91_HB1977 LRB9101066BBdv 1 AN ACT to amend the Unemployment Insurance Act by 2 changing Section 237. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Unemployment Insurance Act is amended by 6 changing Section 237 as follows: 7 (820 ILCS 405/237) (from Ch. 48, par. 347) 8 Sec. 237. (a) "Base period"means (1) the four9consecutive calendar quarters ended on the preceding December1031, for benefit years beginning in May, June, or July; (2)11the four consecutive calendar quarters ended on the preceding12March 31, for benefit years beginning in August, September,13or October; (3) the four consecutive calendar quarters ended14on the preceding June 30, for benefit years beginning in15November, December, or January; and (4) the four consecutive16calendar quarters ended on the preceding September 30, for17benefit years beginning in February, March, or April. This18paragraph shall apply to benefit years beginning prior to19November 1, 1981. For each benefit year beginning on or after20November 1, 1981, "base period"means the first four of the 21 last five completed calendar quarters immediately preceding 22 the benefit year. Further, any wages that had previously been 23 used to establish a valid claim under Section 242 and with 24 respect to which benefits have been paid shall not be 25 included in the base period provided for in this subsection. 26 (b) Notwithstanding subsection (a)the foregoing27paragraph, with respect to any benefit year beginning on or28after January 1, 1988, an individual, who has been awarded 29 temporary total disability under any workers' compensation 30 act or any occupational diseases act and does not qualify for 31 the maximum weekly benefit amount under Section 401 because -2- LRB9101066BBdv 1 he was unemployed and awarded temporary total disability 2 during the base period determined in accordance with 3 subsection (a)the preceding paragraph, shall have his weekly 4 benefit amount, if it is greater than the weekly benefit 5 amount determined in accordance with subsection (a)the6preceding paragraph, determined by the base period of a 7 benefit year which began on the date of the beginning of the 8 first week for which he was awarded temporary total 9 disability under any workers' compensation act or 10 occupational diseases act, provided, however, that such base 11 period shall not begin more than one year prior to the 12 individual's base period as determined under subsection (a) 13the preceding paragraph. Further, any wages which had 14 previously been used to establish a valid claim pursuant to 15 Section 242 and with respect to which benefits have been paid 16 shall not be included in the base period provided for in this 17 subsectionparagraph. 18 (c) With respect to any benefit year beginning on or 19 after January 1, 2000, for an individual who is ineligible to 20 receive benefits under this Act by reason of the provisions 21 of paragraph (E) of Section 500 during the base periods 22 determined in accordance with subsections (a) and (b), "base 23 period" means the last 4 completed calendar quarters 24 immediately preceding the benefit year. 25 (d) Notwithstanding the foregoing provisions of this 26 Section, "base period" means the base period as defined in 27 the unemployment compensation law of any State under which 28 benefits are payable to an individual on the basis of a 29 combination of his wages pursuant to an arrangement described 30 in Section 2700 F. 31 (Source: P.A. 85-956; 85-1009.)
