Amend Senate Bill 596 by replacing 3 the title with the following: 4 "AN ACT to amend the Clerks of Courts Act by changing 5 Section 27.7."; and 6 by replacing everything after the enacting clause with the 7 following: 8 "Section 5. The Clerks of Courts Act is amended by 9 changing Section 27.7 as follows: 10 (705 ILCS 105/27.7) 11 (This Section may contain text from a Public Act with a 12 delayed effective date) 13 Sec. 27.7. Children's waiting room. The expense of 14 establishing and maintaining a children's waiting room for 15 children whose parents or guardians are attending a court 16 hearing as a litigant or witness in counties over 180,000 17500,000and under 3,000,000 in population shall be borne by 18 the county. To defray that expense in any county having 19 established a children's waiting room or that elects to 20 establish such a system, the county board may require the 21 clerk of the circuit court in the county to charge and -2- LRB9003274DJcdam 1 collect a children's waiting room fee of not less than $2 nor 2 more than $5. The fee shall be paid at the time of filing the 3 first pleading, paper, or other appearance filed by each 4 party in all civil cases. No additional fee shall be required 5 if more than one party is presented in a single pleading, 6 paper, or other appearance. The fee shall be collected in 7 the manner in which all other fees or costs are collected. 8 Each clerk shall commence the charges and collection upon 9 receipt of written notice from the chairman of the county 10 board together with a certified copy of the board's 11 resolution. The clerk shall file the resolution of record in 12 his or her office. 13 The fees shall be in addition to all other fees and 14 charges of the clerks, shall be assessable as costs, and may 15 be waived only if the judge specifically provides for the 16 waiver of the children's waiting room fee. The fees shall be 17 remitted monthly by the clerk to the county treasurer, to be 18 retained by the treasurer in a special fund designated as the 19 children's waiting room fund. The fund shall be audited by 20 the county auditor, and the county board shall make 21 expenditure from the fund in payment of any cost related to 22 the establishment and maintenance of the children's waiting 23 room, including personnel, heat, light, telephone, security, 24 rental of space, or any other item in connection with the 25 operation of a children's waiting room. 26 The fees shall not be charged in any matter coming to the 27 clerk on a change of venue, nor in any proceeding to review 28 the decision of any administrative officer, agency, or body. 29 (Source: P.A. 89-717, eff. 1-1-98.) 30 Section 95. No acceleration or delay. Where this Act 31 makes changes in a statute that is represented in this Act by 32 text that is not yet or no longer in effect (for example, a 33 Section represented by multiple versions), the use of that -3- LRB9003274DJcdam 1 text does not accelerate or delay the taking effect of (i) 2 the changes made by this Act or (ii) provisions derived from 3 any other Public Act. 4 Section 99. Effective date. This Act takes effect upon 5 January 1, 1998.".
