Provides that a scholarship recipient who fails to fulfill his or her designated-shortage-area practice requirement shall pay interest at 9% per annum on the unpaid balance of the principal amount required to be paid by the recipient as a result of that failure. LRB9002354THcb SB331 Enrolled LRB9002354THcb 1 AN ACT to amend the Family Practice Residency Act by 2 changing Section 10. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Family Practice Residency Act is amended 6 by changing Section 10 as follows: 7 (110 ILCS 935/10) (from Ch. 144, par. 1460) 8 Sec. 10. Scholarship recipients who fail to fulfill the 9 obligation described in subsection (d) of Section 3.07 of 10 this Act shall pay to the Department a sum equal to 3 times 11 the amount of the annual scholarship grant for each year the 12 recipient fails to fulfill such obligation. A scholarship 13 recipient who fails to fulfill the obligation described in 14 subsection (d) of Section 3.07 shall have 30 days from the 15 date on which that failure begins in which to enter into a 16 contract with the Department that sets forth the manner in 17 which that sum is required to be paid. If the contract is 18 not entered into within that 30 day period or if the contract 19 is entered into but the required payments are not made in the 20 amounts and at the times provided in the contract, the 21 scholarship recipient also shall be required to pay to the 22 Department interest at the rate of 9% per annum on the amount 23 of that sum remaining due and unpaid. The amounts paid to the 24 Department under this Section shall be deposited into the 25 Community Health Center Care Fund and shall be used by the 26 Department to improve access to primary health care services 27 as authorized by Section 55.53(a) of the Civil Administrative 28 Code of Illinois. 29 The Department may transfer to the Illinois Development 30 Finance Authority, into an account outside the State 31 treasury, moneys in the Community Health Center Care Fund as SB331 Enrolled -2- LRB9002354THcb 1 needed, but not to exceed an amount established, by rule, by 2 the Department to establish a reserve or credit enhancement 3 escrow account to support a financing program or a loan or 4 equipment leasing program to provide moneys to support the 5 purposes of Section 55.53(a) of the Civil Administrative Code 6 of Illinois. The disposition of moneys at the conclusion of 7 any financing program under this Section shall be determined 8 by an interagency agreement. 9 (Source: P.A. 87-655; 88-535.)
