Amend Senate Bill 1372 by replacing 3 the title with the following: 4 "AN ACT to amend the Illinois Public Aid Code by changing 5 Section 5-5.01a."; and 6 by replacing everything after the enacting clause with the 7 following: 8 "Section 5. The Illinois Public Aid Code is amended by 9 changing Section 5-5.01a as follows: 10 (305 ILCS 5/5-5.01a) 11 Sec. 5-5.01a. Supportive living facilities demonstration 12 project. For the purpose of studying alternative settings 13 for long term care, the Department may establish and provide 14 oversight for a demonstration project to determine the 15 viability of supportive living facilities that seek to 16 promote resident independence, dignity, respect, and 17 well-being in the most cost-effective manner. 18 A supportive living facility is either a free-standing 19 facility or a distinct physical and operational entity within 20 a nursing facility. A supportive living facility integrates 21 housing with health, personal care, and supportive services -2- LRB9010778SMdvam01 1 and is a designated setting that offers residents their own 2 separate, private, and distinct living units. 3 Demonstration sites shall be selected by the Department 4 based upon criteria that may include the need for services in 5 a geographic area, the availability of funding, and the 6 site's ability to meet the standards. 7 The Department may adopt rules to implement this Section. 8 Rules that establish or modify the services, standards, and 9 conditions for participation in the demonstration project 10 shall be adopted by the Department in consultation with the 11 Department on Aging, the Department of Rehabilitation 12 Services, and the Department of Mental Health and 13 Developmental Disabilities (or their successor agencies). 14 Facilities or distinct parts of facilities which are 15 selected as supportive living facilities and are in good 16 standing with the Department's rules are exempt from the 17 provisions of the Nursing Home Care Act and the Illinois 18 Health Facilities Planning Act. 19 The Department shall report its findings and 20 recommendations based on the demonstration project to the 21 General Assembly on or before January 1, 2001. 22 (Source: P.A. 89-499, eff. 6-28-96.) 23 Section 99. Effective date. This Act takes effect upon 24 becoming law.".
