 1        AN  ACT  to  amend  the  Good  Samaritan  Act by changing
 2    Section 12.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The Good Samaritan Act is amended by changing
 6    Section 12 as follows:

 7        (745 ILCS 49/12)
 8        Sec.  12.  Use  of  an  automatic external defibrillator;
 9    exemption from civil liability for emergency care.
10        (a)  Any  person  who  has  successfully  completed   the
11    training  requirements of a course in basic emergency care of
12    a person in cardiac arrest that:
13             (i)  included training in the operation and  use  of
14        an automatic external defibrillator; and
15             (ii)  was conducted in accordance with the standards
16        of the American Heart Association,
17    and  who,  in  good  faith,  not  for  compensation,  renders
18    emergency  medical  care  involving  the  use of an automatic
19    external  defibrillator  in  accordance  with  his   or   her
20    training  is  not liable for any civil damages as a result of
21    any  act  or  omission,  except  for   willful   and   wanton
22    misconduct, by that person in rendering that care.
23        (b)  A person or entity that owns, occupies, or manages a
24    building  or  portion of a building in which a person meeting
25    the criteria set forth in subsection  (a)  renders  emergency
26    medical  care  involving  the  use  of  an automatic external
27    defibrillator in accordance with subsection (a) is not liable
28    for any civil damages as a result of  any  act  or  omission,
29    except  for  willful  and  wanton  misconduct,  by the person
30    rendering that care.
