SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Local Public Safety Consent Decree Act. Provides that a unit of local government, its officers, or its representatives may not enter into or amend a consent decree that impacts public safety for a period longer than 10 years without the approval of the General Assembly through the adoption of a joint resolution by the General Assembly. Prohibits the General Assembly from approving the entering into or amendment of a consent decree that impacts public safety for a period exceeding 15 years beyond the establishment of the consent decree. Limits home rule powers. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Local
5Public Safety Consent Decree Act.
 
6    Section 5. Approval of General Assembly.
7    (a) A unit of local government, its officers, or its
8representatives may not enter into or amend a consent decree
9that impacts public safety for a period longer than 10 years
10without the approval of the General Assembly through the
11adoption of a joint resolution by the General Assembly.
12    (b) The General Assembly may not approve the entering into
13or amendment of a consent decree that impacts public safety for
14a period exceeding 15 years beyond the establishment of the
15consent decree.
 
16    Section 10. Home rule. A home rule unit may not enter into
17or amend a consent decree in a manner inconsistent with this
18Act. This Act is a limitation under subsection (i) of Section 6
19of Article VII of the Illinois Constitution on the concurrent
20exercise by home rule units of powers and functions exercised
21by the State.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
