows:
 
6    (105 ILCS 5/10-20.69 new)
7    Sec. 10-20.69. Hiring employees; nepotism.
8    (a) In this Section, "relative" means a spouse or a child,
9parent, grandparent, sibling, cousin, or spouse of any of those
10persons.
11    (b) An applicant for employment with a school district must
12obtain school board approval at a public hearing prior to being
13hired if he or she is the relative of a person already employed
14by the school district and that person would have supervisory
15authority over the applicant. This subsection applies only to
16applicants hired on or after the effective date of this
17amendatory Act of the 101st General Assembly.
18    (c) If a school board member is a relative of an applicant
19for employment with the school district, the board member may
20not participate in any employment decisions concerning the
21applicant, including, but not limited to, decisions regarding
22hiring, employment status, reappointment, placement,
23evaluations, salary and salary increases, promotion, tenure,
