 1                     AMENDMENT TO HOUSE BILL 279

 2        AMENDMENT NO.     .  Amend House Bill 279, AS AMENDED, by
 3    replacing everything  after  the  enacting  clause  with  the
 4    following:

 5        "Section   90.   The  Emergency  Medical  Services  (EMS)
 6    Systems Act is amended by changing Section 3.70 as follows:

 7        (210 ILCS 50/3.70)
 8        Sec. 3.70.  Emergency Medical Dispatcher.
 9        (a)  "Emergency  Medical  Dispatcher"  means a person who
10    has successfully completed a dispatching  course  meeting  or
11    exceeding  the  national  curriculum  of  the  United  States
12    Department of Transportation in accordance with rules adopted
13    by  the  Department  pursuant  to this Act, who accepts calls
14    from the public for emergency medical services and dispatches
15    designated emergency medical services personnel and vehicles.
16    The Emergency Medical  Dispatcher  may  or  may  not  provide
17    prearrival   medical  instructions  to  the  caller,  at  the
18    discretion of the entity or agency  that  employs  him.  Such
19    instructions  shall  be provided in accordance with protocols
20    established by the EMS Medical Director of the EMS System  in
21    which  the  dispatcher  operates.  If the dispatcher operates
22    under the authority of an Emergency  Telephone  System  Board

 1    established  under  the  Emergency  Telephone System Act, the
 2    protocols shall be established by such Board in  consultation
 3    with  the  EMS  Medical  Director.   Persons who have already
 4    completed  a  course  of  instruction  in  emergency  medical
 5    dispatch based on, equivalent to or  exceeding  the  national
 6    curriculum of the United States Department of Transportation,
 7    or   as  otherwise  approved  by  the  Department,  shall  be
 8    considered Emergency Medical  Dispatchers  on  the  effective
 9    date of this amendatory Act.
10        (b)  The   Department   shall   have  the  authority  and
11    responsibility to:
12             (1)  Prescribe education  and  continuing  education
13        requirements  for the Emergency Medical Dispatcher, which
14        meet or exceed the  national  curriculum  of  the  United
15        States   Department   of  Transportation,  through  rules
16        adopted pursuant to this Act;
17             (2)  Require the  Emergency  Medical  Dispatcher  to
18        notify  the  Department  of the EMS System(s) in which he
19        operates;
20             (3)  Require the Emergency  Medical  Dispatcher  who
21        provides  prearrival  instructions  to  callers to comply
22        with the protocols for such instructions  established  by
23        the  EMS  Medical  Director(s)  and  Emergency  Telephone
24        System Board or Boards, or in the absence of an Emergency
25        Telephone  System Board or Boards the governmental agency
26        performing the duties of an  Emergency  Telephone  System
27        Board or Boards, of the EMS System or Systems in which he
28        operates;
29             (4)  Require  the  Emergency  Medical  Dispatcher to
30        keep the Department currently informed as to  the  entity
31        or agency that employs or supervises his activities as an
32        Emergency Medical Dispatcher;
33             (5)  (Blank)  Establish  a  mechanism for phasing in
34        the Emergency  Medical  Dispatcher  requirements  over  a

 1        five-year period;
 2             (5.5)  Establish     an    annual    recertification
 3        requirement  for  Emergency  Medical   Dispatchers   that
 4        requires  at  least 12 hours of continuing education each
 5        year; and
 6             (6)  Establish criteria  for  modifying  or  waiving
 7        Emergency  Medical  Dispatcher  requirements based on (i)
 8        the scope and frequency of dispatch  activities  and  the
 9        dispatcher's  access  to  training  or  (ii)  whether the
10        previously-attended dispatcher  training  program  merits
11        automatic recertification for the dispatcher.
