 1                    AMENDMENT TO SENATE BILL 773
 2        AMENDMENT NO.     .  Amend Senate Bill 773 on page 1,  by
 3    replacing lines 1 and 2 with the following:
 4        "AN ACT concerning women"; and
 5    on  page  1,  by  inserting  immediately  below  line  4  the
 6    following:
 7        "Section  1.  Short  title.  This Act may be cited as the
 8    Commission on the Status of Women Act.
 9        Section 5.  Creation; members.  A commission, to be known
10    as the Commission on the Status of Women, is  created  within
11    the Department of Human Rights.
12        The Commission shall consist of 12 members, including:  4
13    members  of the General Assembly, one each to be appointed by
14    the Speaker of the House  of  Representatives,  the  Minority
15    Leader  of the House of Representatives, the President of the
16    Senate, and the Minority Leader of the Senate; and 8  members
17    of the public appointed by the Governor.
18        Members appointed from the public may include but are not
19    limited  to persons who are active in and knowledgeable about
20    the following areas: health and  human  services,  education,
21    business  and  industry,  science  and  technology,  arts and

 1    culture, the promotion of social and  economic  justice,  law
 2    and government, and volunteerism.
 3        At  least  9 of the 12 members of the Commission shall be
 4    women.  The membership of the Commission  shall  reflect  the
 5    diversity   of  this  State's  population.   The  legislative
 6    leaders and the Governor shall consult with  individuals  and
 7    organizations  that  promote the advancement of women to seek
 8    their recommendation of persons to serve as public members of
 9    the Commission.
10        Section 10.  Terms.  The members of the Commission  shall
11    be  appointed  every  2 years for terms expiring on July 1 of
12    each succeeding odd-numbered year.  The public members  shall
13    serve  until  their  respective  successors are appointed and
14    qualified.  The members from the General Assembly shall serve
15    until their respective successors are appointed or until  the
16    termination  of  their  legislative service, whichever occurs
17    first.   Vacancies  occurring  because  of   the   death   or
18    resignation  of  a  member  shall be filled by the appointing
19    authority for the group in which the vacancy occurs.  The new
20    member shall serve for the  remainder  of  the  term  of  the
21    position that was vacated.
22        Section  15.  Compensation.  Commission members shall not
23    receive  compensation  for  their  services  but   shall   be
24    reimbursed for necessary expenses incurred in the performance
25    of their duties.
26        Section  20.  Organization; rules.  The Commission shall,
27    within 30 days after all of the members have been  appointed,
28    appoint  a secretary to keep a record of its proceedings, and
29    any  other  officers  that   it   considers   necessary.    A
30    Chairperson  shall  be  designated  by  the  Governor every 2
31    years.   The  Commission  may  make   any   rules   for   the

 1    administration  of  the  Commission that are not inconsistent
 2    with this Act.
 3        Section   25.  Staff   and   assistants.    Subject    to
 4    appropriations,  the Department of Human Rights shall provide
 5    the necessary staff and assistance for the Commission.
 6        Section 30.  Offices.   Subject  to  appropriations,  the
 7    Commission  shall  maintain  an office for the transaction of
 8    business in any city in the State  that  the  Commission  may
 9    designate.
10        Section 40.  Powers and duties.
11        (a)  The Commission shall do all of the following:
12             (1)  identify through research, data collection, and
13        public hearings, barriers to women's equality;
14             (2)  maintain  and make available to the appropriate
15        appointing authorities lists  of  persons  qualified  for
16        appointment to positions in State government;
17             (3)  educate  the  public on the status of women and
18        on the impact of public  policy  on  women,  and  analyze
19        current  and  proposed public policies to determine their
20        impact  on  women  and  report  the   analysis   to   the
21        appropriate authorities;
22             (4)  issue   reports   and  recommendations  to  the
23        executive and legislative branches  of  State  government
24        and  to  the  general  public  regarding  women's  policy
25        issues; and
26             (5)  help  the  public  and  private sectors develop
27        programs  and   services   for   women,   and   encourage
28        collaboration  between  the  Commission  and other public
29        agencies, institutions, and organizations  on  issues  of
30        mutual interest on them.
31        (b)  The  Commission  shall  also  study  and analyze all

 1    facts relating the Illinois laws, rules, and guidelines  with
 2    respect to equal protection under the Illinois Constitution.
 3        (c)  The Commission may do the following:
 4             (1)  Create   standing   or  special  committees  as
 5        needed.  These standing or special  committees  shall  be
 6        chaired  by  a  member  of the Commission but may include
 7        members who are not members of the Commission.
 8             (2)  Survey activity in the area of status of  women
 9        carried  on  by  any commission, agency, or department of
10        the  federal  government,  any  State,  or  any   private
11        organization or association and may cooperate with any of
12        those entities in conducting investigations and studies.
13        Section 45.  Gifts and grants.  The Commission may accept
14    monetary  gifts  or  grants from the federal government or an
15    agency of the federal government, any  charitable  foundation
16    or  professional  association,  or any other reputable source
17    for the implementation of any program necessary or  desirable
18    for carrying out the general purposes of the Commission.  The
19    gifts  and  grants  shall be held by the State Treasurer in a
20    special trust fund outside the State treasury and expended as
21    directed by the Commission in the exercise of its powers  and
22    the performance of its duties as prescribed by law.
23        Section  50.  Reports  and recommendations.  On or before
24    February 1 of each year, the Commission  shall  make  a  full
25    report  of  its proceedings for the year ending December 1 to
26    the Governor  and  members  of  the  General  Assembly.   The
27    Commission  may  submit any recommendations pertaining to its
28    affairs that it deems desirable and any  recommendations  for
29    legislative  consideration and action that it deems necessary
30    or desirable with the report.
31        The requirement  for  reporting  shall  be  satisfied  by
32    filing  copies  of the report with the Governor; the Speaker,

 1    Minority Leader, and Clerk of the House  of  Representatives;
 2    the  President, Minority Leader, and Secretary of the Senate;
 3    and the Legislative Research Unit as required by Section  3.1
 4    of  the  General  Assembly  Organization  Act;  and by filing
 5    additional  copies   with   the   State   Government   Report
 6    Distribution  Center  for the General Assembly as is required
 7    under subsection (1) of Section 7 of the State Library Act.";
 8    and
 9    on page 1, line 5, by replacing "Section  5."  with  "Section
10    100.".
