LRB9002932DPks SB859 Engrossed LRB9002932DPks 1 AN ACT to amend the Barber, Cosmetology, Esthetics, and 2 Nail Technology Act of 1985 by changing Section 1-11. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Barber, Cosmetology, Esthetics, and Nail 6 Technology Act of 1985 is amended by changing Section 1-11 as 7 follows: 8 (225 ILCS 410/1-11) (from Ch. 111, par. 1701-11) 9 Sec. 1-11. Exceptions to Act. 10 (a) Nothing in this Act shall be construed to apply to 11 the educational activities conducted in connection with any 12 monthly, annual or other special educational program of any 13 bona fide association of licensed cosmetologists, 14 estheticians, nail technicians, or barbers, or licensed 15 cosmetology, esthetics, nail technology, or barber schools 16 from which the general public is excluded. 17 (b) Nothing in this Act shall be construed to apply to 18 the activities and services of registered nurses or licensed 19 practical nurses, as defined in the Illinois Nursing Act of 20 1987, or to personal care or health care services provided by 21 individuals in the performance of their duties as employed or 22 authorized by facilities or programs licensed or certified by 23 State agencies. As used in this subsection, "personal care" 24 means assistance with meals, dressing, movement, bathing, or 25 other personal needs, or maintenance or general supervision 26 and oversight of the physical and mental well-being of an 27 individual who is incapable of maintaining a private, 28 independent residence or who is incapable of managing his or 29 her person whether or not a guardian has been appointed for 30 that individual. The definition of "personal care" as used in 31 this subsection shall not otherwise be construed to negate SB859 Engrossed -2- LRB9002932DPks 1 the requirements of this Act or its rules. 2 (c) Nothing in this Act shall be deemed to require 3 licensure of individuals employed by the motion picture, 4 film, television, stage play or related industry for the 5 purpose of providing cosmetology or esthetics services to 6 actors of that industry while engaged in the practice of 7 cosmetology or esthetics as a part of that person's 8 employment. 9 (Source: P.A. 89-387, eff. 1-1-96.) 10 Section 99. Effective date. This Act takes effect upon 11 becoming law.
