Amend Senate Bill 852 on page 3, 3 line 23, by deleting "Fifty percent of the members"; and 4 on page 3, line 24, by replacing "appointed and confirmed" 5 with "Nine members"; and 6 on page 12, by replacing lines 5 through 32 with the 7 following: 8 "Section 15. The Head and Spinal Cord Injury Act is 9 amended by changing Section 6 as follows: 10 (410 ILCS 515/6) (from Ch. 111 1/2, par. 7856) 11 (Text of Section taking effect July 1, 1997) 12 Sec. 6. (a) There is hereby created the Advisory Council 13 on Spinal Cord and Head Injuries within the Department of 14 Human Services. The Council shall consist of 29 members,.15Two members shall be appointed by each of the Speaker of the16House of Representatives, the President of the Senate, the17Minority Leader of the House of Representatives and the18Minority Leader of the Senate The remaining 21 members shall19beappointed by the Governor with the advice and consent of 20 the Senate.These 21 members shall determine by lot which 721are to have one-year terms, which 7 are to have 2-year terms,-2- LRB9000351MWpcam03 1and which 7 are to have 3-year terms. Thereafter, the2successors to each of These 21Members shall serve 3-year 3 terms and until their successors are appointed by the 4 Governor with the advice and consent of the Senate. The 5 members appointed by the Governor shall include 2 6 neurosurgeons, 2 orthopedic surgeons, 2 rehabilitation 7 specialists, one of whom shall be a registered nurse, 4 8 persons with head injuries or family members of persons with 9 head injuries, 4 persons with spinal cord injuries or family 10 members of persons with spinal cord injuries, a 11 representative of an Illinois college or university, and a 12 representative from health institutions or private industry. 13 These members shall not serve more than 2 consecutive 3-year 14 terms. The Governor shall appoint one individual from each 15 of the following entities to the Council as ex-officio 16 members: the unit of the Department of Human Services that is 17 responsible for the administration of the vocational 18 rehabilitation program, another unit within the Department of 19 Human Services that provides services for individuals with 20 disabilities, the State Board of Education, the Department of 21 Public Health, the Department of Insurance, the Department of 22 Public Aid, the Division of Specialized Care for Children of 23 the University of Illinois, the Statewide Independent Living 24 Council, and the State Rehabilitation Advisory Council. 25 Ex-officio members are not subject to limit of 2 consecutive 26 3-year terms.and a representative of each of the following:27(1) an Illinois college or university, (2) health28institutions or private industry, (3) the Department of Human29Services , (4) the State Board of Education, (5) the30Department of Public Health, (6)the Department of Insurance,31and (7) the Department of Public Aid.The appointment of 32 individuals representing State agencies shall be conditioned 33 on their continued employment with their respective agencies. 34 (b) From funds appropriated for such purpose, the -3- LRB9000351MWpcam03 1 Department of Human Services shall provide to the Council the 2 necessary staff and expenses to carry out the duties and 3 responsibilities assigned by the Council. Such staff shall 4 consist of a director and other support staff. 5 (c) Meetings shall be held at least every 90 days or at 6 the call of the Council chairman, who shall be elected by the 7 Council. 8 (d) Each member shall be reimbursed for reasonable and 9 necessary expenses actually incurred in the performance of 10 his official duties. 11 (e) The Council shall adopt written procedures to govern 12 its activities. Consultants shall be provided for the Council 13 from appropriations made for such purpose. 14 (f) The Council shall make recommendations to the 15 Governor for developing and administering a State plan to 16 provide services for spinal cord and head injured persons. 17 (g) No member of the Council may participate in or seek 18 to influence a decision or vote of the Council if the member 19 would be directly involved with the matter or if he would 20 derive income from it. A violation of this prohibition shall 21 be grounds for a person to be removed as a member of the 22 Council by the Governor. 23 (h) The Council shall: 24 (1) promote meetings and programs for the 25 discussion of reducing the debilitating effects of spinal 26 cord and head injuries and disseminate information in 27 cooperation with any other department, agency or entity 28 on the prevention, evaluation, care, treatment and 29 rehabilitation of persons affected by spinal cord and 30 head injuries; 31 (2) study and review current prevention, 32 evaluation, care, treatment and rehabilitation 33 technologies and recommend appropriate preparation, 34 training, retraining and distribution of manpower and -4- LRB9000351MWpcam03 1 resources in the provision of services to spinal cord and 2 head injured persons through private and public 3 residential facilities, day programs and other 4 specialized services; 5 (3) recommend specific methods, means and 6 procedures which should be adopted to improve and upgrade 7 the State's service delivery system for spinal cord and 8 head injured citizens of this State; 9 (4) participate in developing and disseminating 10 criteria and standards which may be required for future 11 funding or licensing of facilities, day programs and 12 other specialized services for spinal cord and head 13 injured persons in this State;and14 (5) report annually to the Governor and the General 15 Assembly on its activities, and on the results of its 16 studies and the recommendations of the Council; and 17 (6) be the advisory board for purposes of federal 18 programs regarding traumatic brain injury. 19 (i) The Department of Human Services may accept on 20 behalf of the Council federal funds, gifts and donations from 21 individuals, private organizations and foundations, and any 22 other funds that may become available. 23 (Source: P.A. 89-507, eff. 7-1-97.)"; and 24 by deleting all of pages 13 and 14; and 25 on page 15, by deleting lines 1 and 2.
