92_SB2214enr SB2214 Enrolled LRB9213234LDcsA 1 AN ACT in relation to certain land. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 ARTICLE 1 5 Section 1-5. Upon the payment of the sum of $12,000.00 to 6 the State of Illinois, the rights or easements of access, 7 crossing, light, air and view from, to and over the following 8 described line and FAP Route 12 (US 40) are restored subject 9 to permit requirements of the State of Illinois, Department 10 of Transportation. 11 Parcel No. 800XA86 12 A line in the Southeast Quarter of the Southwest Quarter 13 of Section 14, Township 5 North, Range 3 West of the 14 Third Principal Meridian, Bond County, Illinois, more 15 particularly described as follows: 16 Commencing at a stone at the south quarter corner of said 17 Section 14; thence on an assumed bearing of South 88 18 degrees 45 minutes 55 seconds West on the south line of 19 said Section 14, a distance of 700.38 feet to an iron 20 rod; thence North 01 degree 45 minutes 03 seconds West, 21 576.33 feet to an iron rod on the south right of way line 22 of old U.S. Route 40, also being the Point of Beginning. 23 From said Point of Beginning; thence North 63 degrees 47 24 minutes 57 seconds East on said right of way line, 564.92 25 feet to an iron rod, being the point of terminus. 26 Section 1-10. The Secretary of Transportation shall 24 obtain a certified copy of the portions of this Act 25 containing the title, enacting clause, the effective date, 26 the appropriate Section or Sections containing the land 27 descriptions of the property to be transferred or otherwise 28 affected under this Article, and this Section within 60 days 29 after its effective date and, upon receipt of payment 30 required by the Section or Sections, if any payment is 31 required, shall record the certified document in the 32 Recorder's Office in the county which the land is located. The Department of Natural Resources is 3 authorized to convey an easement to the owner of record of 4 the real estate described in this Section. The easement may 5 be permanent and is to provide access to the real estate and 6 shall not be for other purposes. The easement shall be 7 conveyed in such form and with such conditions as may be 8 determined by the Department to be necessary. The real 9 estate that is the subject of this Section is described as 10 follows: 11 Part of the West Half(W 1/2) of the Northeast Quarter (NE 12 1/4) of Section Numbered Two (2), Township Numbered Eight (8) 13 North, Range Numbered Six (6) West of the Third Principal 14 Meridian, described in detail as follows; 15 Commencing at an iron pin at the Northwest corner of the 16 Northeast Quarter (NE 1/4) of said Section Numbered Two (2); 17 Thence South 0 degree 29 minutes 30 seconds West along 18 the Quarter Section line one hundred twenty-six and sixty-one 19 hundredths (126.61) feet to the point of beginning. The Director of Natural Resources shall 2 obtain a certified copy of the portions of this Act 3 containing the title, enacting clause, the effective date, 4 the appropriate Section or Sections containing the land 5 descriptions of the property to be transferred or otherwise 6 affected under this Article, and this Section within 60 days 7 after its effective date and, upon receipt of payment 8 required by the Section or Sections, if any payment is 9 required, shall record the certified document in the 10 Recorder's Office in the county in which the land is located. 11 ARTICLE 3 12 Section 3-5. The Secretary of Human Services and the 3 Kankakee River Valley Forest Preserve District must enter 4 into the intergovernmental agreement prior to the transfer of 5 said land. If the Kankakee River Valley Forest Preserve 6 District breaches a condition of the intergovernmental 7 agreement, then the State of Illinois shall have the right of 8 entry upon said land upon written demand submitted by the 9 Secretary of Human Services or his or her successor on behalf 10 of the State of Illinois and upon return of the purchase 11 price. 12 Section 3-900. The Secretary of Human Services shall 13 obtain a certified copy of the portions of this Act 14 containing the title, the enacting clause, the effective 15 date, the appropriate Section or Sections containing the land 16 descriptions of the property to be transferred or otherwise 17 affected, Section 3-10, and this Section within 60 days after 18 its effective date and, upon receipt of payment required by 19 the Section or Sections, if any payment is required, shall 20 record the certified document in the Recorder's Office in the 21 county in which the land is located. 22 ARTICLE 4 23 Section 4-5. The Director of Natural Resources, on 29 behalf of the State of Illinois, is authorized to execute and 30 deliver to Harold Haile, his successors and assigns, for and 31 in consideration of $3,460.00 paid to said Department, a quit 32 claim deed to the following described real property, to wit: 33 Parcel 2: A strip of land 160 feet in width extending SB2214 Enrolled -28- LRB9213234LDcsA 1 over and across the Southwest Quarter of the Northwest 2 Quarter of Section 11, running in a Southeasterly 3 direction, the South line of same being the South line of 4 the existing township road right of way, said 160 foot 5 strip being more particularly described as follows: 6 Beginning at a point being 627 feet South of the 7 Northwest corner of the Southwest Quarter of the 8 Northwest Quarter of Section 11, said point being on the 9 South line of the existing township road right of way; 10 thence running South 55 degrees 4 minutes East along said 11 South line of the township road right of way, a distance 12 of 1193.93 feet to a point on the South line of the 13 Southwest Quarter of the Northwest Quarter of said 14 Section 11; thence East, a distance of 279.42 feet to a 15 point; thence running North 55 degrees 4 minutes West to 16 the West line of the Southwest Quarter of the Northwest 17 Quarter of said Section 11 at a point being 195.16 feet 18 North of the point of beginning; thence South, a distance 19 of 195.16 feet to the point of beginning; in Township 4 20 South, Range 4 East of the Third Principal Meridian, all 21 situated in JEFFERSON COUNTY, ILLINOIS, EXCEPT all 22 minerals and all rights and easements in favor of said 23 mineral estate; 24 ALSO, 25 Parcel 2 minerals: All coal within 150 feet of the 26 surface as to the following: A strip of land 160 feet in 27 width extending over and across the Southwest Quarter of 28 the Northwest Quarter of Section 11, running in a 29 Southeasterly direction, the South line of same being the 30 South line of the existing township road right of way, 31 said 160 foot strip being more particularly described as 32 follows: Beginning at a point being 627 feet South of the 33 Northwest corner of the Southwest Quarter of the 34 Northwest Quarter of Section 11, said point being on the SB2214 Enrolled -29- LRB9213234LDcsA 1 South line of the existing township road right of way; 2 thence running South 55 degrees 4 minutes East along said 3 South line of the township road right of way, a distance 4 of 1193.93 feet to a point on the South line of the 5 Southwest Quarter of the Northwest Quarter of said 6 Section 11; thence East, a distance of 279.42 feet to a 7 point; thence running North 55 degrees 4 minutes West to 8 the West line of the Southwest Quarter of the Northwest 9 quarter of said Section 11 at a point being 195.16 feet 10 North of the point of beginning; thence South a distance 11 of 195.16 feet to the point of beginning; in Township 4 12 South, Range 4 East of the Third Principal Meridian, all 13 situated in JEFFERSON COUNTY, ILLINOIS. 14 Section 30-900. The Director of Natural Resources shall 15 obtain a certified copy of the portions of this Act 16 containing the title, enacting clause, the effective date, 17 the appropriate Section or Sections containing the land 18 descriptions of the property to be transferred or otherwise 19 affected under this Article, and this Section within 60 days 20 after its effective date and, upon receipt of payment 21 required by the Section or Sections, if any payment is 22 required, shall record the certified document in the 23 Recorder's Office in the county in which the land is located. 24 ARTICLE 999 25 Section 999-5. Effective date. This Act takes effect 26 upon becoming law.
