 1        AN ACT regarding schools.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The School Code is amended by adding Sections
 5    10-28 and 34-18.22 as follows:

 6        (105 ILCS 5/10-28 new)
 7        Sec.   10-28.  Sharing   information   on   school  lunch
 8    applicants.  Each school board shall agree  in  writing  with
 9    the  Department  of  Public  Aid  (as  the  State agency that
10    administers the State Medical Assistance Program as  provided
11    in Title XIX of the federal Social Security Act and the State
12    Children's  Health Insurance Program as provided in Title XXI
13    of the  federal  Social  Security  Act)  to  share  with  the
14    Department  of  Public Aid information on applicants for free
15    or reduced-price lunches.  This sharing of information  shall
16    be  for  the sole purpose of helping the Department of Public
17    Aid  identify  and  enroll  children  in  the  State  Medical
18    Assistance Program or the State Children's  Health  Insurance
19    Program    or    both    as    allowed    under   42   U.S.C.
20    1758(b)(2)(C)(iii)(IV) and under the restrictions  set  forth
21    in 42 U.S.C. 1758(b)(2)(C)(vi) and (vii).

23        Sec.   34-18.22.  Sharing  information  on  school  lunch
24    applicants.  The  board  shall  agree  in  writing  with  the
25    Department  of  Public  Aid  (as  the   State   agency   that
26    administers  the State Medical Assistance Program as provided
27    in Title XIX of the federal Social Security Act and the State
28    Children's Health Insurance Program as provided in Title  XXI
29    of  the  federal  Social  Security  Act)  to  share  with the
30    Department of Public Aid information on applicants  for  free

 1    or  reduced-price lunches.  This sharing of information shall
 2    be for the sole purpose of helping the Department  of  Public
 3    Aid  identify  and  enroll  children  in  the  State  Medical
 4    Assistance  Program  or the State Children's Health Insurance
 5    Program   or   both    as    allowed    under    42    U.S.C.
 6    1758(b)(2)(C)(iii)(IV)  and  under the restrictions set forth
 7    in 42 U.S.C. 1758(b)(2)(C)(vi) and (vii).

 8        Section 10.  The School Breakfast and Lunch  Program  Act
 9    is amended by adding Section 10 as follows:

10        (105 ILCS 125/10 new)
11        Sec. 10.  Sharing information on school lunch applicants.
12    Each   private   school  that  receives  funds  for  free  or
13    reduced-price lunches under this Act shall agree  in  writing
14    with  the  Department of Public Aid (as the State agency that
15    administers the State Medical Assistance Program as  provided
16    in Title XIX of the federal Social Security Act and the State
17    Children's  Health Insurance Program as provided in Title XXI
18    of the  federal  Social  Security  Act)  to  share  with  the
19    Department  of  Public Aid information on applicants for free
20    or reduced-price lunches.  This sharing of information  shall
21    be  for  the sole purpose of helping the Department of Public
22    Aid  identify  and  enroll  children  in  the  State  Medical
23    Assistance Program or the State Children's  Health  Insurance
24    Program    or    both    as    allowed    under   42   U.S.C.
25    1758(b)(2)(C)(iii)(IV) and under the restrictions  set  forth
26    in 42 U.S.C. 1758(b)(2)(C)(vi) and (vii).  The State Board of
27    Education   may   not   provide  reimbursement  for  free  or
28    reduced-price lunches to any private  school  that  does  not
29    share  information  with  the Department of Public Aid to the
30    extent allowed and under the restrictions in the federal law.

31        Section 99.  Effective date.  This Act  takes  effect  on
