 1        AN ACT concerning disaster service volunteers.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The Disaster Service Volunteer Leave Act is
 5    amended by changing Section 3 as follows:

 6        (5 ILCS 335/3) (from Ch. 127, par. 4053)
 7        Sec. 3.  Disaster Service Volunteer Leave.   An  employee
 8    of  a  State  agency  who  is  a  certified  disaster service
 9    volunteer of the  American  Red  Cross  or  assigned  to  the
10    Illinois  Emergency  Management Agency in accordance with the
11    Illinois Emergency Management Act, the  Emergency  Management
12    Assistance  Compact  Act,  or other applicable administrative
13    rules may be granted leave from his work  with  pay  for  not
14    more   than  20  working  days  in  any  12-month  period  to
15    participate in specialized disaster relief services  for  the
16    American  Red  Cross or for the Illinois Emergency Management
17    Agency, as the case may be, upon the request of the  American
18    Red Cross or the Illinois Emergency Management Agency for the
19    services  of  that  employee  and  upon  the approval of that
20    employee's agency, without loss of seniority,  pay,  vacation
21    time,  compensatory  time, personal days, sick time or earned
22    overtime  accumulation.   The  agency  shall  compensate   an
23    employee granted leave under this Section at his regular rate
24    of pay for those regular work hours during which the employee
25    is  absent  from  his  work.  For purposes of assessing State
26    disaster response needs, requests made pursuant to  this  Act
27    for   services  out-of-state  shall  be  coordinated  by  the
28    American Red Cross  and  the  Illinois  Emergency  Management
29    Agency   through  the  Illinois  State  Emergency  Operations
30    Center.  The Illinois Emergency Management Agency may consult
31    with the Department of Central Management Services  on  leave

 1    issues  that  could  impact  the operations of State agencies
 2    under the Governor's jurisdiction. Leave under this Act shall
 3    not be unreasonably denied for services related to a disaster
 4    within the United States or its territories be  granted  only
 5    for services related to a disaster occurring within the State
 6    of Illinois.

 8        Section   10.   The  Local  Government  Disaster  Service
 9    Volunteer Act is amended by changing Section 15 as follows:

11        Sec. 15.  Local  government  disaster  service  volunteer
12    leave.  An  employee  of  a  local  agency who is a certified
13    disaster service volunteer  of  the  American  Red  Cross  or
14    assigned  to  the  Illinois  Emergency  Management  Agency in
15    accordance with the Illinois Emergency  Management  Act,  the
16    Emergency   Management   Assistance  Compact  Act,  or  other
17    applicable administrative rules may be granted leave from his
18    or her work with pay for not more than 20 working days in any
19    12-month period to participate in specialized disaster relief
20    services for the American  Red  Cross  or  for  the  Illinois
21    Emergency  Management  Agency,  as  the case may be, upon the
22    request of the American Red Cross or the  Illinois  Emergency
23    Management  Agency for the services of that employee and upon
24    the approval of  that  employee's  agency,  without  loss  of
25    seniority,  pay,  vacation  time, compensatory time, personal
26    days, sick time, or earned overtime accumulation. The  agency

 3        Section  99.  Effective date.  This Act takes effect July
 4    1, 2002.
