1 An Act to implement the federal Worker Adjustment and
2 Retraining Notification Act.
3 WHEREAS, workers facing plant closings or mass layoffs
4 can benefit from retraining and readjustment services
5 provided before their termination; and
6 WHEREAS, the Department of Employment Security
7 coordinates and provides retraining and readjustment
8 services, including outreach to possible new employers,
9 placement services, and pre-layoff workshops to inform
10 workers about services available to ease the transition to
11 new employment, to employees facing termination; and
12 WHEREAS, the federal Worker Adjustment and Retraining
13 Notification Act (WARN) requires certain employers to provide
14 notice of impending plant closings or mass layoffs to the
15 entity designated by the State of Illinois to provide rapid
16 response activities under the federal Workforce Investment
17 Act; and
18 WHEREAS, the State of Illinois has designated the
19 Department of Employment Security, Job Training Division as
20 the entity that provides rapid response activities under the
21 federal Workforce Investment Act; and
22 WHEREAS, employers at times fail to provide notice to the
23 Department of Employment Security, Job Training Division as
24 required by the WARN Act; therefore
25 Be it enacted by the People of the State of Illinois,
26 represented in the General Assembly:
27 Section 5. The Department of Employment Security Law of
28 the Civil Administrative Code of Illinois is amended by
29 adding Section 1005-60 as follows:

2 Sec. 1005-60. Compliance with WARN. The Department must
3 monitor and investigate compliance with the federal Worker
4 Adjustment and Retraining Notification Act by private
5 entities in Illinois. In particular, the Department must
6 monitor and investigate whether those private entities are
7 complying with the requirement under that Act that they
8 notify the entity designated by the State of Illinois to
9 provide rapid response activities under the federal Workforce
10 Investment Act in the event of a mass layoff or plant
11 closing.
12 Section 99. Effective date. This Act takes effect upon
13 becoming law.
