SYNOPSIS AS INTRODUCED:

New Act

Creates the Local Public Safety Consent Decree Act. Provides that a unit of local government, its officers, or its representatives may not enter into or amend a consent decree that impacts public safety for a period longer than 10 years without the approval of the General Assembly through the adoption of a joint resolution by the General Assembly. Prohibits the General Assembly from approving the entering into or amendment of a consent decree that impacts public safety for a period exceeding 15 years beyond the establishment of the consent decree. Limits home rule powers. Effective immediately.

A BILL FOR

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Local Public Safety Consent Decree Act.

Section 5. Approval of General Assembly.

(a) A unit of local government, its officers, or its representatives may not enter into or amend a consent decree that impacts public safety for a period longer than 10 years without the approval of the General Assembly through the adoption of a joint resolution by the General Assembly.

(b) The General Assembly may not approve the entering into or amendment of a consent decree that impacts public safety for a period exceeding 15 years beyond the establishment of the consent decree.

Section 10. Home rule. A home rule unit may not enter into or amend a consent decree in a manner inconsistent with this Act. This Act is a limitation under subsection (i) of Section 6 of Article VII of the Illinois Constitution on the concurrent exercise by home rule units of powers and functions exercised by the State.

Section 99. Effective date. This Act takes effect upon becoming law.
