Provides that the Law does not apply to the work of a 14 or 15 year old minor in a program organized and supervised by a park district with a population of less than 500,000. Prohibits a minor under 16 from working between 10 p.m. (rather than 9 p.m.) and 7 a.m. during school summer vacation periods (rather than from June 1 until Labor Day). Adds provisions regarding the permitted working hours of minors over 14 who are employed by park districts or municipal parks and recreation departments. LRB9002348WHmg SB476 Enrolled LRB9002348WHmg 1 AN ACT to amend the Child Labor Law by changing Sections 2 3 and 7. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Child Labor Law is amended by changing 6 Sections 3 and 7 as follows: 7 (820 ILCS 205/3) (from Ch. 48, par. 31.3) 8 Sec. 3. Except as hereinafter provided, no minor under 9 16 years of age shall be employed, permitted, or allowed to 10 work in any gainful occupation mentioned in Section 1 of this 11 Act for more than 6 consecutive days in any one week, or 12 more than 48 hours in any one week, or more than 8 hours in 13 any one day, or be so employed, permitted or allowed to work 14 between 7 p.m. and 7 a.m. from Labor Day until June 1 or 15 between 9 p.m. and 7 a.m. from June 1 until Labor Day. 16 The hours of work of minors under the age of 16 years 17 employed outside of school hours shall not exceed 3 a day on 18 days when school is in session, nor shall the combined hours 19 of work outside and in school exceed a total of 8 a day; 20 except that a minor under the age of 16 may work both 21 Saturday and Sunday for not more than 8 hours each day if the 22 following conditions are met: (1) the minor does not work 23 outside school more than 6 consecutive days in any one week, 24 and (2) the number of hours worked by the minor outside 25 school in any week does not exceed 24. 26 A minor 14 or more years of age who is employed in a 27 recreational or educational activity by a park district or 28 municipal parks and recreation department while school is in 29 session may work up to 3 hours per school day twice a week no 30 later than 9 p.m. if the number of hours worked by the minor 31 outside school in any week does not exceed 24 or between 10 SB476 Enrolled -2- LRB9002348WHmg 1 p.m. and 7 a.m. during that school district's summer 2 vacation, or if the school district operates on a 12 month 3 basis, the period during which school is not in session for 4 the minor. 5 (Source: P.A. 87-139.) 6 (820 ILCS 205/7) (from Ch. 48, par. 31.7) 7 Sec. 7. No minor under 16 years of age shall be 8 employed, permitted or allowed to work: 9 1. In, about or in connection with any public messenger 10 or delivery service, bowling alley, pool room, billiard room, 11 skating rink, exhibition park or place of amusement, garage, 12 or as a bell-boy in any hotel or rooming house or about or in 13 connection with power-driven machinery; except this 14 subsection shall not apply to ice skating rinks owned and 15 operated by a school or unit of local government; 16 2. In the oiling, cleaning or wiping of machinery or 17 shafting; 18 3. In or about any mine or quarry; provided that office 19 and messenger and other non-hazardous employment shall not be 20 prohibited by this Act; 21 4. In stone cutting or polishing; 22 5. In or about any hazardous factory work; 23 6. In or about any plant manufacturing explosives or 24 articles containing explosive components, or in the use or 25 transportation of same; provided that office and messenger 26 and other non-hazardous employment shall not be prohibited by 27 this Act; 28 7. In or about plants manufacturing iron or steel, ore 29 reduction works, smelters, foundries, forging shops, hot 30 rolling mills or any other place in which the heating, 31 melting, or heat treatment of metals is carried on; provided 32 that office and messenger and other non-hazardous employment 33 shall not be prohibited by this Act; SB476 Enrolled -3- LRB9002348WHmg 1 8. In the operation of machinery used in the cold 2 rolling of heavy metal stock, or in the operation of 3 power-driven punching, shearing, stamping, or metal plate 4 bending machines; 5 9. In or about sawmills or lath, shingle, or 6 cooperage-stock mills; provided that office and messenger and 7 other non-hazardous employment shall not be prohibited by 8 this Act; 9 10. In the operation of power-driven woodworking 10 machines, or off-bearing from circular saws; 11 11. In the operation of freight elevators or hoisting 12 machines and cranes; 13 12. In spray painting or in occupations involving 14 exposure to lead or its compounds or to dangerous or 15 poisonous dyes or chemicals; 16 13. In any place or establishment in which intoxicating 17 alcoholic liquors are served or sold for consumption on the 18 premises, or in which such liquors are manufactured or 19 bottled, except as follows:; provided that20 (A) bus-boy and kitchen employment, not otherwise 21 prohibited, when in connection with the service of meals 22 at any private club, fraternal organization or veteran's 23 organization shall not be prohibited by this subsection; 24 (B) this subsection 13 does not apply to employment 25 that is performed on property owned or operated by a park 26 district, as defined in subsection (a) of Section 1-3 of 27 the Park District Code, if the employment is not 28 otherwise prohibited by law; 29 14. In oil refineries, gasoline blending plants, or 30 pumping stations on oil transmission lines; 31 15. In the operation of laundry, dry cleaning, or dyeing 32 machinery; 33 16. In occupations involving exposure to radioactive 34 substances; SB476 Enrolled -4- LRB9002348WHmg 1 17. In or about any filling station or service station; 2 18. In construction work, including demolition and 3 repair; 4 19. In roofing operations; 5 20. In excavating operations; 6 21. In logging operations; 7 22. In public and private utilities and related 8 services; 9 23. In operations in or in connection with slaughtering, 10 meat packing, poultry processing, and fish and seafood 11 processing; 12 24. In operations which involve working on an elevated 13 surface, with or without use of equipment, including but not 14 limited to ladders and scaffolds; 15 25. In security positions or any occupations that 16 require the use or carrying of a firearm or other weapon; or 17 26. In occupations which involve the handling or storage 18 of blood, blood products, body fluids, or body tissues. 19 (Source: P.A. 88-365.)
